Recitals
A. The Board of County Commissioners of Garfield County, Colorado,
received a pretiminary rian app[.uiion from David Hicks and Glenwood commercial'
LLC to condominiumize four recently constructed buildings into a total of 92 individual
warehouse, retaU ana off"" spaces tt be sold and or leased as separate fee interests as
illustrated on the approved preliminary Plan attached as Exhibit A;
c. The subject property is tocated in study Area I of the Garfield county
Comprehensive Ptan of ZObO,'is designated as Commercial General on the Proposed
Land Use Disticts ffi *d is locateld in the Commercial General Zone District and
legally described as shoin on the accompanying Preliminary Plan attached a Exhibit A;
D. The Planning commission opened a public hearinq on April 8, 2009 upon
the question of whethei th#re[minary Plan Application should be granted, granted with

conditions, or denied at which hcaring the public and interested persons were given the
opportunity to express their opinions rigarding the issuance of said Application;
E. The Garfield County Planning Commission closed the public hearing on
the April 8, 2009 and recommended "Applgv{ with conditions" for the Preliminary Plan
Application to the Board of County Commissioners;
F. on september 14, 2009, the Board of county commissioners (the Board)
opened a public he#ng upon the q,r".tiot, of whether the Preliminary Plan Application
should Ue eraffJ,;;-a with conditions, or denied at which hearing the public and
interested persons were given the opportunity to express their opinions regarding the
issuance of said APPlications;
G. The Board of County Commissioners closed the public hearing on the
September l4,2OO9 to make a final decision;
H. The Boar4 on the basis of substantial competent evidence produced at the
aforementioned hearing, has made the following detennination of facts:
1. Proof of proper public notice was provided as required for tie nulli3 hearings
before tfrl pt'an"i"g Commission and the Board of County Commissioners.
Z. The public hearing before the Planning Commission and the Board of County
Commissioners was extensive and complete, that all pertinent_facts, matters
and issues were submitted and that all interested parties were heard at those
hearings'
3. The Preliminary Plan Application has met the requirements set forth in the
Garfield County Zofug ilesolution of 1978, as amended and the Garfield
Cor.rntySubdivisionRegulationsoflgS4,asamended'
4. The above stated and other reasons' the proposed Preliminary Plan
Application has been determined to be in the best interest of the healt[ safety,
*ofir, convenience, order, prosperity and welfare of the citizens of Garfietd
CountY.
RES-OLUTION
NOW, THEREFORE, BE IT RESOLVED by the Board of county
Commissioners of Garfield County, Colorado, that:
A. The forgoing Recitals are incorporated by this reference as part of the Resolution'
B. The Preliminary Ptan Application submitted by David Hicks and Glenwood
Commercial ,-ttCto condominiumize four recently constnrcted buildings into a total
of 92 individual warehouse, retail and office spaces to be sold and or leased as
separate fee interests as lots as illustrated on the Preliminary Plan attached as Exhibit
1

A is hereby approved subject to compliance with the following conditions:
1. That all representations made by the Applicant in the application, and at the
public h#i"g before the Board of County Commissioners and Planning
Commissiorr, Ihdl be conditions of approval, unless specifically altered by the
Board of CountY Commissioners'
The Applicant shall submit a letter from a licensed professional engineer (licensed
to p."cii"e in the State of colorado) that states that the drainage improvemenls
*"L "o*t octed properly and in accordance with the recommendations in the
Final Drainage n"pott prepared by JLB Engineering Consultants (dated
itzsi2oo+) J wefi'with the recommendations of HP Geotech Preliminary
Geotechnical Study dated March 2001.
Specificatly, the letter shall also provide a drainage plan, at the same scale as the
pi.fi-i"*i Plan and prepared bi u" engineer registered in the State of Colorado,
which shalt dePict the following:
a) Limits of tributary areas' where practical;
b) Computations of expected tributary flows; and
c) Design of drainage facilities to prevent storm waters in excess of historic
run-off from eniering, damaging or being carried by existing drainage
facilities, and to prevint major damage or flooding of residences in a one
hundred (100) Year storm, showing:
1) Area subject to inundation; and
2) Locatio" and size of proposed culverts, bridges, ditches and
channels.
d) Shall provide proof that all drainage easements, channels, and culverts
have been desiined by an engineer registered in the State of colorado'
e) Shall provide proof that all drainage facilities have been designed based
on a minimum of a twenty-five (25) year frequency storm'

3. Pursuant to the recommendations in the Preliminary Geotechnicat Study preparg!
by gp Geotech in 2001, the Applicant shall instali a rockfall fence on the uphill
side of building fou as a miiigation measure or demonstrate that there is an

Professional Engineer'
4. The approved Preliminary Plan and Final Plat shalt be required to depict the
existing easements per section 4:50(O) of the Garfield county Subdivision
Regulations of 1984, as amended thai include the following documents: Book
3 49 -page 5 62, #47 57 7 7, #57 1 17 8, # 57 I 17 9' #6845 62'
1. The Applicant shall be required to provicte the Corurty Building and Planning
Department with a letter or email frbm CDOT that prwides acknowledgement
that the existing State Highway Access Permit covers the 92 warehouse' retail'

- 3. The development is also located in the RE-l School District. As such the

6. Fire Protection
The Preliminary Plan (and Final Plat) shall be revised to show all antennas and
equipment exterior to tk unit that Verizon will lease will be contained in an LCE
associated with their Unit.

south westem corner of the property near to the road to the colby and Lynch
properties.
b. The Condominiumization CC&Rs shall contain language that specifically
states who will be responsible for the annual tests and inspections *{ *y

and th" site of this sub.division. The fre suppression system required a fire
p*o to be installed on it to increase the water pressure to buildings three
and iour; it requires special operational procedures to keep it functioning
