REI,ATTONSHTP 1'O 1'I]IJ COMI'REI{I]NSIVE PI,AN The subjeot properly is located in District 2b - Central Water and Individual Sewage Treatment and Distriot ltr - River/Floodplain Severe Environmental Constraints as designated by the Garfield County Comprehensive Plan's Management Districts Map. IT- Dh,SCRIT}'TION OF TIIIJ PROPOSAI- A Site f)escriplion: This 100 acre parcel is lo<;ated approximately one (l) mile northwest of New Castle on the southern side olCounty Road 245. Slope across the tract is generally very gradual, especially in the area where the exemption is recluested. Vegetation on Llte tract appears to be primarily annual grasses with the neighboring slopes dominated by pinion and juniper. Theconfluence of the mainstenr olElk Creek and East Elk Creek is directly south of the area proposed for the three (3) new lots. See vicinity nrap, page' (o- Adiacent I-and I lses: The parent tract has historically been used for agriculture, but recently, the tract and the surrounding area hars been transitioning to more intensive land uses, primarily single lamily homesites. Given the proximity to the town of New C--astle, l"his trend will probably continue. tvl B 0 l* oO C Prof,<rsal: The applir:ant intends to subdivide, by exemption, three (3) lots of approximzrtely three (3) aoreseach, with the remaining, lourth lot being 91 acres in size. 'Ihe nine (9) aores c;omprising the three (3) lots is currently an irrigated field, west of an existing, private aooess roacl. See sketch plan, pag€-ft2--- D History: The applioant petitioned for exemption in early 1995, to create a separate parcel east olCIl- 245, using the oounty road split. criteria. This request was granted by ttesolution 95-03t1, oreating an l8 aore traot, east o[CR 245 and a 100 acre tract west ol'CR 245. 'fhe 18 aore [rzrct was later the subject of the Cedars PUD proja;t, receiving Preliminary Plan approval by the County later in 1995. III. MAJOR ISSTTF,S AND CONCERNS A.Suhclivision Regrrlations: Seotion 8:52 ol the Garfield County Subdivision Regulations states Lhat "No mole than a tolal of fotr (4) lots, pards, interests or dwelling units will be created fron any paxn| as that parcnl was described in the rccords of the Garfield County Clerk and Recorder's Office on January I, 1973, and is not a part of a recorded subdivision; however, any parcel to be divided by exeatption that is split by a public right-of-way (State or Federal highway, County road orrailroad) ornattral feature, preventingjoint use of the proposetl tracts, and the division occurs along thepublic right-of-way ornaturul fealurq such parcels lhereby created may, in the discretion of the Board, not be consirlercd to have bren aealetl by exemption with regard to the four (4) lot, piu'cel, interest or dwelling unil lintitalion olherwise applicable;" Deeds subn-ritted with the application demonstrate the property existing as of 1965. See deeds, pages 8*q 'fhe previous exemption granted by the Iloard was based on the County Road preventing joint use, therefore, in the discretion of the Board, it appears this recluest meets the provisions ol Section 8:52 of the Subclivision Regulations and up to lour (4) lots may be created. B.Zoning: Thesubjoot property is within the A/R/ltD zone distriot, which requires a minimum of two (2) acres for each lot. All proposed lots are in excess of this minimum requirement. C.Waler Sunply: The water supply for this proposal is specified to be either water laps purchased liom the T'own ol New Castle or well waler. A letter has been included from the Town of New Castle indicating its approval of three (3) taps. See letter, pagg-l.O-- . Given the stated willingness of New Castle to provide oommunity water, stalf reoommends any approval be based on this water supply, simply because no well pern-rits or well permit applications have been submitted with this petition. A problem arises lrom the wording of the letter lrom the Town regarding the water supply, to wit: "All water 1ap lees must be paid to the Town prior to any delivery olwater or at the issuance of a building permit." If the taps are not paid lor prior to the I'rnal approval of this exernption request and are to be paid for at tirne of building permit issuanoe, the County would have ellectively oreated lots wil.hout a physical supply at time of creation. Staffrecommends the water taps be paid lor and that the town water line be extended to all property lines, prior to the authorization of an exemption plat. tr Z o 7) o o If the applicants choose to use well, the Board has required applications to include copies of approved well permits and to drill a well to meeting the following criteria lor demonstrating the quality, quantity and dependability of a well or a shared well system, prior to any dscision being made:: l)A well be drilled zrnd a 24hour pump test shall be perlormed; The applicant supply, to the Planning Departrnent, the well completion report demonstrating the depth of the well, the characteristics of the aquifer and the static water level; T'he results of the 24 hour pump test indicating the pumping rate in gallons per tninute and inlormittion showing drawdown and recharge shall be subniitted to the Planning Department; A written opinion of the person concluoting the well test that this well woulcl be adequate to supply water to Lhe number of proposed lots and be subrnitted to the Planning Department; An assumption of an average olno less than 3.5 people per dwelling unit, using 100 gallons of water per person, per day, If the well is to be shztred, the provision lbr individual water storage tanks olno less than I 000 gallons for each proposed lot (required at time ol building permit applicati<ln), A disoussion of the mechanical components of the shared well system to inolude the pump, water supply line, storage tank and other components (for shared well systems); A legal, well shar-ing agreement which discusses all easements and costs assooiated with the operation and maintenance o[the system and who will be responsible lbr paying these costs and how assessments will be nlade (lor shared well systents); 'fhe water quality be tested by an approved testing laboratory and meet State guidelines ooncerning bacteria and nitrates. 2) 3) 4) 5) 6) 8) e) Sewer: The stated method ol'waste water disposal is the use of individual sewage clisposal systems. Aooordilg to the Soil Conservation Service, soils on-site are primarily Ileldt clay loams, charaoteristioally deep and well-drained. Constraints to buikling site developrnent and use of ISDS are considered moderate to severe due to a high clay content, whioh causes slow percolation. Staff reconrmends a plat note be inoluded to address these limitations. Ptissible l'rlooclplain: 'l'he linrited sketoh nrap submitted with this application does not show it; however, alter cheoking the designated I'loodplain of'East Elk and Elk Creeks, it appears tl-rat at least one (1) ol the three (3) aore lots and portions of the larger lot may exist within the designated floodplain. See floodplain map, page lPlL Stalf rer:ommends a plat note to address this issue. Access: The lol"s that woulcl be oreated by this request lie south of CR 245 and would be aocessed by an existing, private road. Stalf does not know if easements for this road are in existence, but would be necessary to guarantee access to these lots. 'fhis easement must be reoorded with the Clerk and Itocorder prior to hnal approval. E D F Fire Proteotion: The Burning Mountains Fire Proteotion District has responded to this request, indicating this property is withirytheir service area and access to the lots to be created exists. See letter, pug€J$ -. Staff recommends a plat note be inoluded to address wildhre mitigation. G .*3 o Easements: Any recluired easements for drainage, utilities, access, irrigatton ditches, etc., will be recluired to be shown on the exemption plat. School Inrfract Fees: The applicant will be required to pay school impact lees of $200, lor each lot oreated by this exemption. Potenlial Roail Imlaot Fees: If or when the County adopts a road impact fee, the lots created by this exempl.iotr will be subject to paying that fee; paid at time of builcling permit application, paid by the building permit applicant. This provision shall be inoluded as a plat n<lte. IV" SI TGGE,S'I'E,D FINDINGS 1 'Ihat proper posting ancl public notice was provided as required for the meeting before the Board of County Commissioners. That the meeting before the Board of County Commissioners was extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at thal. meeting. That for the above stated and other reasons, the proposed exemption is in the best interest ol the health, safety, ntorals, convenienoe, order, prosperity and wellare ol'the citizens of Garl-reld County. V. RF,COMMF.NDA'I'ION Stalf recommends APPROVAL of the application, pursuant to Lhe lollowing conditions: That all representations ol the applicant, either within the application or stated at the meeting befbre the Board of County Commissioners, shall be considered conditions of approval. A Final Exemption Plat shall be submitted, indicating the legal description of the proper[y, dimension and area of the proposed lots, access to a public right-of- way, and any proposed easements lor setbacks, drainage, irrigation, access or utilities. That the applicant shall have 120 days to present a plat to the Commissioners lor signature, lrom the date olapproval of the exemption. The Board may grant extensions o{- up to one (l) year lrom the <lriginal date of approval. That the applicant shall submit $i200.00, per lot, in School Impact Fees lor the oreation of all exemption parcels. 5. That the lollowing plat notes be inoluded "The minimum delensible spaoe distance shall be 30 leet on level terrain, plus appropriate modihcation to recognize the increased rate of fire spread at sloped sites.
