(L973) Secrion 30-28-t0f (10) (a) - (d) as amended, and the subdivision Regulations of Garfield County, Colorado, adopted January 2, L979, Secrion 2.02.0L (d) and 3.02.01, rhe under- signed attorney for Jim L. Jones and carol J. Jones respectfully peti- Ei-ons the Board of County Commissioners of Garfield County, Colorado, to exempt by resolution the divlsion of a tract containing approximately 47acres into two traets of approximately 37 acres and l0 acres respectlvely,from the definitions of "subdivision" and "subdivided 1and" as the termsare used and defined in C.R.S. (1973) Secrion 30-28-101 (10) (a) - (d) and the Garfield County Subdivision Regulations, for t.he reasons stated below: 1. The newly created parcel of approximately 10 acres will be conveyed to the Petitionerrs daughter and son-in-law, Brenda Joyce Sjogren and Donald L. Sjogren. 2. The newly created parcels will meet all requirement.s of theapplicable zone disrricr (A/R/RD). In support of this petltion, the Petitioners also submit the following: Map drawn to scale showing proposed 1ot subdivision and access. Copy of Petitionerfs Deed to subject parcel. Vicinity Map The source of domestic waEer for each tract shal1 be an individual well, with the 37 acre tract to be served by a well to be constructed under Permit No. L28542 lssued by the Colorado Division of Water Resources and the tract containing l0 acres, more or less, to be served by a we1l, the permit for which has been applied for. Sewage disposal for both parcels shall be a septic tank/ leach field (non-evaporative type). The subject property is not crossed or joined by a live stream. Soil Conservation Service analysis of soil types and characEeristics is attached hereto. A copy of the'Assessorts map showing the subject property and the adjoining area is attached hereto. The subject property is located approximately 6 miles northwest of Rifle on State Highway 13.
