A/R/RD (Agricultural / Residential / Rural Density) I. DESCRIPTION OF THE PROPOSAL: The Applicant is requesting a modification the southern boundary of Lot 29 and the northern boundary of Lot 37 for the purpose of reflecting the actual location of the 40' roadway which has been constructed and is in place. As reflected on the 2"0 Amended Plat submitted with the application, the current boundary lines of Lots 29 and 37 were located within the originally platted 40' roadway and utility easement. The proposed location of the boundary lines for these lots will also lie within the centerline of the new 40' roadway easement location. Staff is of the opinion that this new 40' roadway easement shall also reflect that this easement is for utilities as originally platted il. APPLICABLITY Pursuant to section 6:00 of the Subdivision Regulations, an amendment may be made to a recorded plat, if such amendment does not increase the number of subdivision lots or dwelling units, result in the major relocation of a road or add new roads. [I. BACKGROUND The Antlers Orchard Development tracts were platted in 1906. In 2001, an Amended Plat request was made by Mr. and Mrs. LaFrenz for the purpose of amending the lot boundaries of the five (5) platted Antlers Orchard Development lots. The purpose of the l" Amended Plat was to provide a better overall lot configuration more suitable to the existing topography, thus offering more suitable building sites. The Amended Final Plat was approved by the Board on September 10, 2001, and the Amended Plat was recorded on November 20,2001. o o LaF r enzl J affr ey Amended Pl at BOCC: lll17l03 Page2 IV. STAFFRECOMMENDATIONS: Staff recommends that the Board APPROVE the Antlers Orchard Development 2'u Amended Plat for Lots 29 and 37 , subject to the following conditions of approval: 1. That all representations of the Applicant, either within the application or stated at the meeting before the Board, shall be considered conditions of approval; 2. The easement for the existing roadway shall be identified as "40' Roadway and Utility Easement". 3. The plat shall be titled "Amended Final Plat of (subdivision name)". Within 90 days of approval, the Amended Final Plat shall be signed and dated by the County Surveyor, then signed and dated by the Chairman of the Board and recorded in the Clerk and Recorder's Office of Garfield County. The Amended Final Plat shall meet the minimum CRS standards for land survey plats, as required by Colorado state law, and approved by the County Surveyor and shall include, at a minimum, the information outlined in Section 5:22 of the Garfi eld County Subdivision Regulations. Amended Plat Dear Mr. and Mrs. LaFrenz and Mr. Jaffrey, As you are aware, the Board of County Commissioners approved the request to amend Tracts 29 and, 37 ofthe Antler's Orchard Development Company PlatNo. 1 on Monday, November 17, 2003 with the following conditions : 1. That all representations of the Applicant, either within the application or stated at the meeting before the Board, shall be considered conditions of approval; 2 The easement for the existing roadway shall be identified as "40' Roadway and Utility Easement"- 3. The plat shall be titled "Amended Final Plat of (subdivision name)". As a matter ofprocess and within 90 days of the approval by the Board, you are required to submit a paper version of the amended final plat for review by the County Surveyor. Once any corrections have been made, you are required to provide a mylar of the final plat to this office for signature by the County Surveyor.
