Del?RtY................ , Clerk of the Board when the following proceedings, among others were had and done, to -wit: RESOLUTION NO.- 81-33 A RESOLUTION CONCERNED WITH GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY SUBDIVISION REGULATIONS FOR: FRED AND GOLDIE JOHNSON WHEREAS, Fred and Goldie Johnson have petitionedtheBoard of County Commissioners of Garfield County, Colorado, for an exemption from the definition of the terms "subdivision" and "subdivided land" under C.R.S. _1973, 30-28-101 (10) (a), -(d), as amended, and the Sub- division Regulations of GarfieldCounty, Colorado, adopted January 2, 1979, Sections 2.02.21 (d) and 3.02.01 for the division of a 7 acre tract described as follows: In book 512, Page 929, filed in the Office of Clerk' and Recorder of Garfield County, Colorado;.into 2 tracts of approximately 2 and 5 acres each, more or less, which proposed divided tract is more particu- larly described as follows Tract A: A parcel of land situated in the NF4, SFS, SWI -4, Sec. 10, T.6S., R.93W. of the 6th Principal Meridian, and more particularly described as follows: Beginning at the 'Northeast corner of the NE4SE4SW% of Sec. 10, T.6S., R. 93W. of the 6thPrincipal' Meridian, and more particularly described as follows: Beginning at the northeast corner of the NE4SE4SW4 of Sec. 10 T.6S., R. 93 W. ofthe 6th Principal Meridian, a No. 5 rebar with metal cap being buried under the pavement of County Road No. 206 (now County Road No 294); thence S. 00°31'08" E. and along the east line of said N04SF!,-,SW4 of Section 10 a distance of 659.53 'feet;, thence S 89°44'22" W. and along the south line of said N5-4SFkSid4 of Section 10 a distance of 156.29 feet to the True Point of Beginning; thence S. 89044'22" W. and along the south line of said NE4SE4SW4 of Section 10 a distance of 330.00 feet to the east line of a 25 foot road easement, thence N. 00°34'20" W. and along the east line of said 25 foot road easement a distance of 264.00 feet; thence N 89°44' 22" E. a distance of 330.00 feet; thence S. 00°34'20" E. a distance of 264.00 feet to the True Point of Beginning, containing 2.0 acres more or less. (in the State of Colorado and County of Garfield); and WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County, Colorado, that the proposed division does not fall within the purposes of Part 1, Article 28, Title 30, Colorado Revised Statutes 1973, as amended, for the reason that the impact created does not warrant a full subdivision` review; and WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of County Commissioners of Garfield County; Colorado, that there - is a reasonable probability of 'locating domestic water on each of _said tracts, that thereisadequate ingress and egress to said tracts, that the location of septic tanks will be permitted by the Colorado Department of Health, that _the requested division is not part of an existing or 'larger development and does not tall within the general purposes and intent of the subdivision regulations of the State of Colorado and the County of Garfield, and should, therefore, be exempted from the definition of the terms "subdivision" and t BOOK 565 PAGE 6'9A "subdivided land" as set forth in C.R.S. 1973, 30-28-101 (10) (a)-(d), as amended; NOW, THEREFORE, BE IT RESOLVED that the division of the above described tract I "A" from the above described 7 Acre tract is hereby exempted from such definitions and said ,tract may be divided into tract "A" all as is more fully described above, and said divided tract may be conveyed in the form of such smaller tracts: without further compliance with the aforesaid subdivision statutes and regulations; provided, however,; that this exemption is granted on the condition and with the express under- standing and agreement of the Petitioners that no further exemptions be allowed on said tract "A" and that a copy of the instrument or instruments of conveyance when recorded shall be filed withthisResolution.
