DESCRIPTION OF THE PROPOSAL The Applicant is requesting to move the interior lot line separating Lot 41 and Lot 42 so the lot dimensions will conform to the natural ditch feature of the property. Lot 41 will increase from 7.586 ac. to 8.071 ac., and Lot 42 will decrease from 10.128 ac. to 9.642 ac. The Applicant is the owner of Lot 42 and has consent from the adjacent owner to join then in this application. The property is located east of CR 227, north of I-70, between Rifle and Silt. There is one single family dwelling unit on each lot. The lots were Orme initially in 1.11_ as part of the Antler's Orchard Development Subdivision. Section 6:10 of the Subd on regulations states that an amendment may be made to a re orded plat if such amendment does n t 1 "increase the number of subdivision lots or dwelling unir 2 )lresult in the major relocation of a road or add new roads. This request will not result in either of the two aforementioned standards and Staff finds these standards are met. II. STAFF RECOMMENDATION The Applicant has provided all required documentation and has satisfied the applicable standards for a plat amendment. Therefore, Staff recommends that the Board of County Commissioners, pursuant to Section 6:10 of the Subdivision Regulations of 1984, as amended, Approve this amended plat request with the following conditions: 1. That all representations of the Applicant, either within the application or stated at the meeting before the Board, shall be considered conditions of approval; and 11 fiX / l?. Within 90 day approval, the Amended Final PI,St shall be reviewed (paper copy), then signed and 2 re I/ dated (mylar co by the County Surveyor, than signed and dated by the Chairman of the Board and recorded in the Clerk and Recorder's Office of Garfield County. The Amended Final Plat shall meet T1YUA` the minimum CRS standards for land survey plats, as required by Colorado state law, and approved by the County Surveyor and shall include, at a minimum, the information outlined in Section 5:22 of the Garfield County Subdivision Regulations. 3. Prior to submittal by the Applicant of the mylar in the above condition, the Applicant shall place a 25.0' Access & Utility Easement from Book 1159 Page 829, along the northern property line of both lots 41 and 42. INTEROFFICE MEMORANDUM To: Jim Hardcastle, Building and Planning Department From: Scott Aibner — Garfield County Surveyor Subject: Amended Plat Tracts 41 and 42, Antlers Orchard Development Date: 6/16/04 Dear Jim, Upon review of the, Amended Plat Tracts 41 and 42; Antlers Orchard Development, I have prepared a list of comments or corrections to be made prior to approval for survey content and form. 1. The overall boundary does not close by 0.26 feet. 2. The Southeast corner of tract 42 should be found or set and noted as such on the plat. 3. The basis of bearings needs to completed in note number one of the surveyors notes. Also note number four refers to lots instead of tracts. 4. A tie to a known section corner or corners would complete the position of these tracts within the section.
