PETITION FOR EXM{PTION
Pursuant to C.R.S. (L973) Secrion 30-28-t0f (10) (a) - (d) as
amended, and the subdivision Regulations of Garfield County, Colorado,
adopted January 2, L979, Secrion 2.02.0L (d) and 3.02.01, rhe under-
signed attorney for Jim L. Jones and carol J. Jones respectfully peti-
Ei-ons the Board of County Commissioners of Garfield County, Colorado, to
exempt by resolution the divlsion of a tract containing approximately 47acres into two traets of approximately 37 acres and l0 acres respectlvely,from the definitions of "subdivision" and "subdivided 1and" as the termsare used and defined in C.R.S. (1973) Secrion 30-28-101 (10) (a) - (d)
and the Garfield County Subdivision Regulations, for t.he reasons stated
below:
1. The newly created parcel of approximately 10 acres will be
conveyed to the Petitionerrs daughter and son-in-law, Brenda Joyce
Sjogren and Donald L. Sjogren.
2. The newly created parcels will meet all requirement.s of theapplicable zone disrricr (A/R/RD).
In support of this petltion, the Petitioners also submit the following:

Copy of Petitionerfs Deed to subject parcel.
Vicinity Map
The source of domestic waEer for each tract shal1 be an
individual well, with the 37 acre tract to be served by a
well to be constructed under Permit No. L28542 lssued by
the Colorado Division of Water Resources and the tract
containing l0 acres, more or less, to be served by a
we1l, the permit for which has been applied for.
Sewage disposal for both parcels shall be a septic tank/
leach field (non-evaporative type).
The subject property is not crossed or joined by a live
stream.
Soil Conservation Service analysis of soil types and
characEeristics is attached hereto.
A copy of the'Assessorts map showing the subject property
and the adjoining area is attached hereto.
The subject property is located approximately 6 miles
northwest of Rifle on State Highway 13.

Ladies and Gentlemen:
I enclose herewi-th for fillng a Petition for Subdivision Exemption
f or the division of the 47 acre parceJ- of land or,med by the Jones I
northwest of Rifle into two parcels containing approximately 37 acres
and 10 acres, respectively. I also enclose herewith an Application for
Special Use Permit to allow the placement of a mobile home on the pro-
posed 10 acre parcel, which applicaEion is, of course, dependant upon
the approval of the Petition for Subdivision Exemption. It is the
Jones t intent to convey the 10 acre parcel t.o their daught-e.r an{ sgn-in-
law r*ho wish to place a mobile home on the newly created parcel.

that you would proceed to schedule the Jones I Petition for Subdlvislon
Exemptlon and their Special Use PermLt Appllcation for appropriate
hearings. Please advise. me of the'dates of those hearings so that I can
arrange for the necessary publlcatlon and nalling of notices. Thls is
aLl based upon the assumption that the recent correspondence from the
State Engineer verifylng the issuance of a well permi.t for the subject
10 acre parcel will satisfy the requirements of a l'ater supply for the

the use of that wel-l to the onl-y well on the 35 acres. This amendment was made
at the request of Jim and Carol- Jones who now own the original 45-acre parcel.

we have issued as the only we1-1- to be consEructed on the lO-acre parcel whlch
you have been asked to consider as the Jones Exemption, which Mr. Hal- Simpson
of this office commented upon in a letter to you dated June 8, l-983.
