The Board of County Commissioners of Garfield County, Colorado, (Board) received a request for a Land Use Change Permit to allow for Processing and Material Handling for the Parachute Creek Gas Plant Expansion as further described in Exhibit A, Lease Areas, Exhibit B, C, and D, Site Plans. B. The Parachute Creek Gas Plant Expansion is located within a 1,333 acre parcel of land owned by Williams Production RMT Company LLC/WPX Energy Rocky Mountain, LLC. The ownership of this property is described in a Commonwealth Title Company of Garfield County File No. 1201017, dated 1/24/12. C. Processing and Material Handling may be permitted in. the Resource Lands- Gentle Slopes zone district with Major Impact Review. E. The Planning Commission opened a public hearing on the 23rd day of May, 2012 for consideration of whether the proposed Major Impact Review for Processing and Material Handling should be approved, approved with conditions, or denied, during which hearing the public and interested persons were given the opportunity to express their opinions regarding the request. F. The Planning Commission closed the public hearing on the 23rd day of May, 2012 to make a final decision. The Planning Commission voted to recommend the Board of County Commissioners approve with conditions the Major Impact Review for Processing and Material Handling. G. The Board of County Commissioners opened a public hearing on the 9th day of July, 2012 for consideration of whether the proposed Land Use Change Permit should be granted or denied, during which hearing the public and interested persons were given the opportunity to express their opinions regarding the request. H. The Board of County Commissioners closed the public hearing on the 9th day of July, .2012 to make a final decision. I. The Board of County Commissioners on the basis of substantial competent evidence produced at the aforementioned hearing, has made the following determinations of fact: 1. That the public hearings before the Planning Commission and Board of County Commissioners were extensive and complete; all pertinent facts, matters and issues were submitted; and that all interested parties were heard at those hearings. 2. The proposed use is in the best interest of the health, safety, convenience, order, prosperity, and welfare of the citizens of Garfield County, 3. That the application, if all conditions are met, can be in conformance with the applicable Sections of the Garfield County Unified Land Use Resolution of 2008, as amended. 4. The application is in general conformance with the Garfield County Comprehensive Plan 2030. The forgoing Recitals are incorporated. by this reference as part of the resolution. B. The Land Use Change Permit for Processing and Material Handling related to Parachute Creek Gas Plant Expansion is hereby approved subject to compliance with the following conditions: 1. That all representations made by the Applicant in the application, and .at the public hearings, shall be conditions of approval, unless specifically altered by the Board of County Commissioners. 2. That the operation of the facility be done in accordance with all applicable Federal, State, and local regulations governing the operation of this type of facility. 3. Site operations shall not emit heat, glare, radiation, dust, or fumes which substantially interfere with the existing use of adjoining property or which constitutes a public nuisance or hazard. 4. All equipment and structures associated with this permit shall be painted with non - reflective paint in neutral colors to reduce glare and mitigate any visual impacts. 5. All lighting associated with the property shall be directed inward and downward towards the interior of the property. G. Prior to issuance of the Land Use Change Permit, the Applicant shall obtain all required federal, state, and local permits. This requirement does not include the Construction Permit from the Air Quality Control Division of Colorado Department of Public Health and Environment (CDPIIE) which will be issued prior to commencement of the operation of the facility. The Applicant shall provide a copy of that permit to Garfield County Building and Planning Department upon issuance by CDPHE. 7. The Applicant shall implement wildlife mitigation measures as specified in the William Field Services, Parachute Creek TXP-1 Project, Section 7-202 Protection of Wildlife Habitat Areas, Garfield County Unified Land Use Resolution 2008 prepared by WestWater Engineering dated September 2011 and Phil Vaughan Construction Management Inc., Bargath LLC. Parachute Creek Pipeyard Laydown Area, Mitigation Recommendations: Section 7-202 Protection of Wildlife Habitat Areas, Garfield County Unified Land Use Resolution 2008, prepared by WestWater Engineering dated January 2012 as attached as exhibits to the Resolution attached as Exhibit E. 8. The Applicant shall implement Colorado Parks & Wildlife's Best Management Practices as follows: A. Establish policies to protect wildlife (e.g., no poaching, no firearms, no dogs on location, no feeding of wildlife, etc.). 2. Promptly report spills that affect wildlife to the Water Quality Control Division of Colorado Department of Public Health and Environment and Colorado Parks & Wildlife. 3. Store and stage emergency spill response equipment at strategic locations along perennial water courses so that it is available to expedite effective spill response. B. Invasive/Non-Native Vegetation Control 1. Continue control programs for the life of the well field (applicable to the Gas Plant). C. Restoration, Reclamation and Abandonment 1. Seed a. Use appropriately diverse reclamation seed mixes that mirror an appropriate reference area_ for the site being reclaimed (see also species- specific pecies- specifc recommendations). • b. Emphasize bunchgrass over sod -forming grasses in seed mixes in order to provide more effective wildlife cover and to facilitate forb and shrub establishment. c. Plan for reclamation failure and beprepared to repeat seeding as necessary to meet vegetation cover, composition, and diversity standards. 2. Vegetation Cover Standard a. Establish vegetation with total perennial non-invasive plant cover of at least eighty (80) percent of pre -disturbance or reference area levels - 3. Establishing Reclaimed Areas a. Apply certified.weed free mulch and Crimp or tacify to remain in place to reclaim areas for seed preservation and moisture retention. b. Utilize staked soil retention blankets for erosion control and reclamation of large surface areas with 3:1 or steeper slopes. Avoid use of plastic blanket materials, known to cause mortality ofsnakes. c. Control weeds in areas surrounding reclamation areas in 'order to reduce weed competition. d. . Monitoring 1. Conduct necessary reclamation and invasive plant monitoring. E. Deer and Elk 1. Avoid aggressive non-native grasses and shrubs in mule deer and elk habitat restoration. 2. Reclaim mule deer and elk habitats with native shrubs, grasses, and forbs appropriate to the ecological site disturbed. F. Black. Bear 1. Initiate a food and waste/refuse management program that uses bear -proof food storage containers and trash receptacles. 2. Report bear conflicts immediately to CPW. 9. Prior to construction, the Applicant shall provide the Garfield County Planning Department for their review, evidence demonstrating that the Applicant requested an extension to their existing stonnwater permits for the TXP-1 expansion and laydown/employee parking areas from Colorado Department of Public Health and Environment (CDPHE). Once CDPHE issues these permits copies shall be provided. to Garfield County Planning Department. 13_ Erosion control measures shall be in place at the laydown yard/employee parking area prior to any construction commencing. 11. The Property Owner and Operator acknowledge that the County has the following performance standards, and failure to comply with such standards could lead to revocation of the Land Use Change Permit: A. All fabrication, service and repair operations shall be conducted within an enclosed building or obscured by a fence, natural topography or landscaping; B. All operations involving loading and unloading of vehicles shall be conducted on private property and shall not be conducted on a public fight -of -way; C. AIL industrial wastes shall be disposed of in a manner consistent with statutes and requirements of CDPHE; D. Every use shall be operated so that the ground vibration inherently and recurrently generated is not perceptible without instruments at any point of any boundary line of the property; and, E.
