WILDLIFE HABITATION
This property is not considered to be critical habitat
for muledeer or elk in this area. Although they are in this
region, the snow is usually too deep for winter feed range.
Due to the nearby roads and homes, elk are normally only seen
to the south and southwest where there is more cover. Deer
are seen more spring to fall. There are no water ponds or
springs on the property that would benefit wildlife. Since
this property has been under agricultural use, it is grazed
by cattle after the fall harvest reducing fall and winter
wildlife forage. (4.6 of the 89 acres are cultivated)

ORDER GRANTING APPLICATION FOR ALLOTMENT CONTRACT
40 CHRISTELEIT SUBDIVISION HOMEOWNER'S ASSOCIATION
Application having been made by or on behalf of Christeleit Subdivision Homeowner's
• Association and all parties interested in the foregoing Water Allotment Contract and hearing on
said Application having been duly held, it is hereby ordered that said Application be granted and
that the foregoing Water Allotment Contract for 90 cubic feet per second of water from the
District's direct flow rights and 3.7 acre feet of water per year of storage water owned or
controlled by the District is hereby approved and executed by and on behalf of the Basalt Water
Conservancy District, for the beneficial use of the water allotted in the foregoing Contract, upon
the terms, conditions and manner of payment as therein specified and subject to the following
• specific conditions:
1. The Applicant shall provide the District proof that it is a homeowner's association
incorporated as a non-profit corporation under the laws of the State of Colorado or such other
entity as is acceptable to the district which shall be responsible for the on going payment
of charges due under the approved Contract following subdivision of the property described in
the Application on file with the District and the Applicant shall give notice to purchasers of all
or any part of the subject property of the obligation of this Contract, and shall record such notice
in the records of the Clerk and Recorder of Garfield County, Colorado. Applicant and his
successors and assigns shall comply with all rules and regulations now existing or hereafter
adopted by the District to enforce payment of charges due under the approved Contract by present
and future owners of all or any part of the real property served under the Contract.

2. The Applicant shall provide the District proof that the proposed land use of the
land to be benefited by the water allotted hereunder has been approved by the applicable govern-
mental authorities having jurisdiction over such land use, including evidence satisfactory to the
District that each lot or parcel to be benefitted hereunder is legally subdivided.
3. The applicant has acknowledged that the land to be benefited by the foregoing and
attached Contract is described as follows:

BASALT WATER CONSERVANCY DISTRICT
• WATER ALLOTMENT CONTRACT
Pursuant to C.R.S. 1973, 37-45-131)
The Applicant, Christeleit Subdivision Homeowner's Association, has applied to the Basalt
Water Conservancy District (hereinafter the "District"), a political subdivision of the State of
Colorado, organized pursuant to and existing by virtue of Colorado Revised Statutes, 1973, 37-
45-101, et seq., for an allotment Contract for beneficial use of water rights owned, leased, or
hereafter acquired by the District. By execution of this Contract, Applicant hereby agrees to the
following terms and conditions:
1. OUANTITY: In consideration of the covenants and conditions herein contained,
Applicant shall be entitled to receive and apply to beneficial use 90 cubic feet of water per second
from the District direct flow rights and 3.7 acre feet per year of storage water owned or
controlled by the District.
2. SOURCE OF ALLOTTED WATER: Water rights allotted pursuant to this
Contract shall be from the District's water rights decreed to the Basalt Conduit, Landis Canal,
Stockman's Ditch Extension or other decrees or water rights hereafter acquired by the District,
including the District's contractual right to receive storage water from Ruedi Reservoir. The
District shall have the right to designate the water right or Decree of the District from which the
• Applicant's allotted rights shall be obtained. The Applicant's use of any of the District's water
rights shall be subject to any and all terms and conditions imposed by the Water Court on the use
of the District's said rights. Exchange releases made from the District's storage rights in Ruedi
Reservoir or other works and facilities of the District shall be delivered to the Applicant at the
outlet works of said storage facility and release of water at such outlet works shall constitute full
performance of the District's delivery obligation. Delivery of water from the District's storage
rights in Ruedi Reservoir shall be subject to the District's lease Contract with the United States
Bureau of Reclamation and any rules and regulations promulgated pursuant thereto.
3. PURPOSE AND LOCATION OF USE: Applicant will use the waters herein
granted for beneficial purposes limited to the augmentation of existing and future wells and other
• water sources, within or through facilities or upon lands owned, operated or served by Applicant,
which lands are more fully described on Exhibit "A" attached hereto; provided that the location
and purpose of Applicant's use of said water shall be legally recognized and permitted by the
applicable governmental authority having jurisdiction over the property served. Applicant's
contemplated usage for the water allotted hereunder is for the following use or uses:

• Applicant acknowledges that usage of the District's water rights as herein contemplated
shall be in lieu of or supplemental to Applicant obtaining or adjudicating, on its own, the right
to use certain waters. It is acknowledged that certain locations within the District may not be
susceptible to service solely by the District's water rights allotted hereunder or the District's said
water rights may not satisfy Applicant's needs and purposes. To the extent that service cannot
be achieved by use of the District's allotted water rights, or in the event said service is
inadequate, Applicant may, utilize such other water rights, by way of supplementing the
411 District's water rights, or otherwise, as is necessary to assure water service sufficiently reliable
for Applicant's intended purpose or purposes. All lands, facilities and areas served by water
rights allotted hereunder shall be situated within the boundaries of the District. The District
reserves the exclusive right to review and approve any conditions which may be attached to
judicial approval of Applicant's use of the District's water rights allotted hereunder. Applicant
agrees to defray any out-of-pocket expenses incurred by the District in connection with the allot-
ment of water rights hereunder, including, but not limited to, reimbursement of legal and
• engineering costs incurred in connection with any water rights adjudication necessary to allow
Applicant's use of such allotted water rights; provided, however, in the event any such
adjudication involves more of the District's water rights than are allotted pursuant to this
Contract, Applicant shall bear only a pro -rata portion of such expenses. Applicant shall be solely
responsible for providing works and facilities, if any, necessary to utilize the District's water
rights allotted hereunder for Applicant's beneficial use.
Water service provided by the District shall be limited to the amount of water available
in priority at the original point of diversion of the District's applicable water right and neither
the District, nor those entitled to utilize the District's decrees, may call on any greater amount
at new or alternate points of diversion. The District shall request the Colorado State Engineer
• to estimate any conveyance losses between the original point and any alternate point and such
estimate shall be deducted from this amount in each case. The District, or anyone using the
District's decrees, may call on any additional sources of supply that may be available at an
alternate point of diversion, but not at the original point of diversion, only as against water rights
which are junior to the date of application for the alternate point of diversion.
In the event the Applicant intends to develop an augmentation plan and institute legal
proceedings for the approval of such augmentation plan to allow the Applicant to utilize the
water allotted to Applicant hereunder, the Applicant shall give the District written notice of such
intent. In the event the Applicant develops and adjudicates an augmentation plan to utilize the
water allotted hereunder, Applicant shall not be obligated to bear or defray any legal or
• engineering expense of the District incurred by the District for the purpose of developing and
adjudicating a plan of augmentation for the District. In any event, the District shall have the
right to approve the Applicant's augmentation plan and the Applicant shall provide the District
copies of such plan and of all pleadings and other papers filed with the Water Court in the
adjudication thereof.
4. PAYMENT: Applicant shall pay annually for the water service described herein
• at a price to be fixed annually by the Board of Directors of the District for such service. The
initial annual payment shall be made, in full, within 15 days after the date of a notice from the
District that the initial payment is due. Said notice will advise the Applicant, among other

things, of the water delivery year to which the payment shall apply and the price which is
applicable to that year. Annual payments for each year thereafter shall be made by the Applicant
on or before each March 1. If an annual payment is not made by the due date, written notice
thereof will be sent by the District to the Applicant at Applicant's address set forth below. If
payment is not made within ten (10) days after said written notice, the District may, at its option,
411 elect to terminate all of the Applicants right, title, or interest under this Contract, in which event
the water right allotted hereunder may be transferred, leased or otherwise disposed of by the
District at the discretion of its Board of Directors.

In the event water deliveries hereunder are made by or pursuant to agreement with some
other person, corporation, quasi -municipal entity, or governmental entity, and in the event the
Applicant fails to make payments as required hereunder, the District may, at its sole option and
request, authorize said person or entity to curtail the Applicant's water service pursuant to this
Contract, and in such event neither the District nor such persons or entity shall be liable for such
curtailment.
5. APPROPRIATION OF FUNDS: The Applicant agrees that so long as this
Contract is valid and in force, Applicant will budget and appropriate from such sources of
revenues as may be legally available to the Applicant the funds necessary to make the annual
payments in advance of water delivery pursuant to this Contract. The Applicant will hold
harmless the District and any person or entity involved in the delivery of water pursuant to this
Contract, for discontinuance in service due to the failure of Applicant to maintain the payments
herein required on a current basis.
6. BENEFIT OF CONTRACT: The water right allotted hereunder shall be
beneficially used for the purposes and in the manner specified herein and this Contract is for the
exclusive benefit of the Applicant and shall not inure to the benefit of any successor, assign, or
lessee of said Applicant without the prior written approval of the Board of Directors of the
District.
In the event the water right allotted hereunder is to be used for the benefit of land which
is now or will hereafter be subdivided or otherwise held or owned in separate ownership interest
by two (2) or more uses of the water right allotted hereunder, the Applicant may assign the
Applicant's rights hereunder only to a homeowners association, water district, water and
sanitation district or other special district properly organized and existing under and by virtue of
the laws of the State of Colorado and then only if such association or special district establishes
to the satisfaction of the Basalt Water Conservancy District that it has the ability and authority
to assure its performance of the Applicant's obligations under this Contract. In no event shall
the owner of a portion, but less than all, of the Applicant's property to be served under this
Contract, have any rights hereunder, except as such rights may exist through a homeowners
association or special district as above provided. Any assignment of the Applicant's rights under
• this Contract shall be subject to and must comply with such requirements as the District may
hereafter adopt regarding assignment of Contract rights and the assumption of Contract
obligations by assignees and successors, provided that such requirements shall uniformly apply

to all allottees receiving District service. The restrictions on assignment as herein contained shall
not preclude the District from holding the Applicant, or any successor to the Applicant,
responsible for the performance of all or any part of the Applicant's covenants and agreements
herein contained.
• 7. OTHER RULES: Applicant's rights under this Contract shall be subject to the
Water Service Plan as adopted by the District and amended from time to time; provided that such
Water Service Plan shall apply uniformly throughout the District among water users receiving
the same service from the District. Applicant shall also be bound by the provisions of the Water
Conservancy Act of the State of Colorado, the Rules and Regulations of the Board of Directors
of the District, the plumbing advisory, water conservation, and staged curtailment regulations,
if any, applicable within the County in which the water allotted hereunder is to be used, together
with all amendments of and supplements to any of the foregoing.
8. CURTAILMENT OF USE: The water service provided hereunder is expressly
subject to the provisions of that certain Stipulation in Case No. 80 CW 253 on file in the District
Court in Water Division No. 5 of the State of Colorado, which Stipulation provides, in part, for
the possible curtailment of out -of -house municipal and domestic water demands upon the
occurrence of certain events and upon the District giving notice of such curtailment, all as more
fully set forth in said Stipulation.
9. OPERATION AND MAINTENANCE AGREEMENT: Applicant shall enter into
an "Operation and Maintenance Agreement" with the District if and when the Board of Directors
finds and determines that such an agreement is required by reason of additional or special services
requested by the Applicant and provided by the District or by reason of the delivery or use of
water by the Applicant for more than one of the classes of service which are defined in the Rules
and Regulations of the Board of Directors of said District. Said agreement may contain, but not
be limited to, provision for water delivery at times or by means not provided within the terms
of standard allotment contracts of the District and additional annual monetary consideration for
extension of District services and for additional administration, operation and maintenance costs,
or for other costs to the District which may arise through services made available to the
Applicant.
•10. CHANGE OF USE: The District reserves the exclusive right to review and
approve or disapprove any proposed change in use of the water right allotted hereunder. Any
use other than that set forth herein or any lease or sale of the water or water rights allotted
hereunder without the prior written approval of the District shall be deemed to be a material
breach of this Contract.
11. PRIOR RESOLUTION: The water service provided hereunder is expressly subject
to that certain Resolution passed by the Board of Directors of the District on September 25, 1979,
and all amendments thereto, as the same exists upon the date of this application and allotment
Contract.
12. NO FEE TITLE: It is understood and agreed that nothing herein shall give the
III Applicant any equitable or legal fee title interest or ownership in or to any of the water or water
rights of the District, but that Applicant is entitled to the right to use the water right allotted
hereunder, subject to the limitations, obligations and conditions of this Contract.
• 13. CONSERVATION PRACTICES: Applicant shall implement and use commonly
accepted conservation practices with respect to the water and water rights allotted hereunder and
shall be bound by any conservation plan hereafter adopted by the District, as the same may be
amended from time to time.

On September 7, 1990, High Country Engineering, Inc. personnel
conducted percolation tests at two sites on the subject property
(see enclosed vicinity map). At the "higher elevation" location,
the average percolation rate was 18 minutes per inch. At the
"lower elevation" location, the average percolation rate was 33
minutes per inch. Both of these rates are within the normally
accepted range of 5 minutes per inch to 60 minutes per inch.

Dear Mr. Christeleit:
You have asked us to comment on the water supply and wastewater
disposal for your proposed subdivision. The following information
summarizes the proposed improvements.
Water Supply
Water for the subdivision is proposed to be provided by individual
wells located on each lot. The geologic report for this project,
prepared by Nicholas Lampiris, Ph.D., states "Water will need to
be obtained through the drilling of a well, . . . with a projected
depth of about 180 to 300 feet, although it could be less." A
copy of the referenced geological report is included with this
submittal. Thus, it appears that water is expected to be
available at a reasonable depth.
Information was also obtained on existing wells in the vicinity of
the project. Those wells close to the project for which we were
given depth and yield information are listed below:
• 1.. SE1/4 of the SE1/4 of Pection 24, total depth - 135 feet,
static water. level 90 feet, 15 gpm.
2. NW1/4 of the SW1/4 of Section 29, 15 gpm, reportedly quite
shallow, no total depth available.
The Applicant filed an Application for Purchase of Waters from the
West Divide Conservancy District to augment the water to be
withdrawn from the wells. Subsequently, the application was
• granted, and a copy of the Order Granting Application is enclosed
with this submittal.

Wastewater Disposal
Sewage disposal will be by individual on-site septic tanks and
leach fields. The average daily volume of sewage from each
homesite is estimated to be 260 gallons per day. The sewage
strength is expected to be consistent with that of normal domestic
wastewater. Sizing of individual septic systems will be in
accordance with Garfield County Individual Sewage Disposal System
Regulations.
Percolation tests were conducted at two locations within the
project area. Further information on the percolation tests is
contained in the HCE report dated February 5, 1991, a copy of
which is included with this application. All of the percolation
tests conducted demonstrated acceptable percolation rates. If
individual disposal systems are constructed in accordance with
County standards, no adverse impacts are anticipated.
Responsibility for construction, operation and maintenance of
individual disposal systems will rest with the individual lot
owners, who should maintain the systems in accordance with
Garfield County Health Department Regulations. Should the welfare
of adjacent homeowners be affected by failure of an individual
owner to properly maintain a septic system, the Homeowner's
Association will have the authority to enforce maintenance of the
individual system.

dominantly from basalt. Elevation is 6,800 to 8,000 feet. The average
annual precipitation is 14 to 16 inches, the average annual air temperature
is 42 to 44 degrees F, and the average frost -free period is 85 to 95 days.
Typically, the surface layer is brown loam 7 inches thick. The upper 12
inches of the subsoil is clay loam. The lower 4 inches is loam. The
substratum to a depth of 60 inches or more is loam. The soil is
noncalcareous and--rnfldiy-alka ± re to a depth of 19 inches, arad-ealeareous-and
-moderately-alkaitrrr-below that depth.
Included in this unit are small areas of Tridell and Showalter soils.
Included areas make up about 15 percent of the total acreage.
Permeability of the Norval soil is moderate. Available water capacity
is moderate. Effective rooting depth is 60 inches or more. Runoff is
medium, and the hazard of water erosion is moderate.
This unit is used for rangeland.
The potential plant community on this unit is mainly needleandthread,
western wheatgrass, nuttongrass, prairie junegrass, and big sagebush. Other
less extensive grasses that characterize this unit are bluebunch wheatgrass
and mountain muhly. The average annual production of air-dry vegetation is
about 1,500 pounds per acre. If the condition of the range deteriorates,
cheatgrass and Kentucky bluegrass increase.

is used for moderate development, the main limitations are shrink -swell

frost -free period is 80 to 90 days.
This unit is 45 percent Showalter very stony loam and 35 percent Norval
loam. The components of this unit are so intricately inteLmingled that it
was not practical to map then separately at the scale used. The Showalter
soils occupy convex parts of the landscape, and rbrval soils are in more
concave positons.
Included in this unit are small areas of soils similar to this RRrval
soil which have 30 to 50 percent cobble in the substratum. Included areas
make up about 20 percent of the total acreage.

pounds per acre. The potential plant community on the Fhrval soil is mainly
needleandthread, western wheatgrass, muttongrass, praire junegrass, and big
sagebrush. The average annual production of air-dry vegetation is about
1,500 pounds per acre.
If this unit is used for rangeland seeding or mechanical treatment, the
410 main limitation is stones on the surface of the Showalter component.
Management practices suitable for use on this soil are proper range use,
deferred grazing, rotation grazing, and aerial spraying for brush
management.
If this unit is used for hay and pasture, the main limitations are
stones on the surface, steep slopes, and slow permeability of the Showalter
soil. Grasses and legumes grow well if adequate fertilizer is used.
4111 This unit is very poorly suited to homesite development. The main
limitations are slope, shrink -swell, and stones throughout the profile.
This map unit is in capability subclass VIe, nonirrigated. The
Showalter soil is in Loamy Slopes range site, and the Norval soil is in Deep

4110 19--Cochetopa-Antrobus association, 25 to 50 percent slope. This
map unit is on mountainsides. Elevation is 8,500 to 10,500 feet. The
4111 average annual precipitation is 18 to 20 inches, the average annual air
temperature is 36 to 38 degrees F, and the average frost -free period is 45
to 60 days.
This unit is 45 percent Cochetopa loam and 40 percent Antrobus very
4110 stony loam. The Cnrhetopa soil is on slightly concave benches, and the
Antrobus soil is on steeper convex slopes. The components of this unit are
so intricatedly intermingled that it was not practical to map them
separately at the scale used.
Included in this unit are small areas of Forsey and Jerry soils.
Included areas make up about 15 percent of the total acreage.
The Cochetopa soil is deep and well drained. It formed in alluvium and

Typically, the surface is covered with 12 to 15 percent stones and 25
percent cobble. The upper part of the surface layer is dark grayish brown
very stony loam about 8 inches thick. The lower part is brown very stony
loam about 5 inches thick. The underlying materialto a depth of 60 inches
or more is extremely stony loam. The soil is calcareous throughout the
profile.
Permeabilty of the Antrobus soil is moderate. Available water capacity
is low. Effective rooting depth is 60 inches or more. Runoff is rapid, and
the hazard of water erosion is moderate.
This unit is used for rangeland and homesite development.
The potential plant community on the Cochetopa soil is mainly Thurber
fescue, bearded wheatgrass, Columbia needlegrass, mountain brome, and Idaho
fescue. Western wheatgrass, mountain snowberry, geranium, and western
yarrow are also present in the potential plant community. The average
annual production of air—dry vegetation is about 2,800 pounds per acre. If
the range condition deteriorates, Kentucky bluegrass, geranium, Douglas
rabbitbrush and western yarrow increase.
The potential plant community on the Antrobus soil is mainly bluebunch
wheatgrass, needlegrass, antelope bitterbrush, mountain big sagebrush, and
Saskatoon serviceberry. Other less numerous plants that characterize this
site are Douglas rabbitbrush, bluebunch wheatgrass, and antelope
bitterbrush. Included in this unit are small areas of Aspen. The average
annual production of air—dry vegetation is about 1,200 pounds per acre.
If the range condition deteriorates, mountain big sagebrush, Douglas
rabbitbrush, needlegrasses, and annual weeds increase.

management. Slope limits access by livestock and results in overgrazing of
the less sloping areas.
If this unit is used for homesite development, the main limitations are
slope, shrink -swell, stoniness, and steep slopes. Access roads must be
designed to provide adequate cut -slope grade, and drains must be used to
control surface runoff and keep soil losses to a minimum. The high content
of rock fragments makes excavation difficult.
This map unit is in capability subclass VIIe, nonirrigated. The
Cochetopa soil is in Subalpine Loam range site and the Antrobus soil is in
Stony Loam range site.

35--Empedrado loam, 6 to 12 percent slopes. This deep, well drained
soil is on terrace fans, anq,litis. It formed in alluvium and eolian
4111 materials. Elevation is 6,500 to 9,000 feet. The average annual
precipitation is about 15 to 18 inches, the average annual air temperature
is 40 to 44 degrees F, and the average frost -free season is 75 to 95 days.
Typically, the surface layer is brown loam 5 inches thick. The subsoil
4110 is clay loam about 35 inches thick. The substratum to a depth of 60 inches
is clay loam. The soil is noncalcareous to a depth of 38 inches and
calcareous below that depth.
Included in this unit are small areas of similar soils with darker,
thicker surface layers. Also included are small areas of similar soils with
silt loam and silty clay loam textures throughout the profiles. Included
areas make up about 20 percent of the total acreage.
Permeability of the Empedrado soil is moderate. Available water
capacity is high. Effective rooting depth is 60 inches or more. Runoff is
medium, and the hazard of water erosion is moderate.
This unit is used for hayland and cropland.
This unit is well suited to hay and pasture. Grasses and legumes grow
well if adequate fertilizer is used. If properly managed, this unit can
411/ produce 4 tons of irrigated grass hay per acre.

This unit is well suited to alfalfa and small grain crops. It is
limited mainly by steeper slopes in some areas. Limiting tillage for
seedbed preparation and weed control reduces runoff and erosion. All
tillage should be on the contour or across the slope. If properly managed,
this unit can produce 75 bushels of barley per acre.
The potential plant community on this unit is mainly western wheatgrass,
410 needleandthread, prairie junegrass, mountain big sagebrush, and Douglas
rabbitbrush.
4110 Other less numerous plants that characterize this site are muttongrass,
Letterman needlegrass, common snowberry, Utah serviceberry, and antelope
bitterbrush. The average annual production of air-dry vegetation is about
1,500 pounds per acre. If the range condition deteriorates, mountain big
sagebrush, Kentucky bluegrass, Douglas rabbitbrush, and annual weeds
increase. These plants are dominant when the range is in poor condition;
therefore, grazing should be managed so that the desired balance of species
is maintained in the plant community.
This map unit is suited to hccnesite development. The main limitations
are shrink -swell potential and slope. Shrink -swell potential can be
minimized by prewetting foundation areas. The steepness of slope is a
concern in installing septic tank absorption fields. Absorption lines
should be installed on the contour.
This map unit is in capability subclass IVe, irrigated, and IVe,
nonirrigated. It is in the Deep Loam range site.

The Tridell soil isssomewhat excessively drained. It formed in
alluvium and colluvium derived dominantly from basalt. Slope is 12 to 50
percent. Typically, the upper part of the surface layer is grayish brown
nro4era4-1- stony sandy loam about 2 inches thick. The lower part is very
cobbly fine sandy loam about 7 inches thick. The upper 5 inches of the
underlying material is very cobbly fine sandy loam. The next 11 inches is
cobbly sandy loam. The next 12 inches is very stony fine sandy loam. The
lower part to a depth of 60 inches is very stony loamy sand.
Permeability of the Tridell soil is moderately rapid. Available water
capacity is low. Effective rooting depth is 60 inches or more. Runoff is
rapid, and the hazard of water erosion is high.
This unit is used for rangeland and firewood production.
The potential plant community on the Morval soil is mainly
needleandthread, western wheatgrass, muttongrass, prairie junegrass, and big
sagebrush. The average annual production of air—dry vegetation is about
1,500 pounds per acre. The potential plant community on the Tridell soil is
mainly Utah juniper, pinyon pine, galleta, bluebunch wheatgrass, and
bottlebrush squirreltail. The potential production of the native understory
vegetation in normal years is about 400 pounds of air—dry vegetation per
acre.
Mechanical treatment is not practical, because the surface is stony
and slopes are steep. Management practices suitable for use on this unit
are proper range use, deferred grazing, rotation grazing, and aerial
spraying for brush management. Slope limits access by livestock and results
in overgrazing of the .less sloping areas.

Gentlemen:
I have reviewed the history of the 60 foot road access and
utility easement for the property owned by Peter J. Christeleit
and Linda L. Christeleit which property is described in the
Warranty Deed recorded in Book 555 at Page 67 a copy of which is
attached hereto and marked Exhibit A.
The easement was established at the time of the transfer in
the above described Deed being 30 feet off of the adjoining
property to the west owned by William George Ould and 30 feet off
of the property transferred to the Christeleits. An agreement
was entered into by the Christeleits and Mr. Ould, a copy of
which is attached hereto marked Exhibit B for the construction,
maintenance and upkeep of said easement. Paragraph 2 of the
agreement states that the easement is for road access and utility
purposes in connection with properties owned by them and served
by said easement.
The property to the west that was then owned by Mr. Ould and
served by the easement was thereafter split into additional
separate parcels of land with said parcels using the easement
road. Mr. Ould also granted in Book 595 at Page 25 a right to
use said easement for the Kindall property.
It therefore seems clear to me that when one reviews how the
easement was established jointly out of the Christeleit property
and the Ould property and the language of the easement agreement
indicating it was for the benefit of their properties and that
the use has already been expanded to additional parcels on the
Ould and Kindall property that the proposed subdivision of the
Christeleit property and use by those parcels is a permitted
expansion of the use of the easement.

Resource Engineering, Inc. provides engineering services to the Basalt Water
Conservancy District and administers their Ruedi Reservoir water allotment program.
In this capacity we are familiar with the Christeleit Subdivision.
The Christeleit Subdivision Homeowner's Association has obtained a water allotment
contract for 3.7 acre feet of water from Ruedi Reservoir from the District. This
amount of water is adequate to meet the needs of six residences, each with 6,000
square feet of lawns and gardens and up to five horses.
The Christeleit Subdivision is located in Area "A" of the Basalt Water Conservancy
District. Area "A" is defined as that area that can generally be served by replacement
water from Ruedi Reservoir without causing injury to vested water rights that lie
between the proposed point of use and the Roaring Fork River. On this basis it is
highly probable that wells for the individual lots can be obtained. However, ultimate
responsibility for issuance of well permits is vested in the Colorado Division of Water
Resources and they have the authority to grant, or deny well permits subject to their
promulgated rules and regulations.

Gentlemen:
This letter is to clarify our intentions for the Christeleit
Subdivision Homeowner's Association. We consulted our attorney
at the time we contracted with the Basalt Water Conservancy
District, and it was recommended to us to form the Homeowner°s
Association at the time the subdivision is approved.
The Homeowner's Association will be responsible for the
Basalt Water Conservancy District contract and for road maintenance.
Subdivision restrictive covenants will also be drawn up at the
same time.
Prior to the approval of the Final Plat, the articles of
incorporation and the restrictive covenants will be availabe for
review by the County staff.

I will be out of town during the consideration of the preliminary
plan for the Christeleit Subdivision on June 3, 1991 and,
therefore, am reducing to writing my thoughts concerning the
potential approval of the Christeleit Subdivision. I believe most
of the following is well known to you and the Board of County
Commissioners.
Red Canyon Road has been a safety concern and a matter of
discussion by myself, the Planning Department and the Road & Bridge
Department since I first came to Garfield County. I am aware that
there is an existing resolution stating that no further subdivision
shall be approved that would add traffic impact to the Red Canyon
Road. Clearly, the Christeleit Subdivision will add traffic impact
to the Red Canyon Road, accessing that county right-of-way at the
top of its most dangerous section. Previously, I have told the
Board that it is my recommendation that this road be closed. That
remains my recommendation. However, it does not seem prudent or
appropriate that the Board should not only fail to close the road
but add hazards to that road by approving a subdivision that will
directly impact its dangerous portions. In regard to such safety
hazards, I am aware that during the course of the last year, we
have had at least one accident along this road, to which the
Glenwood Springs Ambulance Service has failed to respond on a 911
call, because of the hazards presented in this area. Additionally,
in the past, we have had extreme difficulty maintaining this road
in the winter, to the extent that equipment operators in the County
Road & Bridge Department have refused to operate snow removal
equipment for fear of injury or death along this road. Clearly,
if this road cannot be maintained in the winter, that must be a
consideration of the Board in approving a potential subdivision.

As all are aware, a previous Board of County Commissioners had
taken the position that this road is too hazardous to sustain
substantial additional impacts. The existing and somewhat dated
resolution stating the policy of this Board must be reviewed as
part of the consideration of the Christeleit Subdivision. That
resolution, as a matter of policy, states that no further
subdivisions will be approved that will impact this portion of the
road. It would be totally inconsistent for this Board to approve
the Christeleit Subdivision knowing of the existence of this
resolution. Therefore, if the Board is inclined to approve the
Christeleit Subdivision, it is my recommendation that the Board
simultaneously repeal the existing resolution that would prohibit
the approval of such subdivisions.
Finally, I must emphasize that through the foregoing, I am not
stating that the County has a risk of liability concerning the Red
Canyon Road. Under current law, Garfield County is totally immune
from claims for liability for personal injury resulting from the
dangerous condition of its roads. Therefore, no matter what the
extent of hazard presented by Red Canyon Road, it does not appear
that the County would be liable at law for a claim for injury along
this road.
