We enclose herewith Petition for Exemption for a
Minor Subdivision with the attachments as recited in the
Petition. Assuming that the Petition is given favorable
consideration by the Minor Subdivision Review Committee, I
note that one additional item that must be submitted on
final plat is a current title insurance policy commitment.
Would you please advise whether or not the insurance policy
issued at the time that the petitioners purchased the property
would suffice for this purpose or will they be required to
submit a new title insurance commitment showing the ownership
of the property as of a current date?

BEFORE THE BOARD OF COUNTY COMMISSIONERS OF GARFIELD COUNTY,
COLORADO, PETITION FOR EXEMPTION, MINOR SUBDIVISION
Pursuant to C.R.S. 1973, Section 30 -28 -101(10)(a) -
(d), as amended, and the Subdivision Regulations of Garfield
County, Colorado, adopted January 2, 1979, as amended, the
undersigned Robert E. Hardy and Maureen B. Hardy, by their
attorneys, Delaney & Balcomb, respectfully petition the Board
of County Commissioners of Garfield County, Colorado, to
exempt by resolution the division of a 42.07 acre tract of
land into two tracts of land, one containing 19.1 acres and
the second containing 23.0 acres. The tract to be subdivided
is more particularly described as follows:
Parcel 1, Hardy Hills, according to the plat
thereof recorded in the office of the Clerk
and Recorder of Garfield County, Colorado, as
Reception No. 300112.
This Petition is made pursuant to Resolution No.
80-73 adopted by the Board of County Commissioners of Garfield
County, Colorado, on May 12, 1980.
In support of this Petition the petitioners state,
allege and submit the following:
(a) Five copies of sketch plan, drawn to scale,
showing the proposed lot subdivision and access thereto are
submitted herewith. The access to the lots is from County
Road No. 112.
(b) Five copies of deed, which is recorded as
Reception No. 280526 in Book 500 at Page 480,is submitted
herewith.
(c) A vicinity map showing the location of the
property is as depicted on the attached sketch plan.
(d) The source of domestic water for the lots will
be obtained from an existing water well located in said Hardy
Hills. The distribution of the waters shall be in accordance
with Declaration of Covenants for Hardy Hills recorded as
Reception No. 295053 in Book 530 at Page 120, five copies of
which are submitted herewith.
(e) Sewage disposal will be by individual septic
tank systems.
(f) No live streams cross or adjoin the proposed
subdivided land.
(g) Evidence of soil types and characteristics of
each type are as set forth in report thereof, five copies of
which are attached hereto.
(h) There are no significant natural or man-made
features on the site, such as streams, lakes or natural drainage
lines; the topography is relatively flat; no buildings now
exist on the proposed subdivided land; electrical power is
derived from the Holy Cross Electric Association through a

power line constructed and in place and as depicted on the
sketch plan; and there is no existing development within
200 feet of the property in any direction.
(i) A fee in the sum of $143.00 is submitted
herewith.

DECLARATION OF COVENANTS
FOR HARDY HILLS

WHEREAS, Robert E. Hardy and Maureen B. Hardy
(Declarants) are the owners of the following described real
property located in the County of Garfield and State of
Colorado, to -wit:
A tract of land situate in the W1/2SW4 of Section 13, and
the EZ of Section 14, all in Township 7 South, Range 88
West of the 6th Principal Meridian being more particularly
described as follows: Beginning at the West 4 corner
of said Section 13; thence N. 89°29'59" E. 1381.55 feet
along the North line of said W1/2SW4; thence S. 01°27'52"
E. 2633.70 feet along the east line of said WZSW4;
thence N. 89°54'45" W. 675.36 feet along the south line
of said W1/2SW4, thence N. 02°28'50" W. 660.00 feet along
the east line of a tract of land described in Rec. No.

(PROPERTY)
WHEREAS, by Resolution of the Board of County
Commissioners of Garfield County, Colorado, dated July 17,
1978, as amended June 1.1 , 1979, Declarants were granted
the right to divide the Property into three parcels (Parcels),
with the possibility of further dividing Parcel 1 at a later
date, and
WHEREAS, Declarants have now made provision for a
water system, ingress and egress to all Parcels and electrical
power to the property line of the Property, and

WHEREAS, Declarants, being desirous of protecting
property values and protecting the health, convenience and
welfare of the owners of the Parcels, do hereby publish and
declare that the following terms and conditions, covenants,
restrictions, uses, limitations and obligations shall be
deemed to run with the Property and shall be a burden upon
and a benefit to any person or persons acquiring or owning
an interest in the Property, their grantees, successors,
heirs, devisees, personal representatives and assigns.
1. USE OF LOTS. All Parcels shall be used for no
purpose other than single family residences. To this end no
building shall be erected, altered, placed or permitted to
remain on any Parcel, other than one single family dwelling,
one barn for the housing of horses and one small storage
shed for the storage of tools and other residential equipment
No other structures shall be allowed.
2. MINIMUM SQUARE FOOTAGE. The floor area of
each single family dwelling, exclusive of open porches and
garages, shall not be less than fifteen hundred (1500)
square feet of finished living area. In addition, each
single family dwelling may have attached thereto a garage,
or carport, for not more than two vehicles.
3. FURTHER SUBDIVISION. Parcels 2 and 3 shall
not be further subdivided and Parcel 1 may be subdivided
into two or more parcels.
4. NEW CONSTRUCTION. All construction shall be
new and no previously erected buildings, structure, or
improvement shall be moved or set upon any Parcel from any
other location.
5. CONSTRUCTION MATERIALS. All residences shall
be constructed of either brick, brick veneer, stone or
lumber, or a combination thereof. Unfinished cinder block
or cement blocks shall not be used for exposed walls. All
barns and storage sheds shall have exterior walls in harmony
with the material used in the exterior walls of the residence.
6. LOCATION OF RESIDENCE. The location of each
residence to be erected on each parcel shall be first approved
by Declarants.

7. OUTSIDE STORAGE. Trash, garbage and other
waste materials shall be kept only in sanitary containers
stored within the residence, or screened from view by a
fence or shrubbery. No other outside storage shall be
allowed.
8. ANTENNAS. No towers or radio or television
antennas higher than three feet above the highest roof line
of a residence shall be allowed and must be attached to the
residence.
9. UTILITIES. All electrical, telephone and
television lines and cables shall be placed underground from
the point of delivery at the boundary line of each Parcel.
10. NATURAL FOLIAGE. All natural foliage shall
be retained to the highest extent possible and only such
foliage shall be removed or destroyed as shall be necessary
to erect the residence on each Parcel.
11. ANIMALS. No animals, livestock or poultry of
any kind shall be raised, bred, or kept on any Parcel;
provided, however, dogs and cats as household pets and not
more than two horses per Parcel may be kept, provided they
are not kept, bred or maintained for commercial purposes.
No horses will be permitted to be kept on any Parcel not
having sufficient pasture to maintain them adequately and
any horses or dogs or cats which constitute an annoyance to
the owners of other Parcels shall be required to remove the
same. All horses must be kept within an enclosed area,
except when riding the same, which must be kept clean,
sanitary and reasonably free of refuse, insects and waste at
all times.
12. NUISANCES. No noxious or offensive trade or
activity shall be conducted upon any Parcel, nor shall
anything be done thereon which may be or become an annoyance
or nuisance to the neighborhood. No Parcel shall be used or
maintained as a dumping ground for rubbish and no vehicle
shall be allowed on any Parcel which does not have a current
license plate recognized as valid by the State of Colorado
and a current safety inspection sticker issued by authority
of the State of Colorado.
13. ROADWAYS. Ingress and egress to the Property
is obtained from Garfield County Road No. 112 , thence

Easterly across a roadway 15 feet in width which has been
conveyed to the County of Garfield, thence Easterly across
a road and utility easement to the Westerly property line of
the Property. The roadway extending through the Property is
a 16 foot wide graveled driveway located on a 60 foot right
of way and easement. The roadway extending from the Westerly
property line of the Property has been provided with adequate
drainage, road base, finish 3/4" gravel and culverts. With
respect to the roadway on the Property, and to the extent
possible the roadway extending Westerly thereof to the
County Road, the respective owners of the Parcels shall
share in the costs of repair and maintenance thereof, as
follows:

In the event Parcel 1 is later divided, the percentage share
of Parcel 3 shall remain 20o and all other parcels shall
share the balance of 80o in equal shares. The road shall be
maintained as a minimum in the same fashion and condition as
the same exists in July of 1979. In addition, all expenses
of snow removal therefrom shall be borne by the owners of
the Parcels in the percentages as above stated.
14. WATER. Declarants will provide an initial
water system at the boundary line of Parcels 2 and 3 which
will derive its source of supply from a water well or wells
located on the Property. The water system may, however,
supply other Parcel owners within the Property. All Parcel
owners shall be responsible for the total cost of supplying
water from their property line to the point of use. Subsequent
to the installation of the water system, the total cost of
operation, repair, maintenance, replacement and all other
costs or expenses which may be required for the water system
shall be shared equally by the owners of each user on the
water system.
With respect to water for Hardy Hills, Declarants
hereby expressly and specifically do not warrant, guarantee
or assure that the water supply for the water system shall
remain adequate, either as to quantity or quality, and that
the obligation for maintaining a quantitative and qualitative
supply of water shall be shared by the owners of the Parcels
of land in Hardy Hills in equal shares.

In order to make the highest and best use of the
water available, the water from the water supply shall be
used for in-house use only, save and except, however,
outside irrigation shall be permitted for an area not in
excess of 2,000 square feet and such water as shall be
required to operate and maintain a swimming pool or hot tub
on each Parcel. Additionally, each user shall be limited to
the use of 15,000 gallons of water per month. To ensure
such limitation upon use, each Parcel owner shall meter all
water usage through a meter which shall be purchased from
Declarants. Declarants hereby retain and reserve the right
to monitor all meters and to discontinue water service to
any user who uses in excess of 15,000 gallons per month.
The obligation to participate in the water system
shall not be obligatory upon any owner of any Parcel in
Hardy Hills and the owner of any Parcel may develop his own
supply of water at any time and forthwith be relieved from
any further obligation for costs or expenses of maintaining
the water system. At such time as any Parcel owner ceases
to use water from the water supply system the percentage
requirement in the sharing of costs and expenses of all
remaining Parcel owners shall be commensurately increased.
15. DURATION OF COVENANTS. These covenants are
to run with the land and shall be binding upon all parties
and all persons claiming under them for a period of twenty-
five (25) years from the date these covenants are recorded,
after which time such covenants shall be automatically
extended for successive periods of ten (10) years unless an
instrument signed by a majority of the then owners of the
Parcels has been recorded agreeing to change said covenants
in whole or in part.
16. ENFORCEMENT. The Declarants and each owner
of a Parcel shall have the right to prosecute any action for
injunctive relief and for damages by reason of any violation
of these covenants.
17. SEVERABILITY. Should any part or parts of
these covenants be declared invalid or unenforceable by any
court of competent jurisdiction, such decision shall not
affect the validity of the remaining covenants.
