That proper publication, public notice and posting was provided as required by law for the hearings before the Planning Commission and Board of County Commissioners. 2. That the hearings before the Planning Commission and Board of Courty Commissioners were extensive aud conrplete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearings. 3. That the Garfield Courty Plaruring Commission recornmended approval of the prelinilary Plan. ) )ss ) t |ryry !,ll| llli [#J I llf u|L Ix ll,llr ru | lI l[IlLU I 2 ot 4 R 0.o0 a o,oo onnrir[o- bdlnry co 4' That the proposed subdivision of land is in compliance with the recommendations set forthin the comprehensive plan for the unincorpor*"J u."u of the county. 5' That all dat1,-surveys, analyses, studies, plans and designs as required by the state ofColorado and Garfield county have been sttmitt"d, reviewed, and found to meet all soundplanning and engineering requirements of the Garireld county Subdivision Regulations. 6' That the proposed subdivision of land conforms to the Garfield county zoningResolution. 7 ' That for the above-stated and other reasons, the proposed subdivision is in the best interestof the health, safety, morals, convenience,'orde., p'rorp.rity and welfare of the citize,s ofGarfield County. 1' All representations of the applicant, either within the application or stated at the publichearings before the Planning Commission shall be considered conditions of approval unlessotherwise stated by the planning Commission. 2' A Final Plat shall be submitted, indicating the legal description of the property, dimensionand area of the proposed lots, access to a public .ight-of-*ry, urJu.ry iropor.a easementsfor setbacks, water supply, drainage, irrijation Ji,Zn.r, access, utilities, etc. :'3' The applicant shall prepare and submit a Subdivision Improvements Agreement addressingall on-site improvements, which shall be included within the final filt submittal. 4' That the applicant shall submit $200.00 in School site Acquisition Fees for the creation ofthe new parcel, prior to or at the time of authorization of the final plat. 5' That the folowing prat notes shail be incruded on the finar plat: "The minimum defensible space distance shall be 30 feet on level terrain, plus appropriatemodification to recognize the increased rate of fire spread at sloped sites. The methodologydescribed in "Determining Safety Zone Dimerrsions, wildfire Safety Guidelines for RuralHomeowners," (colorado State lorest Service) rt uti u. used to determine defensible spacerequirements for the required defensible space within building .rr.lop., in areas exceedingfive (5) percent grade.', "The individual lot owners shall be responsible for the control of noxious weeds.,, "Application for a building permit for each lot within the subdivision shall include a gradi,gand drainage plan consistent with the engineer's report submitted at preliminary plan,showing the physical improvements necessary to mitigate the 10o-year flood flow fi.orn the Now' TIIEREFORE, BE IT RESOLVED that the Preliminary plan of the clinetop Ranch i"ti,*lfrtff,,t}f,.3'lowing describecl unincorporut.J ur.u of Garfield county be approvea *itt, tt. lry fl L !!llr,r{l [| ulrry,|,l|r I uL ff I tl t[r[ | 3 of 4 R o.oo D o.oo annrriio- bouurv co drainage basin located west of the county road.,, 6' That the fural plat submiual include a copy of a computer disk of the plat data, formatted foruse on the County Assessor's CAD system. 1' That all proposed lots shall comply with the Garfield County ZonngResolution of 197g, asamended, and any building shall comply with the lgg4uniform Building Code, as adopted. 8' That. the following provisions be included in the protective covenants goveming thesubdivision: One (1) dog will be allowed for each residential unit within the subdivision and the dog shallbe required to be confined within the owner's property boundaries, with enforcementprovisions allowing for the removal of a dog from the *r, u, a final remedy in worst cases.This provision will only apply to subsequent property owners, as the aiplicants will beallowed to have a maximum of three (3) dogs, confined to the owner's property boundaries, No open hearth solid-fuel fireplaces will be allowed anywhere within an exemption. one(1) new solid-fuel buming stove as defined by C.R.S. 2s-l-4ot,et. seq., and the regulationspromulgated thereunder, will be allowed in any dwelling unit. All dwelling units will beallowed an unrestricted number of natural gas burning stives and appliancei - . All exterior lighting shall be the minimum amount necessary and that all exterior lighting bedirected inward, towards the interior of the subdivision, except that provision. -uy1, madeto allow for safety lighting that goes beyond the property boundaries. 9' The final plat documents shall include mitigation measures for the physical improvementsand management of the 100-year flood flow from the westerly arainage basin, consistentwith the colorado Geologic survey recommendations made in a May it, tggs letter. 10' The subdivision's intemal access shall terminate in a manner that provides adequate roomfor emergency vehicles to tumaround. 11' The applicable road impact fees shall be paid in accordance with Section 4:94 of theSubdivision Regulations. 12' A dty hydrant be installed in the pond and be included in the final plat design andsubdivision improvements agreement.
