My clients tried to obtain a Well Permit for the above-referenced parcel, however, the
Division of Water Resources is requiring proof that the parcel was legally created. Although my
clients' property is currently taxed as a separate parcel by the County, how and when the parcel
became a separate parcel is in question. The purpose of this letter is to request a Resolution
declaring that the County considers the subject property a separate and legally created parcel.
The subject property is located in the SW%NE% and NW%SEYq of Section 6, Township
6 South, Range 91 West of the 6th P.M. and has an old schoolhouse located thereon. I have
enclosed a copy of a boundary survey and the Assessor's map depicting the same. The property
as it exists today was created by a boundary line adjustment which merged a 1 acre parcel that
apparently was once owned and occupied by the School District (the "school Parcel") and
approximately 2 acres of an adjoining parcel. While the creation of the School Parcel appears to
have taken place prior to 1921, as evidenced by several documents of record (copies attached), a
deed conveying the School Parcel to the School District was never recorded in the Garfield County
records.
The prior existence ofthe School Parcel is evidenced by a deed recorded February 15,l92l
in Book 125 at Page 36 which conveyed property located in said NW%SE% of Section 6,
excepting therefrom "the ground fenced and used for school purposes by School District No. 4".
In addition, a Contract dated November 5,1971was recorded April 25,1974 in Book 458 at Page
388 for the purchase of a 4.49-aqe parcel located in said SW%NE% of Section 6, which was

oobounded on the east by a schoolhouse, District No. 4, and school property". I have also enclosed
a copy of a map prepared by Scarrow and Walker dated October 1975 which depicts said,4.49-acre
parcel labeled "DeBaca", as well as an adjacent 1.O4-acre tract of land to the east labeled 'oSchool,,
upon which the old schoolhouse is located.
Obviously, at some point, the School District discontinued use of the School Parcel and
in 1998, a predecessor in interest to the current owlers of the subject property obtained a deed
from Garfield School District No. RE-2 (School District No. 4's successor). As mentioned above,
additional property was subsequently added to the School Parcel via a boundary line adjustment
creating the parcel that exists today. Although there is no recorded deed to the School District,
the evidence as outlined above, would seem to indicate that the School owned and occupied a
separate parcel of land for a considerable period of time dating back to at least 1921 .
Taking into account the foregoing and assuming the School Parcel existed as a separate
parcel, the subsequent boundary line adjustment with the adjoining property was performed in
accordance with C.R.S. $30-28-101(10)(c)(VIII) and Section 1:64 of the Garfield Counry
Subdivision Regulations, thereby legally creating the subject parcel. Furthermore, pursuant to
C.R.S. $30-28-101(10)(d), the Board of County Commissioners may, by Resolution, exempt from
the definition of "subdivision" any division of land if the Board of County Commissioners
determines that such division is not within the purposes of the statute.
Accordingly, my clients are requesting a Resolution from the Board of County
Commissioners declaring that the subject property is, in fact, a separate and legally created pu...i.

Division of Water Resources is requiring proof that the parcel was legally created' Although my
clients' property is currently taxed u, ul"pu.ute parcel tyle County, how and when the parcel
became a separate parcel is in question. 'The purpose or trris letter is to request a Resolution
declaring that the County considers the subject properfy a separate and legally created parcel'
The subject property is located in the SW%NE% and NW%SE% of Section 6' Township

enclosed a copy of a boundary survey and the Assessor's map depicting the-same- The property

"bounded on the east by a schoolhouse, District No. 4, and school property". I have also enclosed
a copy of a map pr.pur"d by Scarrow and Walker dated October 1975 which depicts said 4.49-acre
pur..i labeled;'DeBaca", as well as an adjacent I .04-acre tract of land to the east labeled "School"
upon which the old schoolhouse is located.
Obviously, at some point, the School District discontinued use of the School Parcel and
in 1998, a predecessor in interest to the current owners of the subject property obtained a deed
from Garfield School District No. RE-2 (School District No. 4's successor). As mentioned above,
additionat property was subsequently added to the School Parcel via a boundary line adjustment
creating the parcei that exists ioday. Although there is no recorded deed to the School District,
the evidence as outlined above, would seem to indicate that the School owned and occupied a
separate parcel of land for a considerable period of time dating back to at least 1921.
Taking into account the foregoing and assuming the School Parcel existed as a separate
parcel, the subsequent boundary line adjustment with the adjoining property was performed in
accordance with C.R.S. $30-28-101(10)(c)(V[I) and Section l:64 of the Garfield County
Subdivision Regulations, thereby legally creating the subject parcel. Furthermore, pursuant to
C.R.S. $30-28-101(lQXd), the Board of County Commissioners may, by Resolution, exempt from
the definition of "subdivision" any division of land if the Board of County Commissioners
determines that such division is not within the purposes of the statute.
Accordingly, my clients are requesting a Resolution from the Board of County
Commissioners declaring that the subject property is, in fact, a separate and legally created parcel.
