WHEREAS, Charles E. and Viv'ian Griffjn have petitioned the Board of
County Comrnjssioners of GarfieId County, Co1orado, for an exemption from
the definition of the terms "subd'ivision" and "subdivided land" under c'R's'
.|g73,30-28-l0l (10) (a)-(d), as amended, and the subdivision Regulations of
Garfield county, colorado, adopted January 2, 1g7g, Sections 2 '02'21 (d)
and 3.02.0.l for the division of a .l0.0 acre tract described as follows:

WHEREAS, the Pet'itioners have demonstrated to the satisfaction of the
Board of county comnrissioners of Garfielcl county, colorado, that the proposed
division does not fall within the purposes of Part l, Article 28, Title 30n
Colorado Revjsed Statutes .l973, as amended, for the reason that the impact
created is not'larsJe enougrh to proceed through full subd"ivision review; and,
WHEREAS, the Petitioners have dernonstrated to the satisfaction of the
Board of County Conrnissioners of Garfie'ld County, Colorado, that there is a
reasonable probability of locating domestic water on each of said tracts, that
there is adequate ingress and eqress to said tracts, that the locatjon of
septic tanks will be permitted by the Colorado Department of Health, that
the requested div'ision is not part of an exist'ing or'larger development and
does not fall within the general purposes anci intent of the subdivision regula-
tions of the State of Colorado and the County of Garfield, and should, therefore,
be.exempted from the definition of the terms "subdivision" and "subdivided land"
. as set forth in c.R.S..|973,30-28-l0l (.|0) (a).(d), as amended;
