RE: Lots 62A and 62B, Antlers Orchard Subdivision — Final Plat Amendment
Dear Mr. Stuver,
This letter is provided as notification that your request, on behalf of Matthew J. Stewart,
Douglas Miles Stewart, and Kimberley June Stewart (Applicants), for a Director's
Determination for an amendment to an approved Final Plat to modify the lot lines between
Lots 62A and 62B of the Antlers Orchard Subdivision. The resulting acreage for amended lots
shall be 10.012 acres (Lot 62A) and 16.219 acres (Lot 62B). This application has been
reviewed and the Director has approved the application subject to the following conditions
(please note that items indicated in red are to be added and items indicated in red and
stricken through are to be removed):
1. That all representations of the Applicants shall be considered conditions of approval
unless amended herein.
2. That prior to scheduling the Final Plat for Board of County Commissioner signature, the
Applicants shall complete the following required final plat changes:
a) Remove the existing Plat Notes on the plat;
b) Add the approved final plat notes of the subdivision to the plat or reference as a plat
note that the final plat notes are still applicable and shall be adhered to;
c) State the purpose of this plat in the Plat Notes;
d) Put the notes under "Notes and Legend" under the heading of "Plat Notes" and
number these notes. Also, add the "Notice" found in the lower left hand corner of the
plat as plat note;
e) Please note on the plat if the new lot line follows a ditch or drainage;
f) The title of the final plat shall be as follows: Antlers Orchard Development, Third
Amended Final Plat of Lot 62A and Lot 62B;
g)
Replace the zoning in the "Land Use Summary" of Agricultural/Residential to Rural for
both Lots 62A and 62B. Also, the heading for this column should be labeled as

h) Make corrections to the Certificate of Dedication and Ownership on the plat as follows:

8-1650 being sole Owner(s) in fee simple of all that real property situated in Garfield
County, described as follows:
Lot 62-A and Lot 62-B, Second Amended Final Plat of Lot 62, Antlers Orchard
Development Company's Plat No. 1, according to the plat thereof Recorded August 3,
2005 in the office of the Garfield County Clerk and Recorder as Reception No. 679436_

Please note that if the signatures of the all the individuals above are not signed at the
same time before a notary public then individual notary public certificate blocks will be
required;
a) Remove "Garfield" on Clerk and Recorder Certificate Form Block;
b) Make corrections to the County Commissioners Certificate on the plat as follows:
"Based on the review and recommendation of Garfield County Director of Community
Development the Building and Planning Department, the Board of County
Commissioners of Garfield County, Colorado, hereby approves this amended Final
Plat this
c) Make corrections to the Title Certificate on the plat as follows: "1 , and
attorney licensed to practice law in the State of Colorado, or agent authorized by a
Title Insurance Company, do hereby certify that I have examined the title to all lands
shown upon this plat and that title to such lands is vested in Third---Amended-Plat of -Let

Please note the title company or an attorney will need to fill in the blank indicted in red
above;
d) Make corrections to the Certificate of Taxes Paid as follows: "I the undersigned, do
hereby certify that the entire amount of taxes and assessments due an and

e) Under the signature line of the Surveyor's Certificate, add the address of the surveyor.
Also, make the following correction and is duly recorded -a- as Reception No.
f) Make corrections to the Surveyor's Certificate on the plat as follows: "I, Brian A.
Steinwinder, do hereby certify that I am a professional land surveyor licensed under
the laws of the State of Colorado, and that this plat is a true, corrected and complete
plat of Lots 62A and 62B Antlers Orchard Development, Third Amended Final Plat of
Lot 62, Antlers Orchard Development Com*any's Plat No, 1 Plat Lot 62A and Lot 62B,
as laid out, platted, dedicated and shown hereon, that such plat was made from an
accurate survey of said property by me, or under my supervision, and correctly shows
the location and dimensions of the lots, easements and streets of Rifle Village South
Parcel B Amended Plat Antlers Orchard Development, Third Amended Final Plat of Lot
62A and Lot 62B as the same staked upon the ground in compliance with applicable
regulations governing the subdivision of land.";
g)
Add the address of the surveyor under the surveyor's name within the Surveyor's
Certificate.
h) Add the following to the County Surveyor's Certificate: "Dated this day of
, A.D., 20 .";
i) Add two (2) lien holder consent certificates for the two (2) Deed of Trust holders to the
final plat.
3. That prior to scheduling the plat for Board of County Commissioner signature, the
Applicants shall submit a mylar signed by all required entities except the Board of County
Commissioners, Clerk & Recorder and County Surveyor; and,
4. Within 90 days of this determination the Amended Plat shall be shall be signed by the
Chairman of the Board of County Commissioners and recorded in the office of the Garfield
County Clerk and Recorder. The Plat shall meet the minimum CRS standards for land
survey plats, as required by Colorado State Law, and approved by the County Surveyor.
The ULUR requires notification to the Board of County Commissioners for their review and
potential call-up of the application for public hearing. The Board review is for a period of 10
calendar days after which the mylar may be scheduled for signature if there is no request for
call-up to a public hearing. The call-up period shall expire on June 5, 2011. The Amended
Final Plat will be scheduled on the Board of County Commissioner's consent agenda after
expiration of the call-up period and once the conditions of approval have been met.
