when the following proceedings, among others were had and done, to-wit:
RESOLUTION NO. 82-202
A RESOLUTION CONCBRNED WITII APPROVAL OF THE PRELIMINARY PI/.N OF THE COLOROSO SUBDIVISION
WHEREAS, Robert D. Coloroso and Dawn M. Holmes have filed an application with the
Board of County Corunissioners of Garfield County for approval of a Preliminary Plan in the
Residentiaulimited/suburban Density Zone District; and
WIIEREAS, based on the material submitted by the applicant and the comlents
of the Garfield County Planning Department, this Board finds as follows:
i. That proper publication and public notlce was provided as required by 1aw
for the hearing before Ehe Planning Conrnission.
2. That the hearing before the Planning Conmission was extensi-ve and complete,
that all pertinent facts, matEers, and issues were submitted and that all interested
parties were heard at that hearing.
3. That the Garfield County Plannlng Conrnission recortrnended approval of the
Preliminary Plan.
4. That the proposed subdivision of land is in compliance with the recommendations
set forth in fhe Comprehensive PIan for the unincorporated area of Ehe county.
5. That atl data, surveys, analyses, studies, plans, and designs as are required
by the State of Colorado and Garfield County have been submitted, reviewed, and found
to meet all sound planning and engineering requirements of the Garfield County Stibdivision
Regulations.
6. That the proposed subdivision of land conforms to the Garfleld County ZonLrtg
Res olu t ion.
7. That for Ehe ,above-stated and other reasons, the proposed subdivision is in
the best interest of the health, safety, moralsrrcooverliencer order, prosperlty' and
welfare of the citizens of Garfield County.
NOW, THEREFORE, BE IT RESOLVED that the Preliminary Plan of Coloroso Subdivision
for the following described unincorporated area of Garf,ield County be approved wlth
the following conditions:
l. That the developer commit to improvements (as d€termined acceptable by the
Board,,of County Conrnissioners) on Village Drive ln their Subdivlsion Improvements
Agreement prior to final plat submittal.
2. That the developer coq[nit to improvements (as determined acceptable by the
Board of County Coumissioners) on County Rodrd 320 (to two intersecEi-ons addressed
in the traffic circulation plan submiEtal by the developer) in their Subdivision
Improvements Agreement prior to final plat submittal.
3. That the propoled park (Lot A) be redesigned as a pocket park and labeled
as t'Tract Att.
4. That a Home Oruners AssociaEion be formed to be responsible for the park area
and maintenance thereof.
5. Interior roads be developed to the City of Rifle's road standards (50'R.O.W.
wigh 32r paved curb, and gutter streets \^7ith sidewalk) and that the developer commit
to this in the Subdivision Improvements Agreement as submittal of final plat.
6. Developer submit a letter from the Colorado Geological Survey indicating that
the Geological Surveyts concerns have been reasonably met.
7. Developer pay a fee of $200.00 per residential lot to the RE-2 School District
at final plat approval.
B. Ihe developer pursue water by the City of Rifle or the Rifle Metro$olitan
District and the Division of Water Resources approve that source prior to submiEtal of
final plat.

A tract of land situated in the Northeast one-quarter of the Northwest
One-quarter (llUN g4l-o; of Section 20, Township 6 South, (T65), Range
93 hlest (R93W), of the Sixth Principal Meridian (6th P.M.) being located
within the Boundary Line of the Rifle Village South Subdlvision Flrst
Fillng, as filed ln the Office of the Clerk and Recorder of Garfield County,
Colorado, as Document No. 227220, descrlbed as follows:
Beginnlng at the Southeast Corner of sald NEI NI,r/-a, belng an lron pipe with
a Brass Cap, properly marked and in placel thence S.30'50t30"W.2.40
feet to t.he northeasterly line of a 60 foot street; thence along the
arc of a curve to the left 166.46 feet having radlus of 2L2.11 feet, the
chord of which bears N.67'59'36"W. 162.24 feet; thence S.89'31'19"W.
413.91 along the northerly line of said 60 foot street; thence N.00o
32'20'1w.650.00 feet to Ehe Southerly llne of Lot 21, Block B of said
Subdivision; thence N.89"31'19"E. 565.00 feet along the Southerly Line
of Lots 21 thru 31, inclusive of sald Block B to a point on the Easterly
Line of said Subdivision; thence S.00'32'20"8. 710.00 feet along the
Easterly Llne of said Subdj-vi-sion to the Point of Beginning.
