Box 681 Glenwood Springs, CO 81602 RE: Christeleit Views Subdivision Improvements Agreement Dear Mr. & Mrs. Christeleit: Earlier this week, a letter was sent to this office stating that the "water system is 100% operational and constructed as designed except as noted herein". The letter continues by saying that only one of the four 120 gallon pressure tanks has been installed and that the Homeowners Association will install additional pressure tanks as needed, as additional houses are constructed. The Subdivision Improvements Agreement was based on the completion of the water system as approved at the time of Preliminary Plan approval and the security to guarantee the improvements was based on the same system being installed. After reviewing the file on the subdivision, it appears that there is a violation of the agreement, since the improvements were not completed by October 1, 1994 and the letter of credit guaranteeing the improvements is no longer valid. The County does have the ability to vacate the plat, per a consent to vacate that you signed at the time the agreement was originally signed. This is not an option we want to pursue, but at this time, it is obvious that some corrective action needs to occur. To resolve this issue, there appear to be two options, short of vacating the plat. One option is to request an amendment to the Preliminary Plan approval given to the water system. This will require going back to a public hearing before the Board of County Commissioners. The other option, is to amend the Subdivision Improvements Agreement and post security to guarantee the completion of the improvements. This option will have to be completed, regardless of whether or not you decide to request an amendment to the water system improvements agreed to during the Preliminary Plan process. 109 8th Street, Suite 303 945-8212/625-5571/285-7972 Glenwood Springs, Colorado 81601 • Please contact me within the next 15 days, to determine a course of action to correct the problem that exists presently. Until we resolve this, the Subdivision Improvements Agreement will continue to be a cloud on any title commitment and it could, in a worst case, result in the vacation of the plat for certain lots. We would prefer not to have to take that kind of action, but due to your change in residence and change in staff dealing with this subdivision, it is necessary for everyone involved to update the old agreement. Garfield County Attorney 109 8th Street, Room 300 Glenwood Springs CO 81601 RE: CHRISTELEIT SUBDIVISION WATER SYSTEM Dear Mr. DeFord: October 27, 1995 This letter is provided as written certification that the Christeleit Subdivision water system is 100% operational and constructed as designed except as noted herein. This certification is based on my inspection of the system on October 27, 1995. The plans called for four 120 gallon pressure tanks to provide continuously adequate pressure to the upper lots of the subdivision. At the present time 1 pressure tank has been installed which is adequate for the existing homes. It is my understanding based on a telephone conversation with Bill Collins of Collins Pump Service who installed the system, that the Homeowners Association will install additional pressure tanks as needed as additional homes are constructed.
