PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted September 1,
1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01 the undersigned

petitions the Board of County Commissioners of Garfield County, Colorado, to
exempt by resolution the division of 0 acre tract of land into
tracts of approximately 217
acres each, more or less, and
which tract to be subdivided is more particularly described as follows:

from the definitions of "subdivision" and "subdivision land" as the terms are used
and deft -led in C.R.S. (1973) Section 30-28-101 (a) -(d) and the Garfield County
Subdivision Regulations, for the reasons stated below:

Beginning at a point whence an iron post with a brass cap found in
place and properly marked for the Southeast corner of Section 33
in said Township and Range bears S. 82°38'00" E. 1113.89 feet
and S. 66°56'42" E. 7923.014 feet; thence S 82°38'00" E. 265.05
feet; thence S. 01°56'45"W. 1336.21 feet; thence N. 82°38'00" W.
258.90 feet; thence N. 01°43'00" E. 1336.80 feet to the point
of beginning.
Subject to:
Richt of the proprietor of a vein or lode to extract and remove h;s
ore therefrom, should the same be found to penetrate or intersect
the premises hereby granted as reserved in U.S. Patent recorded
May 8, 1895, in Book 12 at page 363 as Reception No. 18378-„
Right of way for ditches or canals constructed by the authority
of the United States, as reserved in U.S. Patent recorded May 8,
1895 in Book 12 at page 363 as Reception No. 18378.
Restrictions as contained in instrument recorded November 14, 1968

as disclosed by Map and Statement recorded June 7, 1887 in Book

One-half of all oil, gas, coal and minerals underlying and with
Lots 9,10,10 and 19 in said Sec. 32, together with the right to
orospect for, mine and remove the same to construct facilities
and equipment for such purposes, as reserved to Vera S. Herin and
Rudolph Herin by instrument recorded November 15, 1950 in Book 25E
at page 148 and any and all assignments thereof or interests therein.
Right of way for the continued uninterrupted flow of water in the

Re: Hagman and Finholm Exemptions
We have reviewed the material submitted for the above referenced
exemption applications. The developers propose to use wells for the water
supply which would intercept ground water tributary to the Roaring Fork
River at a point where there is still water available for appropriation. This
office can issue individual domestic well permits to individual lot purchasers
and we recommend approval of the Hagman and Finholm Exemptions.
