A RHSOLUTlON CONCERNED Wlm THE APPROVAL OF A SPECIAL USE PERMIT
APPLICATION FOR KENNETII SPANGLER
WHEREAS, the Board of County Commissioners of Garfield County. Co!oradO, fias
received application from K~dh Spangler for a Special Use Permit to allow for a salvage yard
in the Ccmmen:ial Genml zone diltrict.
WHEREAS. the Board held a public bearing on the: Sth day of April 1999, upon the
question of whether the above-described Special Use Permit ahould be granted or denied. at
which hearing the public: and intere.sted persons were given the opportunity to express their
opinions regarding the Issuance of said Special Use Permit: and

WHEREAS. the Board on the basi1 of substantial competent evidence produced at the
aforementioned hcarina. has made the following dctennination of fact:
1. That proper publication and public notice was provided as required by law for lhc
hearing before the Boanf of County Commissioners.
2. That tho hearing before the Board of County Corrunissioners was extensive and
complete, that all pertinent facts, mattcra and issues were submitted and that aD
interested parties were heard at that hearing.
3. That the application is in compliance with the Garfield County Zoning Resolution
of 1978, as 1mCnded.
4. For the above stated and other reasons, the propO#d use il in the best interest of
the health, safety, morals, convenience, order, prosperity and wdfare of the
citizens of Garfield County.
NOW, THEREFORE. BE IT RESOLVED by the Board of County Commissioners of
Garfield County. Colorado, thal the Special Use Permit be and hereby is approved to allow for &H-A. ~

I. That an representations of the applicant, either within the application or stated It

3. The applicant shall obtain approval and periodic Inspection by the Rifle Fire
Protection Distri~ for compliance with any applicable re&1.1lation regarding the
storage of combustible material.
+. The applicant shall be limited to a commercial enterprise which Is consistent with
the definition of Storage as defined in the GarficJd County Zoning Resolution or
1978, as amended.
S. The applicant shall sign an agreement with Garfield County granting access to the
subjec:i property for inspection to ensure conformance wllh &he conditions or the
special use permits.
6. That the applicant provide proof or adequate emergency water for the purpoSO$ of
fire suppression to the satisfaction of the RiOe Fm: Protcedon District, and the
County.

That the applicant is limited to seven (7) parking areas. The number of units for
each area shall be limited to no more than three (3).
That the parking and access ways on sito be surfaced in such a manner as to
prevent negative oil' sile Impacts to adjoining property owners or to County roads .
Any expansion of the u•e as indicated in the application shaU only be undertaken
following approval by the Board of County Comm!ssionera.
10. The applicant shall oblain & building permit ror the scn:ening fence. The fence shall
be of uniform size, shape and color to the satisfaction of'the Board of County
Conunissionel"3.
