PROJECT NAME: Senate Bill 35 Exemption
APPLICANT: Lewis and Emma Hoy
LOCATION: 5 miles south of Silt on County Road
311. (Divide Creek Road) See map, page 14
PURPOSE: To split a 47 acre tract into 2 parcels
of 232 acres each.
QUALIFICATION: To convey one parcel to a daughter
ZONING: A/R/RD
WATER: Applicant has proposed to serve new parcel
with a new household use only well permit.
The remaining acreage would be served by an
existing well (see Division of Water Resources
letter of 7-22-82)
SEWER:
New individual septic for the new parcel.
The remaining acreage would be served by
the eXisting septic system.
ACCESS: From County Road 311
COMPREHENSIVE PLAN: Districts C and D (Rural Areas with Minor
and Moderate Environmental Constraints)
STAFF COMMENTS:
Staff has several concerns regarding this proposal:
1. This 47 acreparcel was one of many created in this general area without
the benefit of any county review. In the past, the Board of County Commissioners
has expressed their concern over further splits of these parcels which did not
receive County review, specifically, those: in this general area and specifically,
any further splits attempted through the exemption process.
2. The Board should consider the impact to the Silt Bridge and the per lot
assessments ($1000.00 for each new parcel) required by subdividers in the past.
3. As noted in their July 22, 1982 letter, the Division of Water Resources cannot
recommend approval of the split; specifically, since the existing well (if it is
in fact, approved as permit #105982) would preclude the Division's approval of an
additional well on this tract of land. (See staff letter of July 15, 1982, and the
Division's response of July 22, 1982, pages 15 & 11...)
RECOMMENDATION:
Denial, due to inability to serve the parcel with water.
If the applicant can provide additional information to the Division of Water
Resources which would result in their securing a well permit for the additional
parcel, then staff recommends that the applicant proceed with the full subdivision
review process, with no exemptions from such.
