A RESOLUTION CONCERNED WITH GRANITING A}I DGMPTION FROM THE GARFTELDCOUNTY SUBDIVISION REGULATIONS FOR TIIE BORUCH SUBDTWSION DGMPTION.
WHEREAS, Robert Boruch petitioned the Board of County Conrmissioners of GarfieldCounty, Colorado, for an exemption fromthe definition ofthe terms ,,suMivision,, and ,,zuMivided
land" under c'R's' 1973,30-28-l0l (10) (a)-(d), * u*.nd"d, and the SuMivision Regulations ofc1{eld county, colorado, adopted April iz, igtq,section 8:00 through g:60 and for the division ofa 16l'217 acre tract as described in Book l232,Page 770t,as filed in the offices of the clerk andRecorder of Garfield county, colorado, into threei3) tracts of approximately 5.362,7.330, and148.525 acres each with the exerytionparcels more practically as follows:

WHEREAS, the Petitioners have demonshated to tle satisfaction of the Board of Countycommissioners of Garfield county, colorado, that the propos"d division does not fall within thepurposes ofPart l, Article 28, Title 30, Colorado Revised Statutes lg73,as amended, for the reasonthat the division does not warrant ftrther subdivision review; and
WHEREAS, the Petitioners have demonstrated to the satisfaction of the Board of Co,ntycommissioners of Garfield county, colorado, that there is a reasonable probability of locatingdomestic water on each of said parcels, that there is existingingress and egress to said parcels, that

the location of septic tanks will be permitted by the Colorado Department of Healt[ that therequested division is not part ofan existing or larger development and does not fall within the generalpurposes and intent of the Subdivision Regulations of tle State of Colorado and the County ofGarfield, and should, therefore, be exempted fiom the definition of the tenns "subdivisior,, and*suMivided land" as set forth in c.Rs. 1973,30-2g-l0l (10) (a)-(d), as amended; and
Now TIIEREFORE, BE IT RESOLVED that the division of the above described16l'217 acre parcel is_herebyexempted from suchdefinitions andmaybe conveyed intheformoftheLot"l",Lot'2" and Lot'3",asaremorefullydescribedaboveanainatacopyoftheinstrumentor
