HomeMy WebLinkAbout1.0 Application• • September 11, 1991 Garfield County Commissioners 109 8th Street Glenwood Springs, CO 81601 RE: Christeleit Subdivision Dear Commissioners, We would like to submit for your consideration our request for the following: 1) Number of lots - To change the number of lots in the Christeleit Subdivision from six to five. Lot F (39.511 acres) would be excluded. The re- maining total subdivision acreage would be 50.005 acres with five lots at 10.001 acres each. Standard subdivision lot sizes would also help in keeping the planned covenants uniform. Since Lot F is over 35 acres, it need not be included for us to keep it deeded separate. 2) Easement road - We would like to request a waiver in the regulations for the maximum road grade. This waiver would be for 450 feet over 10%, which is now in 12% maximum grade. The remainder of the road grade is well below maximum. This road has been in use for ten years and this section has not hindered local traffic. At our engineer's suggestion, we are making this request as he feels this is an ac- ceptable road grade on our easement road. Thank you for your attention these requests. Box 681 Glenwood Springs, CO 81602 RE: Christeleit Subdivision Final Plat Dear Peter and Linda: I've had the opportunity to review the materials that you submitted for Final Plan approval. The following comments are organized by the applicable condition of approval from the Preliminary Plan Resolution of Approval and the section of the Subdivision Regulations. Resolution 91-055 Condition #3 Condition #4 Condition #7 This condition requires the submittal of a Subdivision Improvements Agreement. The purpose of the Subdivision Improvements Agreement is to contractualize between the County and developer a financial assurance agreement to guarantee the completion of required improvements. Uncompleted work should be identified and detailed cost estimates for completion included. This condition requires the submittal of improvement plans for all proposed improvements including water, utilities and drainage structures. These plans should be stamped by your engineer and labelled "Approved for Construction." Nothing has been submitted to date on the Homeowner's Association. They are responsible for maintenance of all common facilities including roads as well as the water contract. 109 8TH STREET, SUITE 303 • 945-8212/625-5571/285-7972 • GLENWOOD SPRINGS, COLORADO 81601 Peter and Linda Christeleit Page 2 October 24, 1991 Condition #8 Payment for the School Impact Fees, to the tune of $1000 (5 lots @ $200 each), needs to be submitted prior to the approval of the preliminary plan. Condition #9 An access permit for the intersection of Heather Lane with County Road 119 will be required prior to approval of the Final Plat. Contact the Road and Bridge Department for this permit. Condition #10 In reviewing your road plans, I have noted the following discrepancies. The grade exceeds the maximum 10% allowable. At the intersection with the County road, the grade must be 1%. No cul-de-sac is shown on the plans. For the portions of the Broadway that have been constructed, stamped "as -built" plans are required. For the portions not constructed to date, stamped improvement plans are required. The plans that you have submitted to date would indicate that the bulk of the work has not been constructed to date. Condition #14 This condition requires the submittal of protective covenants. Specifically, the concern is to require the construction of a 1500 gallon water storage tank on each lot. Final Plat Section 5:24 (A) Requires the names and addresses of owners or record of surface and mineral estates, including mineral leasees, to be shown on the plat. (B) Requires total acreage of the subdivision, total number of lots within the subdivision and total acreage devoted to each use to be shown on the plat. (C) Requires verification from the County Treasurer that tax payments are current. (D) Requires submittal of protective covenants and restrictions. (H) Requires the submittal of School Impact Fees, as referenced in Condition #8. (I) Requires Management Plan for the I.S.D.S. units. I have submitted a copy of the letter of credit to the County Attorney for his review. When I receive his comments, if any, on this matter, I will forward them to you. Call if you have any questions. Smith Don DeFord Mildred Alsdorf Chuck Deschenes when the following proceedings, among RESOLUTION NO. 91-055 A RESOLUTION CONCERNED WITH THE APPROVAL OF A PRELIMINARY PLAN FOR THE CHRISTELEIT SUBDIVISION. WHEREAS, Peter and Linda Christeleit have filed an application with the Board of County Commissioners of Garfield County for approval of a Preliminary Plan for the Christeleit Subdivision. WHEREAS, based on the material submitted by the applicant and then comments of the Garfield County Planning Department, this Board finds as follows: 1. That proper publication, public notice and posting was provided as required by law for the hearings before the Planning Commission and Board of County Commissioners. 2. That the hearings before the Planning Commission and Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearings. 3. That the Garfield County Planning Commission recommended approval of the Preliminary Plan. 4. That the proposed subdivision of land is in compliance with the recommendations set forth in the Comprehensive Plan for the unincorporated area of the County. 5. That all data, surveys, analyses, studies, plans and designs as are required by the State of Colorado and Garfield County have been submitted, reviewed, and found to meet all sound planning and engineering requirements of the Garfield County Subdivision Regulations. 6. That the proposed subdivision of land conforms to the Garfield County Zoning Resolution. 7. All representations of the applicant, either within the application or stated at the Public Hearing before the Board of County Commissioners shall be considered conditions of approval, unless stated otherwise by the Board of County Commissioners. 2. The applicants shall establish a Homeowner's Association and shall be incorporated in accordance with the requirements of Colorado Revised Statutes. The Homeowner's Association shall be responsible for the Basalt Water Conservancy District water contract and for road maintenance. The articles of incorporation and restrictive covenants shall be reviewed by County Staff prior to the approval of the Final Plat. 3. The applicants shall prepare and submit a subdivision improvements agreement, addressing all on and off-site improvements, prior to the approval of the Final Plat. 4. The applicants shall submit improvement plans for all road, drainage and utility improvements prior to the approval of the Final Plat. 5. All utilities shall be placed underground. 6. All cut slopes created during construction shall be revegetated with native grasses using certified weed -free seed. 7. The applicant shall demonstrate that procedures are established for the maintenance of all roadways, including snow removal, through the Homeowner's Association, prior to the approval of the Final Plat. 8. The applicants shall pay $200 per lot in School Impact Fees prior to the approval of the Final Plat. 9. All required permits from the Road and Bridge Department shall be obtained prior to the approval of the Final Plat. 10. All roadways shall be designed and constructed in conformance with design standards set forth in the County Subdivision Regulations and in place at the time of submittal of the Final Plat. 11. The following plat notes shall be included on the Final Plat: A) U.S.F.S. and State Forestry wildfire prevention guidelines shall be incorporated into residential site planning and design. B) A site specific soils report shall be conducted for each residence prepared by a registered professional engineer. C) Engineered foundations and wastewater systems shall be required by the Building Official. D) This subdivision is not located within a fire protection district. E) Lot buyers shall enter into a pre -annexation agreement with the Carbondale Fire Department. 12. The plat shall depict those areas identified in the geology report as too steep for construction on the Final Plat. 13. Prior to the approval of the Final Plat, the applicants shall seed the property in permanent grasses or the property shall remain in cultivation until all lots are sold. • • r • �. auOK 806 PAGE 278 14. Prior to the approval of the Final Plat, the applicants shall establish covenants to insure the construction of a 1500 gallon water storage tank on each lot as an integral portion of the residence. Box 681 Glenwood Springs, CO 81602 RE: Lot Reduction and Road Grade Waiver Request Dear Peter and Linda: At their meeting on Monday, September 16, the Board of County Commissioners approved your request for a reduction in the number of lots from six (6) to five (5). This change should be reflected on your Final Plat and in your Subdivision Improvements Agreement. In regards to your request for a waiver from the 10% maximum grade requirement, the regulations do not provide for any waiver of this regulation. A preliminary draft version of the new road standards included a waiver provision. However, this provision was not included in the final draft version. One party, who is currently processing a subdivision application, has requested that the Commissioners initiate a change to this standard allowing a waiver up to 12%. Box Glenwood Springs, CO 81602 RE: Revised Road Standards Dear Peter and Linda: Enclosed is a copy of staff comments detailing changes in the Subdivision Regulations regarding road standards. Sections 9:34 through 9:36, as identified in the enclosed, were adopted by the Board of County Commissioners at their August 19, 1991 meeting. A formal Resolution authorizing these amendments will be adopted in the near future. I will forward a copy of the resolution to you upon signature by the Board. Regardless of the presence of the Resolution, these new regulations are now in effect. Since your approved preliminary plan consists of six (6) lots, you would be subject to those standards identified in the "semi -primitive" category. This category would require an engineer to design the road platform and drainage features. Mark Bean and I discussed your question of whether a decrease in density (five lots instead of six lots) would warrant a new set of public hearings on the revised preliminary plan. He and I concurred that with a decrease in density, and assumably a decrease in impact on adjacent lands, that new hearings would not be required. We both felt that the most prudent way to precede would be to write a letter to the Commissioners requesting the decrease in density be allowed without further consideration at the preliminary plan stage.
