Street addresses have not yet been assigned. ZONING: Residential Urban (RU) LOT SIZES: Proposed Lots will be approximately 0.21 acres and 0.23 acres in size TYPE OF APPLICATION: Amended Plat I. GENERAL PROJECT DESCRIPTION The Applicant is proposing the elimination of individual lot lines shown on the Cooperton Townsite Plat to allow for the combination of the platted lots into two larger parcels. The elimination of the lot lines will create two conforming lots pursuant to the zoning for the property and allow the development of single family residences on each of the reconfigured lots. No changes to utilities or services for the reconfigured Tots are proposed. The lots will be served by central water and will each have an individual on-site waste water disposal system. Both lots will continue to have frontage onto Pine Street and the southerly lot will have secondary access from Sopris Ave. Review by Staff has confirmed that the southerly lots will have its front yard designated off of Pine Street for the purposed of setback determinations. The Applicant may include an access and utility easement across the southerly lot to facilitate development of the northerly lot. The amended plat will include new designations for the proposed lots. The proposed amendment will reduce the number of lots. Il. REGULATORY PROVISIONS APPLICANT IS REQURED TO ADDRESS The Amended Plat process is an Administrative Review, with decision by the Director of the Community Development Department. Public notice 15 days prior to the Director's Decision is required by mailing to adjacent property owners within 200 ft. and mineral rights owners of the subject parcel. REVIEW PROCESS 1. Pre -application Conference 2. Submittal of the Application (3 hardcopies, 1 on CD or memory card/stick) 3. Determination of Completeness and submittal of additional copies of the Application for referrals 4. Scheduling of a date for the Director's Decision 5. Completion of required public notice (certified mailing to adjacent property owners within 200 ft and certified/return receipt requested to mineral rights owners) 5. Evaluation by Director/Staff Review 6. Director's Decision 7. Ten Day Cal! -up Period 8. Finalize Plat, Verify Conditions have been Satisfied, circulation of plat for signatures 9. Execution of the Plat by the Board of County Commissioners and Recording IV. SUBMITTAL REQUIREMENTS As a convenience outlined below is a list of information typically required for this type of application: Copy of the Application Form, Application Fees and signed Payment Agreement Form. A narrative describing the request. Proof of Ownership for both parcels (title work or copy of a deed) and information on any lien holders. If a parcel is held in a trust or LLC a recorded Statement of Authority Form will be needed. Names and mailing addresses of properties within 200 ft. of the subject property are needed along with names and addresses of any owners of mineral rights for the subject properties. If Applicant intends to have a representative (Planner/Surveyor or Attorney) complete the Application and processing then a letter of authorization is needed. Copy of the Pre -application Summary needs to be included. The proposed amended plat showing the eliminated lot lines and new parcel designations/descriptions. > The amended plat should include improvement location information relevant to the area of the proposed amendment to ensure no nonconforming conditions will result from the amendment. The information may be removed prior to recording. z The amended plat should include a plat note indicating the purpose of the amended plat > A Vicinity Map generally showing the area within 3 miles. > A copy of the existing Cooperton Plat. > In regard to Article 7, the Application may include waiver requests pursuant to Section 4-118 or representations that certain standards are not applicable. The Application should include at a minimum representations that the amendment will not result in any changes to drainage, access, utility services or other applicable provisions of Article 7. The Application may include requests for waivers from submittal requirements such as an Improvements Agreement, pursuant to Section 4-202. Information on any covenants applicable to the property should be provided. V. APPLICATION REVIEW a. Review by: Staff for completeness recommendation and referral agencies for additional technical review b. Public Hearing: c. Total Deposit: $ 100 (additional hours are billed at $40.50 /hour) General Application Processing Planner reviews case for completeness and sends to referral agencies for comments. Case planner contacts applicant and sets up a site visit. Staff reviews application to determine if it meets standards of review. Case planner makes a recommendation of approval, approval with conditions, or denial to the Director of the Community Development Department.
