BEFORE THE BOARD OF COUNTY COMMISSIONERS OF
GARFIELD COUNTY, COLORADO
RESOLUTION NO. '1-/3
WHEREAS, Lewis E. Hoy has petitioned the Board of County
Commissioners of Garfield County, Colorado, for an exemption
from the definition of the terms "subdivision" and "sub-
divided land" under C.R.S. 1973, 30-28-101 (10) (a) -(b) as
amended, and the Subdivision Regulations of Garfield County,
Colorado, adopted January 2, 1979, Sections 2.02.21 (d) and
3.02.01 for the division of a 52.0 acre tract into two (2)
tracts of approximately 5.0 acres and 47.0 acres more or less,
and said 5.0 acre tract is more particularly described as
follows:
A parcel of land situated in the S'SW' Section 19,
Township 6 South, Range 91 West of the Sixth
Principal Meridian, Garfield County, Colorado, more
particularly described as follows:
Commencing at an iron post and brass cap properly
marked and. found in place for the S.W. Corner of
said Section 19, thence N. 89°19'11" E. along the
South line of said Section 19, 1246.81 feet to the
True Point of Beginning; thence North 440.00 feet;
thence N. 89°19'11" E. 500.00 feet; thence S. 03°
26'08" E. 119.62 feet; thence S. 05°42'47" W. 322.49
feet to said South line of Section 19; thence S.
89°19'11" W. 475.06 feet to the True Point of
Beginning; containing 4.9946 acres more or less.
WHEREAS, the Petitioner has demonstrated to the satisfaction
of the Board of County Commissioners of Garfield County, Colorado,
that he desires said exemption for the purpose of resale of said
tract into single-family residential acreage.
WHEREAS, the Petitioner has demonstrated to the satisfaction
of the Board of County Commissioners of. Garfield County, Colorado,
that there is a reasonable probability of locating domestic water
on each of said tracts, that there is adequate ingress and egress
to said tracts, that the location of septic tanks will be permitted
by the Colorado Department of Health, that the requested division
is in accordance with the general purposes and intent of the
Subdivision Regulations of the State of Colorado and the County of

NOW, THEREFORE, '. upon the motion . of

acre tract of land is hereby exempted from suchdefinitions and
said tract may be divided into two (2) tracts of 5.0 acres and:
47.0 acres,. more or less, all as is morefully described above,
and said divided.tract may be conveyed in the form of such
smaller. tracts without further compliance with the aforesaid
subdivision statutes andregulations; provided,`however, that.
said exemptionisconditioned on the Petitioner obtaining a proper
legaldescription of said tracts prior to any conveyance thereof.

shall be filed with this .Resolution.
