At a regular meeting of the Board of County
Commissioners for Garfield County, Colorado, held at the Courthouse in
Glenwood Springs on Monday , the 27th day of December A.D.
19 84 , there were present:

when the following proceedings, among others were had and done, to -wit:
RESOLUTION NO. 84-265
A RESOLUTION CONCERNED WITH THE APPROVAL OF A PRELIMINARY PLAN FOR THE
REPLAT OF CHELYN ACRES, TRACT 1
WHEREAS, David H. Sivright has filed an application with the Board of
County, Commissioners of Garfield County for approval of a Preliminary
Plan of the repiat of Chelyn Acres, Tract 1, and;
WHEREAS, based on the material submitted by the applicant and the
comments of the Garfield County Planning Department, this Board finds as
follows:
1. That proper publication, public notice and posting was provided
as required by law for the hearings before the Planning
Commission on November 14, 1984 and Board of County Commissioners
on December 10, 1984;' and
2. That the hearings before the Planning Commission and Board of
County Commissioners were extensive and complete, that all
pertinent facts, matters and issues were submitted and that all
interested parties were heard at that hearing; and
3. That the Garfield County Planning Commission recommended approval
of the Preliminary Plan; and
4. That the proposed subdivision of land is in compliance with the
recommendations set forth in the Comprehensive Plan tor the
unincorporated area of the county; and
5. That all data, surveys, analyses, studies, plans and designs as
are required by the State of Colorado and Garfield County have
been submitted, reviewed, and found to meet all sound planning
and engineering requirements of the Garfield County Subdivision
Regulations.
6. That the proposed subdivision of land conforms to the Garfield
County Zoning Resolution.
7. That tor the above -stated and other reasons, the proposed
subdivision is in the best interest of the nealtn, safety,
morals, convenience, order, prosperity, and welfare of the
citizens of Garfield County.
NOW, THEREFORE, BE IT RESOLVED that the Preliminary Plan of Chelyn
Acres, Tract 1 for the following described unincorporated area of
Garfield County be approved with the following conditions:

1. That prior to Final Plat submittal, verification of a legal,
adequate domestic source of water for both lots be received from
the Division of Water Resources and provided to the Department of
Development.
2. the Final Plat have the following information:
Be entitled "Chelyn Acres, Tract 1, Replat"
Have. legally a described easement drawn on the
access and maintenance around the well and for
waterline to the 2.0 acre parcel.
A plat note stating: A soils and foundation investigation
shall be performed by a registered professional engineer
for any residential structures and be submitted with
building permit application.
A plat note stating: that the 2.0 acre
interest in the well water rights.
3. That $200.00 for School Impact fees be suomitte.d along with the
Final Plat.

4. That the new parcel be subject to the same Homeowners Association
By -Laws and be a member of the Association.
