The site is located in District E - Rural Areas/ Severe-Moderate Environmental Constraints
as designated on the Garfield County Cornprehensive Plan Management Districts'Map.
II DESCR TPTION ON THE PROPOSAL
Site Description. The site is located 200' southwest of the Town of Parachute. The
propefiy crurently includes an existing mobile home on proposed Lot I. The rest of

A deed submitted with tlte application describes the parent parcel on January 27, lg50
(Book 248,Page 198, Reception No. l7loo2). Therefore, up to four (4) parcels can
be created through the exemption process.
Zoning. The exemlttiott parcel are consistent with the requirecl two (2) acres
minimurn lot size for tlre A/R/RD Zone Distlict.
I-ega! Access. The pro;lerty has access fi'om a public riglrt-of-way directly frorn the
I-70 fi'ontage ROW. Lot #l would utilize the same access. A driveway easement
through Lot #3 wotrld be required to be shown on the final exemption plat.

The applicant will serye each parcel with an ISDS. Soil conclitions on the site (#2
Arle-Ansari-Rock Outcrop and #4 Aryada Loam) have severe constraints for ISDS
dtte to depth to bedrock and slowpercolation rates. Staffwould suggest that the
following plat note be required:
"Soil conditions on the site rnay require engineered septic systems. Site
specific percolation tests at the time of building permit submittals shall
deternrine specific ISDS needs on the site."
State and Local Health Standards. No State or Local health standards are applicable
to the application, with the exception of Colorado Department of Health ISDS
setback standarcls, which should be verified by an engineer.
Drainage. The Diartrond Ditch traverses tlte property along the nofthem boundary
ofthe proposed exemption. Staffwould suggest that a condition of approval require
that the ditch be sltowtt as an easernent, and that sufficient width be shown for
maintenance purloses.
Fire Protection. No letter of approval has been subnritted fi'orn the appropriate fire
district, which should be a condition of allproval.
Easetnents. Any required easernents (drainage, access, utilities, etc..) will be required
to be shown on the exemption plat.
School Irnpact Fees The applicant willbe required to pay the $200.00 irnpact fee per
lot prior to tlre apllroval of the final plat.
Natural lfazards. Tlre project is located with in an area identified as having moderate
to severe cottstraitrts for ISDS, due to high groundwater and slow percolation rates.
staffwotrld suggest that the proposed plat note addresses these constraints.
IV. SUGGESTED FINDINGS
Tlrat proper posting and public notice was provided as required for the meeting before
the Board of County Commissioners.
That the rneetirtg before the Board of County Commissioners was exlensive and
cotnplete, that all pertinent facts, matters and issues were submitted and that all
interested parties were hearcl at that rneeting.
That for the above stated ancl other reasons, the proposed exemption is in the best
interest of the health, saflety, rnorals, convenience, order, prosperity and welfare of

RECOMMENDATION
Staffrecommends APPROVAL ofthe application, subject to the following conditions:
Tltat all representations of the applicant, either within the application or stated at the
rneeting before the Board of Coturty Commissioners, shall be considered conditions
of approval.
A Final Exemption Plat shall be submitted, indicating the legal description of the
property, dimension and area ofthe proposed lot, access to a public right-of-way, and
any proposed easements for setbacks, drainage, irrigation, access or utilities.
That the applicant sltall have 120 days to present a plat to the Commissioners for
signature fi'orn the date of approval of the exemption.
Tltat the applicant shall subrnit $200.00 in School Impact Fees for the creation ofth
exemptio, parcel. *t
That the following plat note shall appear on the Final Exemption Plat:
