A. A request for exetnption shall be submi tted to the Board on forms provided
Garfielcl Couttty Depalt.ment of Developmer UPlanning Division. Two
The Board olcounty Conrmissioners has the discretionary polver to exempt a division of land
from the defuril.io' of subdivision and thereby from the procedure in these Regulations'
provided the Boarcl determines r.hat suoh exenrption will 'ot i,rpair or dereat the stated purpose
o[ the Subtlivisio, Ilegulations nor be detrirriental to tire ge,eral public welf*re' 'I'he Board
shall make exemptiori decisions in accorrJance with the requirements o[ these regulations'
Following a review of the inclividual laots o[ each application in light of the requiretnents o[
tSese Regulal"ions, the Boartl may approve, oo,4iLionotty approve or deny an exetlrpLion' An
application for exemption must satisfy, at a nrinirnurl, ail of the review criteria listed below'

ISSUANCE OF THIS PERMIT DOES NOT CONFER A WATER RIGHT
CONDMONS OF APPROVAL
1) This well shall be used in such a way as to cause no material injury to existing water rights. The issuance of the
permit does not assure the applicant tnat no iniury will occur to another vested water right or preclude another
owner of a vested water right from seeking relief in a civil court action.
z) The construction of this well shalt be in compliance with the Water Well Construction and Pump lnstallation Rules
2 CCR 402-2, unless approval of a variance has been granted by the State Board of Examiners of Water Well
Construction and Pump lnstallation Contractors in accordance with Rule 17.
g) Approved pursuant to cRS 37-92-602(g)(bXlXA) as the onty well on a residential site ot 11.474 acres described' ai inat portion of the NW 1/4 of sec. rs,-twi..z south, Rng. 96 west of the 6th P.M., Garfield county, being more
particularly described on the attached exhibit'A'.
4) The use of ground water from this well is limited to ordinary household purposes inside a single family dwelling.
The ground water shall not be used for irrigation or other purposes.
5) The maximum pumping rate shall not exceed 15 GPM.
6) The return flow from the use of this well must be through an individual waste water disposal system of the
non-evaporative type where the water is returned to the same stream system in which the well is located.
7) This well shall be constructed not more than 2OO feet from the location specified on this permit.
