WHEREAS, DAVID J. AND NORMA R. HUGHES, have petitioned the Board of County
Commissioners of Garfield County, Colorado, for an exemption under C.R.S. (1973)
Section 30-28-101 (10) (a) - (d) as amended, and the Subdivision Regulations of
Garfield County, Colorado, adopted September 1, 1972 and amended April 14, 1975,
Sections 1.02.17 (d) and 3.02.01, for the division of approximately 4.56 acres
into two tracts of 2 and 2.5 acres, more or less, and more particularly
described as follows:
Parcel No. 1. A tract of land situate in Lot 3, Section 24,
Township 7 South, Range 88 West of the 6th P.M. described
as follows, to -wit:
Beginning at a point which bears S. 000 34' 13" W. 1381.76
feet from the North Quarter corner of said Section 24;
thence S. 000 34' 13" W. 528.33 feet; thence West 159.21
feet to the East line of the County Road; thence 159.83
feet along the arc of a curve to the right having a
radius of 1867.56 feet, the chord of which bears N.
150 32' 54" E, 159.79 feet, along the East line of the
County Road; thence N. 18° E. 393.63 feet along the East
line of the County road to the point of beginning,
containing one acre, more or less.
Parcel No. 2. A tract of land situate in Lots 3 and 4,
Section 24, Township 7 South, Range 88 West of the 6th
P.M. described as follows, to -wit: Beginning at a point
which bears S. 000 34' 13" W. 1910.09 feet from the
North Quarter corner of said Section 24; thence S. OOo
34' 13" W. 611.93 feet; thence 195.62 feet along the
arc of a curve to the left having a radius of 212.21
feet, the chord of which bears N. 83° 03' 47" W. 188.76
feet; thence S. 70° 31' 44" W. 64.14 feet; thence 151.53
feet along the arc of a curve to the right having a
radius of 954.93 feet, the chord of which bears S. 75°
04' 29" W. 151.36 feet; thence S. 790 37' 14" W. 98.38
feet to the east line of the County road; thence N.
45° 28' 45" E. 142.88 feet along the east line of the
County Road; thence 404.81 feet along the arc of a curve
to the left having a radius of 692.10 feet, the chord
of which bears N. 28° 43' 28" E. 399.06 feet, along the
east line of the County road; thence N. 11° 58' E.
183.85 feet; thence 36.83 feet along the arc of a curve
to the right having a radius of 1867.56 feet, the
chord of which bears N. 120 30' 55" E. 36.83 feet, along
the east line of the County road; and thence East 159.21
feet to the point of beginning,
containing 3.56 acres, more or less.
WHEREAS, the Petitioners have shown to the satisfaction of the Board of
County Commissioners of Garfield County, Colorado, that they desire said
exemption for the purpose of re -sale into single-family residential acreage, and;
WHEREAS, said parcel now has three (3) mobile homes located on it, each
with individual sewage disposal systems, and said request for exemption would
reduce the size of the parcel upon which said mobile homes are located from
4.56 acres to 2.56 acres,
WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board
that there is a reasonable probability of locating domestic water on each of
said tracts, that there is adequate ingress and egress to said tracts, that the
location of septic tanks will be permitted by the Colorado Department of Health,
that the requested division is in accordance with the general purposes and
intent of the Subdivision Regulations of the State of Colorado and the County
of Garfield and should, therefore, be exempted from the definition of the terms
"subdivision" and "subdivided land" as set forth in C.R.S. (1973) Section 30-
28-101 (10) (a) - (d) as amended;
NOW THEREFORE, upon motion of rlo ee r%se seconded by

hereby exempted from such definition and transfer of said tract may be made by
division into two (2) tracts of land of 2 and 2.5 acres each, more or less,
further that a proper legal description be perpared for said parcels prior to
conveyance of said parcels and further that such approval is conditioned upon
the Petitioner obtaining a lot size variance from the Garfield County Zoning
Board of Adjustment from the Garfield County Zoning Resolution for individual
sewage disposal for the 2.5 acre parcel. A copy of the instrument or instruments
of conveyance when recorded shall be filed with this Resolution.
