Dear Mark:
We have been asked to advise Mr. and Mrs. Haas on their pending contract of sale of their
property on Miller Lane and Antonelli Lane lying west of Silt. They apparently have received
approval for a subdivision exemption of 4.926 acres from this parcel , but the plat of same has not
yet been tendered by Mr. and Mrs. Haas for execution by County officials and recording . If there
is any other action required , please advise.
Another matter which has been raised by the purch asers of th e residual parcel is the presence
of three Antlers Orchard Development lots within the gross acreage of this parcel. Enclosed is a
County Assessor 's map of the Haas parcel, which is designated as Parcel No. 2179-052-00-310.
This parcel includes AOD Lots 41, 42 and 43 . It has been my advice to Mr. and Mrs. Haas that , in
conformance with other similar properties which contain these pre-1973 lots, they may be sold or
re -subdivided by a revision to the final plat without requiring any additional government approval.
If the Planning Department has any different view of th e matter, please advise.

To w horn it may concern,
Upon the request of Mr. George, I have inspe cted the property at 0058
County road 216 belonging to Mr. Jake Haas. After completion of this
inspection I find no problems with the division of this property at this
time. However, the property is located near the boundary of the Rille
Fire Protection District and the Silt / New Castle Fire Protection
District. I have tried to make contact with the Assistan t Chief of t he
Silt / New Castle Fire Protection District and have been unable to do so.
I will continue to try to contact them and make sure that their concerns
are addressed.

Morgan, in reference to the Haas property l ocated near the
junction of Mil !er Lane and Antone! I i Lane. As I understand it,
this property is appro x imatel y 104 acres and your c li ent, Mr.
Haas, is wishing to sp lit a 100 acre parcel off and sel 1 it,
while retaining the remaining 4 acres for personal u se . The 100
acre parcel is to remain agriculture as is the 4 acre parcel.
Some of this land, if no t all of it lie s in the Si l t-New
Castle Fire Protection District. The District doe s s uppl y fire
protection to the properties i n the Fire District a nd expresses
no concer n with the sale or division of th e property as expre s sed
above. The Di s trict does wish to co mment o n any further changes
with this property use.

C.R.S. (1973) Section 30-28-101 (10) (a) -(d) and the Garfield County
Subdivision Regulations for the reasons stated below:

SUBMITTAL REQUIREMENTS:
An application which satisfies the review criteria must be submitted with
all the following information.
A. Sketch map at a minimum scale of 1"=200' showing the legal
description of the property, dim e nsion and area of all lots or
separate interests to be created, access to a public
right-of-way, and any proposed easeraents for drainage,
irrigation, access or utilities;
B. Vicinity map at a minimum scale o f l"-2000' showing the general
topographic and geographic relation of the proposed exemption to
the surrounding area within two (2) miles, forwhich a copy of
U.S.G.S. quadrangle map may be used.
C. Copy of the deed showing ownership by the applicant, or a letter
from the property owner(s) if othe r than the applicant; and
D. Names and addresses of owners of record of land immediately
adjoining and within 200 feet of t he proposed exemption, mineral
owners . and lessees of mineral owners of record of the property to
be exempted, and tenants of any structure . proposed for
conversion; and
E. Evidence of the soil types and characteristics of each type; and
F. Proof or legal and adequate source of domestic water for each lot
created, method of sewage disposal, and letter of approval of
fire protection plan from appropri a te fire district; and
G. If connection to a community or municipal water or sewer system
is proposed, a letter from the governing boJy stating a
willingness to serve; and
U. Narrative explaining why exemption is being requested; and
I. It shall be demonstrated that the parcel existed as described on
January 1, 1973 or the parcel as it exists presently is one of
not more than three parcels created from a larger parcel as it

This letter is written in response to yours of June 17, 1992. Enclosed
please find a packet of data that we received from the Soil
Conservation Service that identifies the subject property and provides
evidence of soil types and characteristics of each type. We would like
to have this information returned to us when you are finished with it
and have made copies of anything that you wish to keep in the file.
'l'he remaining 50 acre parcel is actually slightly larger than 100
acres. We did not identify the total parcel only for convenience
because the total farm is split by a county road. The total farm does
have a farmhouse on the north side of the county road which has a well
that has been in service for many years. Its drilling and start-up
predates the statutory scheme for permitting, accordingly there is no
permit number or other documentation to provide to you on this well.
Total property consists of approximately 105 acres. This would allow
for three wells under the one well per 35 acre criterion. We believe
this should satisfy all requirements and concerns with respect to
sources of domestic water.
We have spoken to Mike Morgan of the Rifle Fire Protection District.
He will coordinate with the Silt Fire Chief to provide a joint letter
to you. The boundary between the two districts is Miller Lane which
fronts on this property.
Enclosed is a legible copy of the legal description for the subject
parcels.

C. Copy of the deed showing ownership by the applicant, or a letter
from the property owner(s) if other than the applicant; and
D. Names and addresses of owners of record of land immeuiately
adjoining and within 200 feet of the proposed exemption, mineral
owners . and lessees of mineral owners of record of the property to
be exempted, and tenants of any structure proposed for
conversion; and
E. Evidence of the soil types and characteristics of each type; and
F. Proof of legal and adequate source of domestic water for each lot
created, method of sewage disposal, and letter of approval of
fire protection plan from appropriate fire district; and
G. If connection to a community or municipal water or sewer system
is proposed, a letter from the governing boJy stating a
willingness to serve; and
II. Narrative explaining why exemption is being requested; and
I. It shall be demonstrated that the parcel existed as described on
January 1, 1973 or the parcel as it exists presently is one of
not more than three parcels created from a larger parcel as it
eAisted on January 1, 1973.

FROM THE GARFIELD COUNTY SUBDIVISION REGULATION S
FOR JAKE HAAS AND AMENDING RESOLUT ION #80-186
WHEREAS, Jake Haas has oetitioned the Board of County Commissioners
of Garfield County, Colorado, for an exemption from the definition of the terms
11 subdivision 11 and "subdivided land" under C.R.S. 1973, 30-28-101 (10) (a)-(d),
as amended, and the Subdivision Regulations of Garfield County, Colorado,
adopted January 2, 1979, Sections 2.02 .21 (d) and 3.02.0l for the division of
a 73.962 acre tract descri bed as follows: Beg inning at the north quarter
corner of Section 5, Township 6 South, Range 92 West of the 6th Principal
Meridian as established by a section split survey plat by the Garfield County
Surveyor (1964); thence N.89°54 1 19" E. 705 .3 5 fee t along the north line of
said Section 5; thence along a fence line in place tne following four courses:

WHEREAS, th e Petitione r has demonstrated to the satisfaction of the Board
of County Corrnnissioners of Garfield County, Colorado , that the proposed division
does not fall within the purposes of Part l, Article 28, Title 30, Colorado Revised
Statutes 1973, as amended, for the reason that the impact created does not warrant
a full subdivision review; and
WHEREAS, the Petitio ner has demonstrated to the satisfaction of the Board
of County Commissioners of Gar fi el d County, Co l orado, that there is a reasonable
probability of locating domestic water on ea ch of sa id tracts, that there is adequate
ingress and egress to said t racts , that the loc ati on of septic tan ks will be per-
mitted by the Colorado Depar tment of Hea lth , tha t the requested division is not part
of an existing or lar ge r dev elopment and does not f al l within the general purposes
and intent of the subdivision regulRtions of the State of Colorado and the County
of Garfield, and should, therefore , be ex empted from the definition of the terms
"subdivision " and "subdivided landi; as s et forth in C.R.S. 1973, 30-28-101 (10)
(a)-(d), as amended;
NOW, THEREFORE, BE IT RESOLVED that the division of the above described
tracts "A", "B". "C", and "D " from the above described 73.962 acre tract is hereby
exempted from such definition s and said tract may be divided into tracts "A", "B",
"C", and "D", all as is more fully desc r i bed above, and said divided tract may be
conveyed in the form of such s mall er tra cts with out further compliance with the
aforesaid subdivision statutes and regulations; provided, however, that this
exemption is granted on the con dition and with the e xpress understandin g and agree-
ment of the Petitioner that no furt her exemptions be allowed on said tracts "A",
