IJIIEREAS, Robert and Meredith Flinn have petitioned the Board of county corrnissioners
of Garfield County, Colorado, for an exemption from the definition of the terms
'rsubdivisi-on'r and "subdivided 1and" under C.R.S . 1973, 30-28-101 (10) (a)-(d), as
amended, and the Subdivision Regulations of Garfield County, Colorado' adoPted
Jaw,s,ary 2, Lg7g, Sections 2.o2.iL (d) and 3.02.01 for the division of 22'46 acre
tract described as follows: that parcel of land as described in Document No' 302105
as filed in the Office of the Clerk and Recorder of Garfield County, Colorado into
2 tracts of approxiurately 3.17 and lg.2g acres each, more or less, which proposed
divided tracts are more particuLarly deserlbed as follows:

I'IHEREAS, the Petitloners have demonstrated to the satlsfaction of thg Doardof County Conrnissi.oners of Garfleld County, Colorado, that the proposed dlvlsiondoes not fa1l r,rithin the purposes of Part 1, Articl-e 28, Title i0, ColoradoRevised Statutesrt L973, as amended, for the reason that the property split lsso1eLy for the purpose of adjustlng property boundaries, and ,ro ,., lots arecreated, and
I'HE-EAS, the Petitioners have demonstrated to the satisfaction of the Boardof County Comrissloenrs of Garfield County, Colorado, that there is a reasonableprobability of locating domestic water on each of said tracts, that there isadequate ingress and egress to said tracts, that the location of septic tanks willbe permitted by the colorado Departnent of Health, that the requested divisionis not part of an existing or larger development and does not fall withln thegeneral purposes and intent of the subdivislon regulations of the State of Coloradoand the County of Garfield, and should, therefore, be exempted from the definltlonof the terns f'subdivision" ancl "subdivided landrr as set foith in C.R.S. 1973, 3O-2g-101 (10) (a) - (d), as amended;
NOI4', TIIEREFORE, BE IT RESOLVED that the divlsion of the above described tracrs"Af' and t'Btt from the above described 22.46 acre tract 1s hereby exempted frousuch definitions and said tract may be dlvided into tracts rrArr and t'Btt, all as ismore fully described above, and said divided tract may be conveyed in the formof such smaller tracts l^rithout further coryliance with the aforesaid subdivislonstatutes and regulations; and further provided that thls property split is solelyfor the purposes of adjusting property boundaries and no new lots are created bythis action.
