Eastley, Senior Planner Garfield County Community Development Department 108 Eighth Street, Suite 401 Glenwood Springs, CO 81601 RE: Submission of Revised Preliminary Plan/PUD Amendment Application for the Lake Springs Ranch PUD Dear Kathy: This letter accompanies the revised Lake Springs Ranch - Preliminary Plan/PUD Amendment Application. The application has been revised in response to the issues raised in your May 4, 2015 letter (attached) and clarified during our May 7th meeting. I have included 12 hard copies of the revised application, as requested, and a digital copy of the application in PDF format on compact disk. The disk contains pdt's of the application text and each of the exhibits separately as requested in item 1 of you May 4th letter. Also included on the disk, is a Word file of the application text and this cover letter. The following is a summary explaining how each of the items in your May 4th letter has been addressed in the revised application along with references to supporting documents as appropriate. 1. The CD submitted has a single pdf of the submittal materials. In order to load this information onto our website we request that you provide pdf's of each section in the application. This will ease the public, decision -maker, and referral agency review of the application. Response: The digital version of the application has been broken into separate files for the application text and the various exhibits as requested. The digital files are included on the included compact disk. 2. Planning staff is confused by the application format - typically the format follows the pre -application conference submittal requirements - the application forms and general submittal requirements are easily accessible at the beginning of the binder. Any format changes would be appreciated as the combination of the two applications is in itself confusing, anything that can lend clarity to the review would be appreciated. I think switching the figures and exhibits sections would allow the tab/exhibit numbers to be the same. Response: The application has been reorganized somewhat and the figures and exhibits have been organized as all exhibits and renumbered so that the tab numbers on the hard copy version of the application match the exhibit numbers in the table of contents. We have also modified the text of the application to more clearly distinguish between the Preliminary Plan amendments and PUD amendments. 3. The explanation of the request does not clearly identify which requests are being reviewed under the two requested processes. For example, the requested deletion of condition 15 - is this a part of the preliminary plan. amendment or PUD amendment? We cannot combine the two applications as the criteria is different for each and therefore the process for each request must be very clear. Response: This issue has been addressed by creating separate fists for the Preliminary Plan amendment items versus the PUD amendment items per our meeting on May 7t". The PUD and Preliminary Plan amendment items have also been listed at the beginning of their respective review criteria sections for clarity. 4. The Statement of Authority (SOA) incorrectly names the consulting company as agent of the LLLP. The general partner is typically designated as the individual authorized to act on behalf of the LLC. Then the general partner or person named in the SOA provides a letter of authorization for the consulting to be a representative on the land use application. Please provide a revised, recorded, SOA naming the general partner, as well as a letter of authorization for you to act in the land use permit application. Response: Per your May 7th email we have substituted the Statement of Authority (SOA) that was included in the original application with an SOA that was recorded in September of 2011 (Exhibit 10a of the revised application). We have also provide a letter authorizing me to represent the Berkeley Family LLLP on matters related to this application (Exhibit 10b). The letter has been signed by Maci Berkeley, the general partner of the LLLP. 5. Please provide an updated title commitment which has links to the documents. A digital version of the updated title commitment, with hyperlinks to the referenced documents is provided on the included compact disk. 6. Please update the 2004 and 2009 mineral owner research by researching the assessor and/or clerk's records. Response: Exhibit 14c is a report prepared by Eric McCafferty summarizing the current status of the mining rights associated with the property. 7. The pre -application conference summary form lisfs a submittal requirement for revised CCR's, if applicable and none were provided in the submittal. Are there any changes to the CCR's that would result from this proposal? Response: After careful review, if was determined that the CCR's do require a few minor changes, some of which are unrelated to the proposed amendments. A revised version of the CCR's, with the proposed revisions highlighted with Track Changes, has been provide as Exhibit 24 to the revised application. 8. The pre -application conference summary form states that the applicant is required to respond to all standards in Divisions 1, 2, 3, and 4 of Article 7. It appears that this did not occur as numerous subsections were not identified nor were responses provided. If these sections are not relevant to the review of the proposal then the applicant must demonstrate this fact. Response: As we discussed during our May 7th meeting, we added language near the beginning of the Review Criteria - Preliminary Plan Amendment section of the application text (Paragraph 2, Pane 8 of the application text) explaining why not all of the standards in Divisions 1 through 4 of Article 7 were addressed. 9. Staff was unable to locate the required revised and existing PUD Plans in the submittal documentation. Please provide the section in which it is located or submit these plans. Response: The PUD Plan (PUD Zone Map) is included as an attached to the revised PUD Guide (Exhibit 22). No changes to the PUD zoning are proposed with this application.
