WHEREAS, NORMAN HISTAND has petitioned'the Board of County Com,missioners
of Garfie'ld County, Colorado, for an exemption under C.R.S. (1973) Section
30-28-10.| (10) (a) - (d) as amended, and the Subdivision Regulations of
Garfield County, Colorado, adopted September 1,1972 and amended April .l4,
1975, Sections l.O2.l7 (d) and 3.02.01, for the purposes of making a boundary
adjustment on two (2) lots owned by Petitioner consisting of 2.16 acres and
2.032 acres, more or less, and more particularly described as follows:

A tract o f land situated in Lot 9, Section 1, Township 7
South, Range 89 West, 6th P.M., Garfield County, Colorado,

The above described parcels of land, together, contain a total
of 2.032 acres, more or less
WHEREAS, the Petitioner has shown to the satisfaction of the Board of
County Commissioners of Garfield County, Colorado, that he desires said
exemption for the purpose of making a boundary adiustment, and further that
said exemption will not result in any third-party ownership or additional
building site, and should therefore, be exempted from the definition of the
terms "subdivision" and "subdivided land" as set forth in C.R.S. (.l973)
Section 30-28-19.I (.l0) (a) - (O) as amended;
IIHEREAS, the Board of County Conrnissioners by a resolution dated May
20, 1974, granted an exemption to the Subdivision Regulations thereby allowing
the transfer of a 2.032 acre parcel of land from 0live M. Heuschkel to Grace
and Norman Histand, provided that said parcel would be considered separate
from other land owned by Grace and Norman Histand and would be conveyed as
one separate parcel of land comprising 2.032'acres;
