when the following proceedings, among others were had and done, to-wit:
RESOLUTION NO 95-O6r
A RESOLU-IION CONCERNED WITH THE APPROVAL OF A PRELIMINARY PLAN FOR
CEDAR RIDGE SUBDIVISION.
WHEREAS, BECKY WARNER has hled an application with the Board of County
Commissioners of Garf,reld County for approval of a Preliminary Plan for CEDAR RIDGE
Subdivision; and
WHEREAS, the Garheld County Planning Commission reviewed the Cedar Ridge application
and recommended approval to the Board of County Commissioners; and
WHEREAS, based on the material submitted by the applicant, the recommendation of the
Planning Commission and the comments of the Garf,reld County Planning Department, this Board
flrnds as follows:
Thatproperpublication, public notice andposting wasprovided asrequiredbylawfor
the hearings before the Planning Commission and Board of County Commissioners.
That the hearings before the Planning Commission and Board of County
Commissioners were extensive and complete, that all pertinent facts, matters and issues
were submitted and that all interested parties were heard at that hearings.
That the Garfield County Planning Commission recommended approval of the
Preliminary Plan.
That the proposed subdivision of land is in compliance with the recommendations set
forth in the Comprehensive Plan for the unincorporat,ed area of the County.
That all data, surveys, analyses, studies, plans and designs as required by the State of
Colorado and Garfield County have been submitted, reviewed, and found to meet all
sound planning and engineering requirements of the Garfield County Subdivision
Regulations.

6 That the proposed subdivision of land conforms to the Garfield County Zortng
Resolution.
That for the above-stated and other reasons, the proposed subdivision is in the best
interest of the health, safety, morals, convenience, order, prosperity and welfare of the
citizens of Garflreld County.
NOW, THEREFORE, BE m RESOLVED that the Preliminary Plan of Cedar Ridge
Subdivision for the following described unincorporated area of Garflreld County be approved with the
lollowing conditions:
That all representations of the applicant, either within the application or stated at the
public hearings before the Planning Commission and the Board of County
Commissioners shall be considered conditions of approval, unless stated otherwise by
the Planning Commission and the Board of County Commissioners.
The applicant shall prepare and submit a Subdivision Improvements Agreement (SIA)
addressing all on-site improvements, prior to recording a Final Plat.
The applicant shall submit improvement plans for all road, drainage and new utility
improvements prior to recording a final plat.
All new utilities shall be placed underground.
That all cut slopes created during construction shall be revegetated with native grasses
using certihed weed-free seed.
The applicant shall pay $200 per lot in school impact fees prior to approval of the final
plat.
Only one (1) dog will be allowed for each dwelling unit to protect adjacent agricultural
uses. Kennels shall be required, and language ensuring compliance shall be enforced
through the covenants.
Prior to Final Plat, the applicant shall submit percolation tests and an ISDS
Management Plan consistent with Section 4.92(D) ofthe Garflreld County Subdivision
Regulations. Ifthe percolation tests are not adequate, the applicant shall include a plat
note for the affected lots requiring engineered systems for new construction or
replacement of existing systems.
No open-hearth wood-burning devices will be allowed within the subdivision. Each
dwelling unit will be allowed one (1) EPA Phase II stove, and an unlimited number of
natural gas/propane devices.

10.Prior to the presentation of a frnal plat, a final water supply plan shall be submitted to
the Planning Department, including a court-approved augmentation plan and well
permit, if necessary.
The following plat notes addressing geologic constraints on the site shall appear on the
final plat:
'Lot 3 shall have positive drainage around each home of at least five (5) percent
for at least ten (10) feet from the foundation wall."

" Lot 3 requires the submittal of soil tests and foundation design at the time of
building permit submittal. "
12. Weed control is the responsibility of the property owner
Lot4 shall be deleted from the plat and an amended plat shall be prepared prior to the
recording of the plat for the subdivision.
The recommendations of the Colorado State Forester wildfire prevention guidelines,
specihed by the pamphlet "Wildhre Protection in the Wildland Urban fnterface"
prepared by the Colorado State Forest Service (C.S.F.S. #143-691) shall be followed in
the construction of all structures. The Architectural Committee will consider the
guidelines in the most current wildhre publication by the Colorado State Forest Service
when reviewing proposed structures.
