WHEREAS, MABEL M. HARNESS, has petitioned the Board of County Commissioners
of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section
30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of Garfield
County, Colorado, adopted September 1, 1972 and amended April 14, 1975,
Sections 1.02.17 (d) and 3.02.01, for the division of a 20 acre tract into two
tracts of 12 and 8 acres, more or less, and said 20 acre tract is more
particularly described as follows:
A parcel of land situated in the SW1/4SE4 of Section 4, and
the NW1/4NE4 of Section 9, all in Township 6 South, Range
92 West of the Sixth Principal Meridian, lying Northerly
of the Northerly right-of-way line of U.S. Highway No. 6
and 24, said parcel of land is described as follows:
Beginning at the Quarter Corner common to said Sections 4
and 9; thence N. 000 39' 01" W. 179.28 feet along the
Westerly line of said SW1SE1; thence N. 89° 15' 51" E.
1318.56 feet; thence S. 000 38' 01" E. 179.28 feet; thence
S. 000 39' 41" E. 518.88 feet to a point on the Northerly
right-of-way line of said highway; thence N. 89° 57' 28"
W. 446.69 feet along the Northerly right-of-way line of
said highway; thence N. 86° 33' 28" W. 444.69 feet along
the Northerly right-of-w.ay line of said highway; thence
N. 09° 02' 53" W. 2.57 feet along the Northerly right-
of-way line of said highway; thence N. 87° 57' 47" W.
85.41 feet along the Notherly right-of-way lien of said
highway; thence N. 040 34' 43" E. 38.85 feet along the
Northerly right-of-way line of said highway; thence N.
850 23' 30" W. 347.56 feet along the Northerly right-of-
way line of said highway to a point on the Westerly line
of said NW1/4NE4; thence N. 000 40' 18" W. 402.69 feet
along the Westerly line of said NW1NEN to the Quarter
Corner of said Sections 4 and 9, the point of beginning,
containing 20.00 acres, more or less.
WHEREAS, the Petitioner has shown to the satisfaction of the Board of
County Commissioners of Garfield County, Colorado, that they desire said exemption
for the purpose of re -sale into a single-family residential use for the eight
acre parcel and a sawmill on the 12 acre parcel, and further that said sawmill
has been operated at that location for five years previous to this request;
and,
WHEREAS, the Petitioner has demonstrated to the satisfaction of the Board
of County Commissioners that there is a reasonable probability of locating
domestic water on each of said tracts, that there is adequate ingress and egress

to said tracts, that the location of spetic tanks will be permitted by the
Colorado Department of Health, that the requested division is in accordance
with the general purposes and intent of the Subdivision Regulations of the State
of Colorado and the County of Garfield, and should, therefore, be exempted from
the definition of the terms "subdivision" and "subdivided land" as set forth
in C.R.S. (1973) Section 30-28-101 (10) (a) - (d) as amended;
N01! THEREFORE, upon motion of vt seconded by
Pa U®, l:G M.S e- and carried, said 20 acre tract of land is hereby
exempted from such definition and transfer of said tract may be made by
division into 2 tracts of 12 and 8 acres, more or less, and further that said•
exemption is conditioned upon a proper legal description being developed for
said tracts prior to their conveyance. A copy of the instrument(s) of
conveyance when recorded shall be filed with this Resolution.
