After discussing the Planning Department's concems regarding vacating the right-of-way for roadway as depicted on Plat of Antlers Orchard Development, located on the southerly boundary of Tract 42b, wc have determined it is unnecessary for this roadway to be vacated. We will remove the reference regarding vacating the roadway from the Amended Final Plat. There is also a clarification which should be made as to the statement on the Petition for Amended Plat located in Paragraph 4 of the Petition regarding access to the tracts. Paragraph 4 should read "Access to Tracts 39b,41b and 42b shall be from County Road No. 216 by way of a shared driveway, as depicted by the forty (40) foot access, utility and drainage easement on the Amended Final Plat." There will not be three (3) separate accesses for these tracts from County Road No. 216. We are willing to execute a shared driveway agreement in the event such agreement is required by the County. Please let me know if you require this document to be submitted prior to the April 17,2000 public meeting before the Garfield County Board of County Commissioners. BEFORE THE BOARD OF COTINTY COMMISSIONERS GARFIELD COITNTY, COLORADO Pursuant to c.R.s. $30-28-133(a), LYoN LAND AND CATTLE, L.L.C., respectfully petitions the Board of County Commissioners of Garfield County, Colorado to accept an amended Plat to relocate property lines between three (3) adjacent lots, which lots are described as Tracts 39, 41 and 42, Antlers Orchard Development Company Plat No. l, situated in the NWZ+ SWZ+ of Section 4, Township 6 South, Range 92 West of the 6'h P.M., County of Garfield, State of Colorado, for the reasons stated below. 1' The three (3) tracts which are the subject of this Petition are owned by the Petitioner, LYON LAND AND CATTLE, L.L.C., a Colorado limited liabiliry company(See copy of deed submitted herewith as Exhibit A). 2. The purpose of this amended plat request is to allow for the relocation of lot lines three adjacent lots which will reconfigure the lots to allow for a more even division oflots. The reconfigured lots as shown on the amended plat will be Tract 3gb, which is approximately 3.69 acres, Tract 41b, which is approximately 4.311 acres, and Tract 42b, which is 3.016 acres. 3. The parcels will be served by individual wells and septic systems, and petitioner has applied for a well permit for each of the parcels. (See attached Well Permit Applications submitted herewith as Exhibit B.) 4. Access to the Tracts 39b and 42b shall be directly from County Road No. 216. When range condition deteriorates, shrubs increase. Properly managing grazing maintains and improves range condition. Elk, mule deer, coyote, and grouse find habitat on this soil. Use of this soil for community development and as a source of construction material is limited by depth to rock and steep slopes. This soil is in capability subclass Vlle, nonirrigated. S3-Parachute-Rhone loams, 5 to 30 percent slopes. These gently sloping to steep soils are on ridge crests and mountainsides. Elevation ranges from 7,600 to 8,600 feet. The Parachute soil formed in residuum from sandstone or marlstone, and the Rhone soil formed in residuum from hard, fine-grained sandstone. The aver- age annual precipitation is about 20 inches, the average annual air temperature is about 40 degrees F, anrl the frost-free period is less than 75 days. The Parachute soil makes up about 55 percent of the map unit, the Rhone soil makes up about 30 percent, and soils of minor extent make up 15 percent. The Parachute soil is mostly on ridge crests, and the Rhone soil is in gently sloping to moderately sloping areas on mountainsides. The Parachute soil is moderately deep and well drained. Typically, the surface layer is grayish brown loam about 5 inches thick. The upper part of the subsoilis very o'ark grayish brown and brown loam about 13 inches thick, and the lower part is light yellowish brown extremely channery loam about 11 inches thick. Hard, fractured sandstone is at a depth of 2g inches (fig. 9). Permeability of the Parachute soil is moderate,- and available water capacity is low, Ef{ective rooting depth is20 to 40 inches. Surface runoff is medium, and the erosion hazard is moderate. The Rhone soil is deep and well drained. Typically, the upper part of the surface layer is brown loam about g inches thick, and the lower part is brown sandy clayloam about 20 inches thick. The underlying material iibrown very channery sandy clay loam ibout 2q inchesthick. Fractured sandstone is at a depth of 52 inches. . Permeability of the Rhone soil is moderate, and availa-ble water capacity is moderate to high. Effective rootingdepth is 40 to 60 inches. Surface rurioff is slow, and th6erosion hazard is slight. lncluded with these soils in mapping are areas of lrigulsoils on ridge crests. These areas irake up about -i 0percent of the map unit. . These soils are used mainly for grazing and wildlifehabitat. - The native vegetation on these soils is mainly needle-grass, elk sedge, and sagebrush. 31 When range condition deteriorates, forbs and shrubs increase. Properly managing grazing maintains and im- proves range condition. Seeding improves range in poor condition where slope is less than 15 percent. lntermedi- ate wheatgrass, slender wheatgrass, and mountain and smooth brome are suitable for seeding. Preparing a seedbed and drilling the seed are good practices. Re- ducing brush on slopes of less than 15 percent improves deteriorated range, but removing brush may damage deer habitat. Many deer and some snowshoe hare and blue grouse find habrt:i on these soils. Use of this soil for community development or as a source of construction material is limited by depth to rock and steep slopes. This complex is in capability subclass Vle, nonirrigated. S4-Potts loam, 1 to 3 percent slopes. This deep, well drained soil is on mesas, benches, and sides of valleys. Elevation ranges from 5,000 to 7,000 feet. This soil formed in alluvium derived from sarrdstone, shale, or basalt. The average annual precipitaiion is about '14 inches, the average annual air temoerature is about 46 degrees F, and the average frost-iree period is about 120 days. Typically, the surface layer is brcwn loam about 4 inches thick. The subsoil is redCish brown clay loam aboul 24 inches thick. The suDstratum is pinkish white loam to a depth of 60 inches. lncluded with this soil in n-apping are small areas of Olney, Kim, and lldefonso soils that have slopes of 1 to 3 percent. These areas make up 10 to 15 percent of the map unit. Permeability is moderate, and available water capacity is high. Effective rooting depth is 60 inches or more. Surface runoff is slow, and the erosion hazard is slight. This soil is used mainly for irrigated crops and hay andfor dryland farming. Alfalfa, small grains, and grass- legume hay are grown. This soil is usually irrigated by flooding. Drop struc- tures in irrigation ditches, grassed waterways, and mini- mum tillage control erosion. lrrigation water should be carefully managed to avoid piping. Cover crops or stub- ble mulchrng also help to limit erosion losses in dry- farmed areas. The native vegetation on this soil is mainly wheat- grass, needleandthread, and sagebrush. Pheasant, mourning dove, cottontail rabbit, some mule deer, and squirrel find habitat on this soil. Community development and recreation are limited by low strength and shrink-swell potential. Dwellings and roads can be designed to compensate for these limita- tions. Community sewage systems will be needed if the population density increases. This soil is in capability subclasses llle, irrigated, and lllc, nonirrigated. oo32 S5-Potts !oam, 3 to 6 percent slopes. This Agreement constitutes the Subdivision Improvements Agreement (the "SIA") required and intended to secure the faithful construction and installation of the subdivision improvements required as a condition to Final Plat approval. The County hereby accepts and approves the Final Arnended PIat of the Lots, subject to the terms and cond,itions of this Agreement, as well as the terms and conditions of ttre Preliminary Plat approval and the requirements of the Garfield County Zoning and S ubdivision Regulations. 2. OwFer]s-Performance. Owner has constructed and installed, or shail cause to be constructed and installed, at its own expense, those subdivision improvements relating to the Lots which are required to be constructed by Resolution No. _, this Agreement, the Final Amended Plat and the Garfield County Zoning and Subdivision Regulations. The estimated cost of completion of the subdivision improvements related to the Lots is as set forth and certified by a licensed engineer on Exhibit B attached hereto and incorporated herein.
