BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
PETITION FOR EXEMPTION
Pursuant to C.R.S. (1973) Section 30-28-101 (10) (a) -(d) as amended, and
the Subdivision Regulations of Garfield County, Colorado, adopted September 1,
1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01 the under-
signed Norman L. Hammar
respectfully petitions the Board of County Commissioners of Garfield County,
Colorado, to exempt by resolution the division of 40.28 acre tract of
land into 3 tracts of approximately 13.35 acres each,
more or less, and which tract to be subdivided is more particularly described as
follows:

Tract of land described as Lot 3, Section 30, Township 5 South, Range
91 West of the 6th P.M. containing 40.28 acres, more or less.
from the definitions of "subdivision" and "subdivision land" as the terms are used
and defined in C.R.S. (1973) Section 30-28-101 (a) - (d) and the Garfield County
Subdivision Regulations, for the reasons stated below: The above described tract
is a farm with an old farmhouse & buildings. The land consists of a small
meadow, small hay fields, orchard plus non -tillable tree covered & rocky
land. The terrain lends itself well to being divided making some ideal
building sites with privacy assured by natural barriers. The land borders
the BLM to the north & County Road to the east. The East Lateral Canal from
Harvey Gap Reservoir runs thru the property supplying irrigation water. A
reliable domestic well has served the property for years as well as a spring
for livestock use. These ranchette sites made available should be an asset
to the area, each having access to road and utility lines.
In support of this petition the petitioner also submits the following:

lot subdivision and access.
(b) Vicinity Map.
✓(c) Statement on source of domestic water.

We have reviewed the exemption application for Mr. Norman
Hammar. Unfortunately, there is some confusion as to the location of
the parcel. Well records in this office indicate that the land is located
in Range 92 West and not 91 West as stated on the application. If the
land is situated in Range 91 West, we have no objection to the approval
of the exemption since it is in an area where unappropriated water is
available for domestic use. If the land is in Range 92 West, we would
have to evaluate the effect on Rifle Creek and do not recommend approval
at this time until the location is clarified.

STATEMENT ON SOURCE OF DOMESTIC WATER:
Domestic water is already supplied to one of the tracts, the
one with the set of improvements. That well is approximately 100
feet deep and supplies adequate amount of water for household use
plus a limited amount for lawn and garden watering. Other wells
in the area are reported to be from about 70 feet to 125 feet deep
with an occasional one being deeper. The water in all cases known
was reported to be potable water. The spring located on the tract
flows year round into a stock watering pond is another good indicator
of an adequate supply of underground water in the immediate vicinity.
The pond will go with one of the tracts other than the one with the
well. The irrigation canal that flows through the property no
doubt adds some water to the underground aquafier.
STATEMENT ON METHOD OF SEWAGE DISPOSAL:
The proposed method for sewage disposal is by way of the
conventional septic tank and leach field. This is the type of
system installed at the house and was installed according to a
previous owner in 1974. He stated that it was installed to the
State Health specifications and was inspected. The appearance of
the soil would lead one to believe that there would not be any
trouble in acquiring a very good perculation test.
100 YEAR FLOODPLAIN INFORMATION:
This tract of land does not have any live streams flowing
through the property, nor is there any such streams that joins
the property.

':OTE: The boundary lines for this survey of Lot 3, Section 30,
Township 5 South, Ranke 91 West were established from the existing
stone quarter Corner, the restoration of the Southwest Section
Corner of said Section 30, as shown on this nap, and from the
Surveyor General's office GLO Plat dated December 13, 1883. The
bearing source being established by solar observation using
2.00°24'00"W. between said comers, and the record GLO Plat
bearings being rotated left 00 24'00" to said solar bearing.
