following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 85-108
A RESOLUTION CONCERNED WITH T1-15 MODIFICATION OF RESOLUTION NO. 83-113`
GRANTING AN EXEMPTION FROM THE GARFIELD COUNTY SUBDIVISION REGULATIO: S FOR
LEWIS AND EMMMA. FIO',
WHEREAS, Lewis and Emma Hoy have petitioned the Board of County
Commissioners of Garfield County, Colorado, , for an exemption from the
definition of, the tei'ins "subdivision" and "subdivided lan& under C.R.S.
1973, 30-28-1U1 (10) (a) -(d), as -amended, and the Subdivision Regulations
of Garfield County, Colorado, adopted January 2, 1979, Sections 2.02,21
(d) and 3.02,0i for the division of e 47 acre tract of land as described
in Book 578, Page 737 as filed in the Office of the Clerk and Recorder of
Garfield County, Colorado into 2 tracts of appro/imately 23 1.,/2 acres
each, more or less; and approved by Resolution No, 33-1.13; and
WHEREAS, the Petitioners, after further .onsideration have determined
that the division of said 47 acre tract into two tracts of 25.28 acres and
21,73 acres each more or less, would be a more logical division of the 47
acre tract; and
WHEREAS, the proposed moaificati,on- of the legal descriptions. contained
in Resolution No. 8-3-113 to the following legal descriptions, will. meet
all other conditions of approval for said exemptions; .

NOW THEREFORE, BL IT RESOLVED that the division Of the above described
"A" and "B." from the above 47 acre tract iSher_e
by exempted from such
definitions and said tract may be divided into tracts "A" and "5", all as
1s more fully described above, and said divided tract may -.)e conveyed in
the form of such smaller tracts without further compliance with the
aforesaid subdivision statutes and regulations; provided, however, that
this exemption is granted an the condition and with the express
understanding and agreement of the Petitioners that no further exemptions
be allowed on said tracts "A" and "5", and that a copy of the instrument
or instruments of conveyance when recorded shall be filed with this
Resolution,
