My clients presently own approximately 135 acres, which has been platted and filed in the officeof the C1erk and Recorders office, divided into ten separatelots. On the original plat, there are easements for road- ways shown along the various 1ot 1ines. It appears, in two instances, that the platted road- ways are not entirely susceptible to convenient use for roadway construction. In one case, Lhe roadway would crossa deep gul1y, and in another the roadway would run on aquite steep hillside area. My clients feel- that it would be very much in the bestinterest of the prospective purchasers of this land todedicate additional roadways, for the service of the interiorlots of the subdivision. We feel this can be accomplished pursuant to C.R.S. (1973) 30-28-110, (1) (a). We are representing Iu1r. Dick Wheeler for road changes in the Antlers urchard Development Company's Plat No. 1 (the ol-d Fazzi- Property NorLhof Si1t, CoJ-orado). The First of February 1975r w€ met with the County Commissioners,partaining to the road changes and the Commissioners advised usto present this road change to the P1-anning and 'Zoning Committee.uur understanding is the Commissioners vould like the Planning and Zoning Committees view and comments upon this road change. I"1ay I point out, that we f eel there are no lots being changed byrelocating the roads. Lots shown on Plat No. I appear to be along the center of the roads. In other words, the roads shownare Public Road Easements on either side of the 1ots. Ihe roadsin thich we wish to change are inexistence and would be quit.ecostly to consLruct, 1et alone the cost for maintance and doubtfulif bhey would be excepted for a county road. This is our mainobjective. Mr. Wheeler would like to serve the 1ots, which he owoslthe best way possibler to be able to dedicaEe the road system tothe County and have aceess to adjacent property owner if and when they may develope their land. Mr. !.lheeler is planning on selling t.he lots by a meets and bounds description subject to a road easement and if possible excepting thaL portion of a county roadr which ever may occur. If the road changes are agreed on there vitt be an amended mapof that portion of the Antlers urchard Development Company'sPlat No. 1, partaining to the road changes only.
