ACCESS EASEMENT
This ACCESS EASEMENT made this; I.' " -day of April, 2014, by Blue Heron Properties,
LLC (BHP) a Colorado Limited Liability Company.
WITNESS13TH:
WHEREAS, BHP is the owner in fee simple of Lot 257, Phase II, Filings 1, 2 and 3,
according to the plat recorded July 19, 2006, at Reception No. 702420, in the records of the Garfield
County Colorado Clerk and Recorders Office. ("Lot 257"); and
WHEREAS, Aspen Signature Homes of Ironbridge, LLC (ASH) is the owner in fee simple of
Lot 258, Phase II, Filings 1, 2 and 3, according to the plat recorded July 19, 2006, at Reception No.
702420, in the records of the Garfield County Colorado Clerk and Recorders Office. ("Lot 258");
and
WHEREAS, the BHP wishes to gutta non exclusive access easement as depicted on Exhibit
A attached hereto (the "Easement") for the benefit of Lot 258.
1. Recitals. The foregoing recitals are incorporated by reference herein.
2. Grant of Easement. BHP hereby grants and conveys to ASH, its successors and
assigns, the Easement, more particularly depicted on Exhibit A attached hereto and incorporated
herein by reference, for the purpose of ingress and egress to Lot 258.
3. Te;mjnation. In the event legal access is provided to Lot 258 that does not require
access across lot 257 the Easement granted herein shall terminate. If requested by either ASH or
BHP a Terntination of Easement shall be executed and recorded.
4. Authority. BHP represents and warrants that it has full right and lawful authority to
enter into this Agreement and that no consent or approval of any mortgagee or other entity is
required.
5. Successors and Assigns. This Agreement shall be binding upon and inure to the
benefit of the parties hereto, and their respective heirs, successors and assigns.
IN WITNESS WHEREOF, BHP has executed this easement on the date set forth above.
