(.l973) Section 30-28-l0l (.I0) (a) - (d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Sections .I.02.17(d) and 3.02.0.I, for the divisjon of a 20.723 acre parcel into two parcels of 7.283 and 13.440 acres, more or less, and more particular'ly described as follows : Parcel No- I A parcel in Garfie fol I ows : of td land in the Nl/3 N% Nl^l% Sec. 3.l, T5S, R92W,6th P.M., County, Colorado, be'ing more particularly described as Beginning at a point on the north line Sec. the north % corner Sec. 3l bears N. The above described parcel contains 7.283 acres' more or less' WHEREAS, the Petitioners have shown to the satisfaction of the Board of County Comnrissioners of Garfield County, Colorado, that they desire said exemption for the purpose of re-sale'into single-fam'i1y residential acreage; anci, WHEREAS, the Petitioners have demonstrated to the satisfact'ion of the Board that there is a reasonable probab'ility of locating domestic water on each of said tracts, that there is adequate ingress and egress to said tracts, that the location of septic tanks will be perm'itted by the Colorado Department of Health' that the requested division is in accordance with the genera'l purposes and intent of the Subdivision Regulations of the State of Colorado and the County of Garfield' and should, therefore, be exempted from the definition of the terms "subdivis'ion" and,,subdivided land" as set forth in C.R.S. (1973) Section 30-28-l0l (.10) (a) - (d) as amended; NOI^I THEREF0RE, uPon motion of [-atrt ()2*.-seconded bY 5 and caffi ed, saf d 20.723 acre tract of land is hereby exempted from such definition and transfer of said tract may be made by division into two tracts of 7.283 and 13.440 acres, more or less, all as is more fu1ly described above.
