A.Site Descnftion: The subject parcels consist of existing and former agricultural
lands located on the north side of Highway 6 and24' Adjacent land uses include
agricultural lands, single family residences, mobile home park' and ranch land'

B. Project Description: The applicant is proposing to split the 138'02 acre parent
parcel into ttr.ee (3) parcels o f 20 .24, 13.69 and 104.09 acres each' The applicants
are proposing to provide water via wells, and handle sewage disposal by ISDS'

MAJOR ISSITFS ANN CONCFRNS
1. Subdivision: Section 8:10(Applicability-Exemptions) statesthattheBoardhas
discretionary authority to except a division of land from the definition of
subdivision. Followin! a review of *r. facts of each application' the Boardmay
approve conditionally or deny an exemption request' The board may not grant
an exemption unless the applicant can demonstrate compliance with zoning'
legal access, adequate water and sewer, state environmental health standards'
necessary road and drainage improvements, f,rre protection' adequate easements
and school imPact fees.
2. Exemrtion Regulations: Section 8.52 (A) of the Garf,reld county subdivision
Regulations states that no more than four (4) parcels will be created from any
parcel asthat parcel wasdescribed in the Records of the Garfreld county clerk
and Recorder,s Office in January l, 1973, and is not a part of a recorded
subdivision. The parent parcel tras been in its existing conhguration since 1939'
Section 8.52 (A) also allows the exemption of a parcel split by a county right-of-
way not be considered to have been ireated to have been created by exemption
withregardtothefour(4)lotlimitationotherwiseapplicable.
The two exemption parcels are located south of County Road 221' Therefore'
the northe* portion of the property, consisting of approximately 104'09 acres'
would qualify per the split of the County Road' Therefore' up to two (2)
additional parcels could be created from the two (2) parcels on the south side of
the countY road.
3. Zoning: All lots far exceed the minimum lot size requirements of 7,500 sq ft' for
the C/G zone district.
4. Legal Access: Access for the additional lots can be obtained from both County
Road221.aldstateHighway6&24.Noaccesseasementsarenecessary.
5. Water: The only source of water on the site are 15.60 shares in the Grand Ey ErugK-
Ditch company. The applicants are proposing to provide water to the
exemption purc"t, by individual wells. The provision of well permits will be the
responsibility of the purchasers of the exemption parcels' No response has been

responsibility of the purchasers of the exemption parcels. No response has been
received from the oivision of Water Resources, although discussions with the
local offrce (Dwight whitehead) concluded that the applicant should not have
a problem qualifying for a domestic well'
Sewage: sewage is proposed to be handled by ISDS. Soil mapping from scS
andHazards tvtapping iroduced by Lincoln-Devore Laboraties indicate that the
site does not appear to present any constraints to ISDS on the site'
Natural Hazards: county staffreferen cedhazards mapping conducted for the
County in 1976 by Lincoln-Devore Laboratories. The project site is not located
in an area of either slope and soil hazards. No plat notes are necessary in
regards to natural hazards'
Fire Protection. No response has been received by the Rifle Fire District
regardingtheprovisionoffireprotectiontothesite'

RECOMMENDATION
APPROVAL, subject to the following conditions:
1. All representations of the applicant shall be considered conditions of approval
unless otherwise stated by the applicant'
2. The applicant shall have 120 days to complete the required conditions of
approval. Extensions of 120 days may be granted by the Board for a period of
up to one (1) Year.
3. AFinalExemptionPlatwillbesubmitted, indicating thelegal description ofthe
property, dimension and area of all proposed lots or separate interests to be
created, access to a public right-of-way, and any proposed easements for
drainage, irrigation, access or utilities'
4. The applicant shall submit $200.00 in School Impact Fees prior to the siening
of an exemPtion Plat.
5. prior to approval of a Final Plat, the applicants will submit a letter of approval
from the Rifle Fire District.

Prior to the approval of a building permit for either parcel, a well permit must
be submitted to the Garlreld County Building Department' If a well is shared
by the exemption lots, the following conditions will also apply:
A) That easements for waterlines and for access and maintenance of

Dear Mr. Michaelson:
We have reviewed the above referenced proposal to divide a 138.02 acre parcel intg threg
parcels of.20.24 acres, 13.69 acres and 104.09 airei. Your letter indicates the property is located
ir, S".tior,, L1 and 12, T 6 S, R 93 W, but the map provided indicates the property is locatedin
Sections Lr"dX. The information submitted did not indicate the proposed configuration of the
*o"" pu.."t* tto curent source of water on the site is identified other than shares in the Grand
River bitch. The proposed water supply is listed simply as "wells". This proposed split is located
in an area fibutary to the Colorado-River at a point where the stream system is considered to be
overappropriated. New well permits cannot generally be issued for lots of less than 35 acres
without an augmentation plan approved by water court.
On Novemb er 2,1978, a well, located in the NE 1/4 of the NE 1/4 of Sec. 11, T 6 S, R 93
W., 6TH p.M., was late register"d ,rnie, permit no. 103108 for household purposes in two single-
family dwellings and the watering of lfuestock. If this well exists, and is to service the above
referenced parJels, it may be used-for the permitted uses. If the applicants pro-pose a neur well to
serve these'dwellings, u iomestic well permit may be available only if the applicant can specify a
35 acre or larger pirc"l on which this well will be the onlv well. A domestic well permit, yhigh
must be obtained-before the original parcel is split, will allow for use in up to three single family
dwellings (if specified on well p"irnit application), fire protection, the watering oJ domestic animals,
and the"irrigutior, of not ,nor" thrn orr" ,.t" of home lawns and gardens. The availability of a
domestic well permit will be the same as any tract over 35 acres.

In order to assure that a permanent water supply will be available on an equitable basis to
each lot, we recommend the following:
1. The well should be located on an outlot owned in common by all property owners
using the well. Access to the well and the right to establish and maintain a pipeline
shall be provided by easements where necessary.
2. The well should be jointly owned by the lot owners.
3. Covenants and/or other mechanisms should establish a lot owners association with
powers to make decisions concerning management and operation of the well. A
joint maintenance agreement is a required part of such an association.
As an alternative, after the property is split, the domestic permit may be surrendered and
a household use only well permit can be obtained for up to t]-ree parcels. The household use only
well permits can be used to serve one single family dwelling and for the watering of domestic
animals only. No outside use for irrigation of lawns or gardens will be permined. Plat notes
should reflect these limitations on well use. The new household use permits must be located on
the same 35 acres that the surrendered domestic permit was issued for.
If the above provisions are met, we can recommend approval of this proposal based either
on a shared well, or individual household wells. Please let us know if you have any further

WHEREAS, the Board of County Commissioners of Garfield County have heretoforeadopted
and enacted aZontngResolution lor Garflreld County, Colorado, including as a part thereof, certain
zoning maps regulating permitted uses upon the lands within Garheld County, Colorado; and
WHEREAS, C.R.S. (1973) 30-28-109 through 30-28-l l6 provide forthe approval ofall zoning

WHEREAS, the applicant has given notice of public hearing upon such application by
publication in a newspaper of general circulation in Garfield County, appearing in the Citizen
Telegram on March 5,lgg2, and such hearing having been held on April 6,1992, and this Board
having given full consideration tot he evidence submitted thereat; and
WHEREAS, this Board, based upon the record in connection with said application, makes the
following findings in respect thereto, to-wit:
That all applicable regulations regarding a Zorre District Amendment have been
complied with including, but not limited to, Section 10.00 of the Garfield County
Zorrrng Resolution of 1978, as amended.
That proper publication and public notice was provided as required by law for the
hearing before the Board of County Commissioners.
That the public hearing before the Board of County Commissioners wasextensive and
complete, that all pertinent facts, matters and issues were submitted and that all
interested parties were heard at the meeting.
That the proposed zoning is in general compliance with the surrounding land uses and
zoning in Garfield County.
