HomeMy WebLinkAbout2.0 Draft Resolution• • RESOLUTION WHEREAS, OWEN HOLGATE has petitioned the Board of County Commissioners of Garfield County, Colorado, for an exemption under C.R.S. (1973) Section 30- 28-101 (10) (a) - (d) as amended; and the Subdivision Regulations of Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975; Sections 1.02.17 (d) and 3.02.01, for the division of a 5.22 acre tract into two tracts of approximately 2.6 acres each, more or less, and more particularly described as follows: SEE EXHIBIT "A" WHEREAS, the Petitioner has shown to the satisfaction of the Board of County Commissioners of Garfield County, Colorado that he desires said exemption for the purpose of re -sale into single-family residential acreage, and that said extension of use on this parcel is not agreeable to the Board, and WHEREAS, said property requesting such exemption is the product of previous exemption granted by the Board of County Commissioners of Garfield County, Colorado, and that a second such exemption is deemed contrary to County policy on said parcel, and; WHEREAS, the safety of emergency access and fire protection could be further hampered on the site if more than one principal use exists on the lot; NOW THEREFORE, upon motion of seconded by and carried, request for said exemption is denied, and further that no permits be issued for the construction of more than one principal dwelling and accessory buildings as outlined in the Zoning Resolution of Garfield County, Colorado.
