Dear Sir,
In cleaning out my old files for the Dakota Homeowners Association (of which I am no longer
president), I found your letter concerning the "potential geologic hazard" in the Dakota
Subdivision.
First I apologize for not respond to this before, but the letter was "lost in the files".
Secondly, it was discovered that this situation was not the result of any geologic phenomenon, but
rather was the result of a broken main pipe for the irrigation systems of the subdivision. It was
repaired within 10-15 days of the discovery of the problem and has been fine ever since.

RE: Observation of potential geologic hazard near Dakota Subdivision, Garfield and Eagle
Counties
Dear Gentlemen,
The purpose of this letter is to publicize observations made by the Mid Valley Metropolitan District ("District")
in regards to a potential geologic hazard that was observed during the first week of June, 2004. The District's
Operator, Scott Leslie, observed water flowing through a Dakota Subdivision Homeowner's retaining wall (see
attached photo). On further inspection, Mr. Leslie walked north of the Subdivision into a draw where he
observed a spring with an estimated flow rate of approximately 60 gallons per minute (see area map). The
spring flows into an underground "cavern" where the entire flow goes subsurface. It is not known where the
flow goes at this point of entering the "cavern". However, directly prior to the "cavern," there are a number of
abandoned irrigation pipes (see photo). Mr. Leslie recalls that at one time in the past, the flow from this spring
was utilized for irrigation, and an irrigation tank captured this flow, disallowing it to run into the cavern. From
inspection of the area, it is clear that the irrigation tank has been removed.
The District owns and operates water transmission and sewer collection lines located in the streets in the
Dakota Subdivision. The District has concerns that the unknown location of this water source, and its down
gradient course could put the District's infrastructure at risk. Furthermore, the adjacent homeowners may also
share this same concern. Please note that the District is not drawing any conclusions with the information
portrayed in this letter, as the District is only stating its observations of this matter.

This letter constitutes the recommendation for acceptance for the Dakota/Blue Lake Lift Station.
The station has been constructed and testing has been performed. Based on our periodic
observations during construction and testing, the installation and construction of the lift station
conforms with the intent of the plans and specifications approved by the Colorado Department of
Health in their letter dated November 16, 1994, for Site Application #4172.

Dear Ms. Hope:
I am responding to your request, on .behalf of the Dakota
Meadows Homeowners Association, for a Department of the Army
permit;. to install an underdrain crossing within a wetland at the
Dakota Meadows Subdivision. The project is located near the
Eagle -and Garfield county line adjacent to,BlueCreek within
-:B:ection-33, Township 7 South, Range 87 West, Eagle County,
Colorado.
The Chief of Engineers has issued nationwide general permit
number 12 which authorizes the discharge of dredged or fill
material in waters of the United States for utility line
crossings. We have determined that your project will not affect
threatened or endangered species protected by the Endangered
Species Act. Your project can be constructed under this
authority provided the work meets the conditions listed on the
enclosed information sheets and the following special condition:
Cutoff collars shall be installed every 50 feet within the
wetland area.
You must also send a signed letter of certification to the Corps
of Engineers within 30 days after completion of the work (see
general condition number 14). A copy of the certification
statement is included for your use.
This verification is valid for two years from the date of
this letter. If the applicant has not completed the project by
that time, they should contact the Corps of Engineers to obtain
information on any changes which may have occurred to the
nationwide permits. The applicant is responsible for remaining
informed of such changes and for ensuring that all contract
personnel are familiar with the permit terms and conditions.

RE: Dakota Lift Station
Dear Board Members:
The purpose of this letter is to comment on the Dakota Lift Station. As you will recall at your
fast Board meeting the lift station was installed but there were several minor punchlist items
That were yet to be resolved. The Board directed me to contact Dakota representatives and
let them know that the station would not be accepted until the punchlist items are resolved.
To date, the punchlist items have been resolved in a satisfactory manor. The alarm dialer is
operable and has been programmed. 1 would recommend that the District accept the
dedication of the lift station and begin the two year warranty period as of your meeting on the
21st.
1 have discussed the punchlist items with Scott and he concurs that they have been
accomplished. If you have any questions or comments please don't hesitate to call.
