INTRODUCTION
Ralph and Connie Hubbell are the owners ol a 24.76 acre parcel on Main Elk Creek in Garfield
County, Colorado. The property is situated in Section 35, Township 4 South, Range g1 West, 6th
P.M. (See Figure 1, Location Mrp). The property is primarily agricultural land irrigated out of the
Cline Top Ditch and Cline Top Ditch No. 1.
Exempt household use only well permit No.177757 is associated with the property. The property
also includes a small flow through pond which is unadjudicated.
The Hubbells propose to subdivide the property into three parcels; two parcels of 2to 3 acres each
and a larger parcel of 20+ acres. Each parcel will be allowed a single family home, 2,50O square
feet of land and landscape irrigation and some livestock. Up to 10 head of livestock will be
allowed. A separate smallguest house will be allowed on one parcel in addition to the single family
home.
The purpose of this engineering report is to provide the information necessary to file an application
in District 5 Water Court for underground water rights, a surface water right, a storage water right
and a plan for augmentation to support the proposed three lot subdivision.
WATER REOUIREMENTS
The water requirements consist of domestic uses inside three single family homes and a guest
house, irrigation of 1,OOO square feet of lawn and landscape per home (total of 3,OOO S.F.),
livestock water for 1O head. The above uses will be provided from one or more on-site wells.
Another water use is the continued agricultural irrigation out of the Cline Top Ditch and Cline Top
No. 'l Ditch, however, no change in water rights are proposed for these historic uses.
ln addition, the pond will be used for livestock watering, fire protection, aesthetic and piscatorial
uses as well as augmentation for domestic use. lt will be filled and refilled from a surface diversion
out of Main Elk Creek.

The domestic uses from the well(s) are presented in Table 1, Water Requirements. They are based
on inside uses equal to 350 gallons per day (gpd) per single family home, 262.5 gpd for the guest
house and stockwater use at 1 1 gpd per head.
Lawn irrigation requirements- were calculated using the Blaney-Criddle methodology with
temperature and precipitation data from the Glenwood Springs weather station. The Blaney-Criddle
calculations are included in Appendix A.
Pond evaporation was calculated using the NOAA Atlas for evaporation in the Western United
States and precipitation data for the Glenwood Springs weather station. The State Engineer's
method was used to calculate and distribute the evaporation amount. A copy of the calculations
are included in Appendix B.
The total water demand based on the assumptions described above is 2.47 acre feet per year
(AFY). Consumptive use is 1.18 AFY.
NEW WATER RIGHTS
The proposed three lot subdivision will require several new water rights to meet the water demand.
Up to three underground water rights (wells), a storage right for the pond and a surface water right
to fill the pond will be needed. Following is the information for these proposed water rights.
Hubbell Well No. 1 (Permit No. 177757)
Location: The NE7+ NE%, Section 35, Township 4 South, Range 91 West, 6th P.M. at a point 875
feet from the North line and 360 feet from the East line of said Section 35.

Hubbell Ditch And Pipeline
Location: The headgate is on the west bank of Main Elk Creek in the NE7+ NEI/c, Section 35,
Township 4 South, Range g1 West, 6th P.M. at a point 65O feet from the North line and 25O feet
from the East line of said Section 35.
Source: Main Elk Creek tributary to the Colorado River.
Aoprooriation: October 3, 1997 by location of diversion point in the field and formation of intent
to put to beneficial use.
Amount: 0.25 cfs, conditional
Use: Domestic, irrigation, stockwater, piscatorial, aesthetic and fire protection by filling and refilling
Hubbell Pond. Uses are associated with up to three single family homes including 3,OOO square
feet of lawn irrigation and watering of 1O head of livestock.
All structures are located on lands owned by the Hubbells, specifically Lot 3, Rigoli Subdivision and
all uses will be thereon.

EXISTING WATER RIGHTS
The Hubbells claim a partial ownership in the Cline Top Ditch No. 1 and Cline Top Ditch water
rights. The Cline Top Ditch No. 1 diverts from the east bank of Main Elk Creek and serves some
lands on the subject parcel east of the creek. No change is needed for the ditch or associated
water rights.
The Cline Top Ditch diverts from Main Elk Creek about one mile upstream from the property and
is the primary source of agricultural water for the land. Hubbell's ownership in the water rights are
described in the Bill of Sale from Jimmie J. Rigoli and Betty E. Rigoli as "an undivided 2/3 interest
of sellers 1/3 interest in the Cline Top Ditch No. 37A; and particularly priority Nos.49A, October
1, 1885 and 22A8, March 4, 1921." A copy of the Bill of Sale is included in Appendix C.
A summary of the water rights decree information and the Hubbell's ownbrship amounts are shown
in the following table.

HISTORIC USE
The Cline Top Ditch is used to irrigate approximately 12 acres on the Hubbell parcel. The ratio of
water right to historic irrigated area is 0.039 cfs/acre for priority 49A and O.O99 cfs/acre for
priority 2208.

Diversion records maintained by the Division 5 Office of State Engineer shows that the ditch
typically carries water from May through October. A copy of the SEO diversion record summary
is included in Appendix D. Even in the critically low flow years 1954 and '1977, the ditch carried
water.
Average monthly diversions for the period 1950 through 1994 are listed in the following table.
Hubbell's ownership, (22.2o/ol is also shown.

This historic consumptive use of irrigation water on the Hubbell parcel is 'l .9O AFiAC (see Appendix
A) . The consumptive use associated with the permanent dry-up of Yz acre of historic irrigated land
is as follows:

The ratio of water right to irrigated area derived above, when appliedto % acre, yields an amount
of O.O195 cfs of priority 49A and 0.0495 cfs of priority 2208. This amount can be dedicated to
the plan for augmentation.

PLAN FOR AUGMENTATION
The new water rights to be used to meet the water demand of the proposed three lot subdivision
will be subject to an administrative "call" by downstream senior water rights including the Ware
and Hinds Ditch, Cameo call, and potentially the Colorado Water Conservation Board's instream
flow appropriation.
The proposed plan for augmentation will augment 1OO% of the depletions associated with
out-of-priority diversions at the junior wells. Historic consumptive use credit associated with the
dry-up of O.50 acres under the senior Cline Top Ditch water rights and releases from Hubbell Pond
will offset depletions.
Some of the dry-up credits will be stored in the pond when otherwise not used to directly off-set
depletions. The pond will also be filled and refilled from Hubbell Ditch and Pipeline when in priority.
Table 4 shows the augmentation operation schedule.

Operation of the plan for augmentation will prevent any injury to senior water rights. Replacement
water is provided either by bypassing historic diversion at Cline Top Ditch associated with the
dry-up of 0.5 acres or by releases from Hubbell Pond. Cline Top Ditch is located upstream from
the junior water right points of diversion and Hubbell Pond is at the same location as the wells.
