At a regular meeting of the Board of County Commissioners for Garfield County,
Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood
Springs on Monday , the 1st of August A.D. 19 94 , there were present:
Elmer (Buckey) Arbanev , Commissioner Chairman

when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 94-094
A RESOLUTION CONCERNED WITH THE APPROVAL OF A PRELIMINARY PLAN FOR
DAKOTA SUBDIVISION.
WHEREAS, BOB ARNOLD/DON BYERS have filed an application with the Board of
County Commissioners of Garfield County for approval of a Preliminary Plan for Dakota
S ubdivision;
WHEREAS, the Garfield County Planning Commission reviewed the Dakota Subdivision
application and recommended approval to the Board of County Commissioners;
WHEREAS, based on the material submitted by the applicants, the recommendation of the
Planning Commission and the comments of the Garfield County Planning Department, this Board
finds as follows:
1. That proper publication, public notice and posting was provided as required by law for
the hearings before the Planning Commission and Board of County Commissioners.
2. That the hearings before the Planning Commission and Board of County
Commissioners were extensive and complete, that all pertinent facts, matters and issues
were submitted and that all interested parties were heard at that hearings.
3. That the Garfield County Planning Commission recommended approval of the
Preliminary Plan.
4. That the proposed subdivision of land is in compliance with the recommendations set
forth in the Comprehensive Plan for the unincorporated area of the County.

That all data, surveys, analyses, studies, plans and designs as>required by the State of
Colorado and Garfield County have been submitted, reviewed, and found to meet all
sound planning and engineering requirements of f the Garfield County Subdivision
Regulations:'
That the proposed subdivision of land conforms to ;the Garfield County Zonin
Resolution.
'That fot the above -stated and"other reasons, the; proposed PUD is in thebest- interest
-of the health, safety, morals, convenience, order,; prosperity and welfare of the citizens
of Garfield County
N. THEREFORE, BE IT RESOLVEDthat the Preliminary Plan of Dakota Subdivision`.
for the following described unincorporated area of Garfield County be approved with the following
conditions
All representations of the applicant, either withm_the application or stated at the `-
hearing with the Planning Commission, be considered conditions of approval
The applicants shall establish a Homeowners Association and shall be incorporated in
accordance with the requirements of Colorado Revised Statutes. The Homeowner's
Association shall be responsible for all requirements and agreements associated with the
Mid -Valley District, road maintenance and snow removal. The articles of incorporation
and restrictive covenants shall be reviewed by County Staff prior to the approval of a
Final Plat.
The applicants shall prepare and submit a Subdivision Improvements Agreement,
addressing all improvements, prior to recording a final plat.
The applicants shall submit improvement plans for all road, drainage and utility
improvements prior to the approval of a final plat.
5. All utilities shall be placed underground.
6. All cut slopes created during constructionshall be revegetated with native grasses using
certified weed -free seed.
7. The applicants shall pay $200 per lot in school impact fees prior to approval of the final
plat.
8. All roadways shall be designed and constructed in conformance with design standards
set forth in the Subdivision Regulations and in place at the time of final plat.
9. All construction shall be consistent with the recommendations of the applicant's
geologist, described in "Summary Report of Geotechnical Conditions and Preliminary
Recommendations", dated April 18, 1994 by Chen Northern, Inc.
10. If the applicant intends on resubdividing the multi -family lots, provisions (i.e., plat note)
shall be made at the time of Preliminary Plan approval, and subsequent variances and
amended plats shall be submitted and approved consistent with the Garfield County
zoning and subdivision regulations in affect at that time.
11. All requirements associated with agreements with the Mid -Valley Metro District,
described in a May 17, 1994 letter from Lee Leavenworth, are considered conditions of

approval.
12. Dog restrictions, limiting dogs to one (1) per dwelling unit, shall - b_ a included :in the_
covenants submitted at -the time of Final Plat.
13. Fireplace restrictions shall be included within the covenants submitted at the time of
Final Plat. These restrictions shall prohibit -open-hearth fireplaces,.require conformance
to EPA Phase II standards, and shall allow an nniinuted number of gas fireplaces.
14. Engineered foundations shall be required for all dwelling units prior to the issuance of=
a building perrxit.
15. A letter of approval from the Carbondale Fire District Department prior to Final Plat.
