Sivright A part of the NW 1/4, Section 3, T7S, R89W, more practically described as a parcel located approximately 1 1/2 miles south of Glenwood Springs off of Van Dorn Road (CR 149) . SITE: A 5.47 acre tract to be split into two single family lots. RELATIONSHIP TO THE COMPREHENSIVE PLAN The parcel is located with District B, Subdivision/Rural Serviceable Area of the Comprehensive Plan. II. DESCRIPTION OF THE PROPOSAL A. The parcels are on a hillside above Four Mile CreeK with scrub oax and sagebrusn as the predominant vegetation. There are slopes in excess of 25% on the lower portion of tne parcel, witn gentler sloping areas on the upper portion ot the parcel. B. Project Description: It is proposed to split the 5.47 acre parcel into two lots of 3.47 acres and 2.0 acres each. The proposed 3.47 acre parcel would have the existing residence and guesthouse on it. Both parcels would oe served oy a domestic well that produces 14 gallons per minute. A new individual sewage disposal system would be developed tor the 2.0 acre lot. III.MAJOR CONCERNS AND ISSUES A. Agency Comments: 1. The Colorado Geological Survey verbally noted that tne type of soils in tne proposed 2.0 acre tract should have a soils and foundation analysis prior to construction of a dwelling. It was also recommended tnat all slopes over 25% oe avoided for road or dwelling construction. • • 2. The Colorado Division of Water Resources is reviewing the late registration of the present well. Provided the Division of Water Resources approves the well as a domestic well, it will be necessary to have maintenance and access easements described on the plat for the well and water line to the 2.0 acre parcel. 3. The Soil Conservation Service concurred with the Colorado Geologic Survey's recommendation for a soils and foundation analysis prior to the building of a residence. 4. All utility companies have indicated that service can be provided. Glenwood Electric has requested that a 25 foot wide utility easement be created for any power lines crossing the property with the powerline being in the center of the easement. B. Staff Comments: 1. The recommendations of the Colorado Geologic Survey can De resolved by having the following plat note added to a Final Plat: A soils and foundation investigation shall be performed by a registered professional engineer tor any residential structures and be submitted with any building permit application. 2. Prior to the submittal of a final plat, verification of the Division of Water Resource's approval of the late registration of the well for the intended uses should be provided to the Department of Development. 3. If there is a main powerline crossing either proposed parcel, a 25 toot wide, legally described utility easement should be shown on the Final Plat. IV. SUGGESTED FINDINGS 1. That the proper publication and notice was provided as required by law. 2. That the public hearing before the Planning Commission was extensive and complete, that all facts, matters and issues were submitted and that all interested parties were heard at that hearing. 3. That the Preliminary Plan conforms with the requirements of the zone district in which the development is located. 4. That for the above stated and other reasons, the Preliminary Plan is in the best interest of the morals, order, health, safety, convenience and welfare of the citizens of Garfield County. V. RECQIDATION APPROVAL, with the following conditions: 1. That prior to Final Plat submittal, verification of a legal, adequate domestic source of water for both lots be received from the Division of Water Resources and provided to the Department of Development. • • 2. That the Final Plat have the following information: a. Be entitled "Chelyn Acres, Tract 1, Replat" b. Have legally a described easement drawn on the plat for access and maintenance around the well and for a waterline to the 2.0 acre parcel. c. A plat note stating: A soils and foundation investigation shall be performed by a registered professional engineer for any residential structures and be submitted with any building permit application. 3. That $200.00 for School Impact fees be submitted along with the Final Plat. 4. That the new parcel be subject to the same Homeowners Association by-laws and be a member of the Association.
