HomeMy WebLinkAbout1.0 ApplicationBEFORE THE BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY, COLORADO PETITION FOR EXEMPTION Pursuant to C.R.S. 106-2-33 (3) (d) (1963), as amended, the undersigned, JERRY H. HAMAR respectfully petitions the Board of County Commissioners of Garfield County, Colorado to exempt by resolution three parcels of land, being a division of the Southerly portion of H.E.S. Survey No. 131 as shown on the plat attached hereto, and for the reasons as set forth herein: 1. That Petitioner purchased the described property in May of 1971, and said property contains a total of 53 acres, together with a well and residence improvements on the Southerly 23 acres thereof. 2. That Petitioner immediately undertook to improve the residence and the well situate thereon investing a total of $7,000.00. 3. That on July 7, 1971, and ever since that time, Petitioner listed, and has listed, said property for resale in separate parcels approximately as shown on the attached plat (see copy of listing agreement attached hereto). 4. That the Southerly portion of H.E.S. Survey No. 131 is a division of a larger ranch, which division was made some years prior hereto; that the nature of the land is such that it is uneconomical to engage in ranching thereon. 5. That Petitioner has contracted to sell the Southerly 23 acres of said land, together with the improvements situate thereon, to Thomas Stewart, a copy of said contract being attached hereto for reference; that said property contains a working domestic well producing potable water and a septic system. 6. That the remaining 30 acres has been divided by Petitioner into two parcels of 10 and 20 acres, respectively (see plat attached); that such division into parcels is for the purpose of resale as residential home sites, this being the only suitable purpose to which said land can be put; that location of septic systems on said two parcels has been approved by the Garfield County Sanitarian, that there is a reasonable likelihood that domestic wells may be located on said two parcels. 7. That Petitioner has contracted to sell the Northerly 10 acres of said land to Suzan Anderson, a copy of said contract being attached hereto for reference. 8. That insufficient suitable homesite locations exist on said land which would justify a division into smaller acreages by way of the subdivision laws of the State of Colorado and the County of Garfield; that such subdivision would in any event promote undue density of residential lots in said area and that the same is inconsistent with the purposes of the subdivision laws of the State of Colorado and the County of Garfield. 9. That the Contracts with Stewart and Anderson provide for a Restrictive Covenant in each deed prohibiting further division of said parcels into small tracts. WHEREFORE, Petitioner requests that the Board of County Commissioners of Garfield County, Colorado grant him an exemption to sell the above-described two parcels in accordance with the division shown/on the attached plat.
