(1973) Section 30-28-101 (10) (a) -(d) as amended, and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975, Section 1.02.17 (d) and 3.02.01, ROSS D. JEFFERY and DONALD A. CALDWELL, by their attorneys, Delaney & Balcomb, respectfully petition the Board of County Commissioners of Garfield County, Colorado, to exempt by resolution the division of a 2.296 acre tract of land into two tracts of approximately 1.33 acres and .96 acres, more or less, and which tract to be subdivided is more particularly described as follows: A tract of land situate in Section 6, Township 6 South, Range 89 West of the 6th Principal Meridian, being more particularly described as follows: Beginning at a point on the northerly right-of-way line of Interstate 70 whence the southwest corner of Section 34, Township 5 South, Range 89 West of the 6th Principal Meridian bears N. 27°41'40" W. 1,488.66 feet; thence along said right-of-way line the following courses: N. 74°57'30" E. 172.60 feet; thence 128.20 feet along the arc of a 1,482.40 foot radius non -tangent curve to the right whose arc subtends a chord bearing N. 77°26'30" E. a distance of 128.16 feet; thence S. 10°05'00" E. 10.00 feet; thence N. 80°34'30" E. 32.01 feet to the westerly boundary of a parcel of land described in Reception No. 203932 in Book 314 at Page 218 of the records of the Clerk and Recorder of Garfield County, Colorado; thence N. 01°06'00" W. 283.81 feet along said westerly boundary to a board fence; thence S. 88°11'41" W. 328.37 feet along said board fence to a wire fence; thence S. 01°26'38" E. 341.57 feet along said wire fence to the point of beginning containing 2.296 acres more or less; from the definitions of "subdivision" and "subdivision land" as the terms are used and defined in C.R.S. (1973) Section 30-28-101 (a) -(d) and the Garfield County Subdivision Regulations, for the reasons stated below: • • 1. The 1.33 acre tract is now being utilized by the Bureau of Land Management under a lease with petitioners. 2. The .96 acre tract is contiguous to Storm King Trailer Park. 3. Petitioners have contracted to sell the .96 acre tract to the owners of the Storm King Trailer Park, conditioned upon receiving County approval of the conveyance. In support of this petition, the petitioner also submits the following: (a) Map drawn to scale showing proposed lot subdivision and access; (b) Copy of deed; (c) Vicinity Map; (d) Statement on source of domestic water; (e) Statement on method of sewage disposal; (f) 100 year floodplain information where live stream crosses or adjoins said tract; (g) Fee in the amount of $53.00. Jeffery and Donald A. Caldwell dated August ('Lk 1979. Statement on Source of Domestic Water The subject property is located within the West Glenwood Springs Water District. The tract of land proposed to be sold by petitioners had been used as a mobile home site and there is now in place a 3/4 -inch tap from a water main of the West Glenwood Springs Water District. Statement on Method of Sewage Disposal The subject property is located within the West Glenwood Springs Sanitation District. The use of the tract in the past, as above pointed out, included sewage service from the said Sanitation District and the sewer line remains in place. One -Year Floodplain Information Attached is a Flood Boundary Map, Garfield County, Colorado, prepared by the U.S. Department of Housing and Urban Development.
