llH'REAS, the Pet'iti'llers have demonstrated to the satjsfaction of the Bcard
of County Commissioners of Garfie'ld County, Colorado, that they desire said
exempt-ion for one 1.l.5 acre tract for re-sale into single-famjly residential
acreage, and one .l1.5 acre tract for sale to an adioining tract of land'
hJHEREAS, the Petitioners have denonstrated to the satisfactjon of the
Board that said ll.5 acre tract of lancl to be added to an adjoininq tract
of land will not create any third-party ownership; and consequently, said
proposed exempt.ion will not increase the dens'ity of building sites on sa'id 23
acre tract;
VJHEREAS, the petitioners have demonstrated to the satisfaction of the Board
of locatjng domestic water on sa'id .I1.5 acre tract to be re-solci for single-
family resident.ial acreage, that the rocation of septic tanks will be perm'itted
by the colorado Department of Health, that the requested division is in
accordance with the general purposes and intent of the Subdivision Regulations
of the state of colorado and the county of Garfield and should, therefore' be
exempted from the definition of the terms "subd'ivis'ion" and "subdivjded'land"
as set forth in C.R.S. (.I973) Section 30-28-10.| (.|0) (a) - (d) as amended;

The above application for exemption has been reviewed bg the pTanningDepartnent- Requested Lots of l-0 and 20 acres represent a deveTopmentpattern and densitg which is compatibl_e with this area of the countg.
This area is incr-uded within the studg area for our geoJogic hazardstudg currentLg undertaken within the House BiiJ i04J pragram. Theinformation we have received from the firm conductins thu studgindicates that a potential probLem of foundation shifting and Local_sTope faiLure ex:sts if the naturai drainage of this area were to besignificantTg disturbed.. one nethod of insuring that this does notoccur is Targe l-ot dever-opnent as is proposed bg the petitioner. Nofurther exemption of this l-and should be aLiowed.. rn ad.dition,ang exemptions in this area of the countg shouTd be consistent withthis and past exemption actions taken bg the countg, specificarTgkeeping the 70 and 20 acre size Lots.
The provision of utiiities, water and sewer for the resuTting Jotsdoes not present a probLem for this request.
