JUN 1 8 1991 ''iILDRCD 4LSDJ;<F, COUNTY CLE7K c 11244G9 STATE OF COLORADO )ss County of Garfield BOOK 806 ME r At a reqular meeting of the Board of County Commissioners for Garfield County, Colorado, held in the Commissioners' Meeting Room, Garfield County Courthouse, in Glenwood Springs on Monday , the 17th of June A.D. 1991 , there were present: Arnold L. Mackley Elmer (Buckey) Arbaney Marian I. Smith Don DeFord Mildred Alsdorf Chuck Deschenes , Commissioner Chairman , Commissioner , Commissioner , County Attorney , Clerk of the Board , County Administrator when the following proceedings, among others were had and done, to -wit: RESOLUTION NO. 91-055 A RESOLUTION CONCERNED WITH THE APPROVAL OF A PRELIMINARY PLAN FOR THE CHRISTELEIT SUBDIVISION. WHEREAS, Peter and Linda Christeleit have filed an application with the Board of County Commissioners of Garfield County for approval of a Preliminary Plan for the Christeleit Subdivision. WHEREAS, based on the material submitted by the applicant and then comments of the Garfield County Planning Department, this Board finds as follows: 1. That proper publication, public notice and posting was provided as required by law for the hearings before the Planning Commission and Board of County Commissioners. 2. That the hearings before the Planning Commission and Board of County Commissioners were extensive and complete, that all pertinent facts, matters and issues were submitted and that all interested parties were heard at that hearings. 3. That the Garfield County Planning Commission recommended approval of the Preliminary Plan. 4. That the proposed subdivision of land is in compliance with the recommendations set forth in the Comprehensive Plan for the unincorporated area of the County. 5. That all data, surveys, analyses, studies, plans and designs as are required by the State of Colorado and Garfield County have been submitted, reviewed, and found to meet all sound planning and engineering requirements of the Garfield County Subdivision Regulations. 6. That the proposed subdivision of land conforms to the Garfield County Zoning Resolution. 7. That for the above -stated and other reasons, the proposed subdivision is in the best interest of the health, safety, morals, convenience, order, prosperity and welfare of the citizens of Garfield County. • BOOK 806 mE279 NOW, THEREFORE, BE IT RESOLVED that the Preliminary Plan of the Christeleit Subdivision for the following described unincorporated area of Garfield County be approved with the following conditions: 1. All representations of the applicant, either within the application or stated at the Public Hearing before the Board of County Commissioners shall be considered conditions of approval, unless stated otherwise by the Board of County Commissioners. 2. The applicants shall establish a Homeowner's Association and shall be incorporated in accordance with the requirements of Colorado Revised Statutes. The Homeowner's Association shall be responsible for the Basalt Water Conservancy District water contract and for road maintenance. The articles of incorporation and restrictive covenants shall be reviewed by County Staff prior to the approval of the Final Plat. 3. The applicants shall prepare and submit a subdivision improvements agreement, addressing all on and off-site improvements, prior to the approval of the Final Plat. 4. The applicants shall submit improvement plans for all road, drainage and utility improvements prior to the approval of the Final Plat. 5. All utilities shall be placed underground. 6. All cut slopes created during construction shall be revegetated with native grasses using certified weed -free seed. 7. The applicant shall demonstrate that procedures are ---- established for the maintenance of all roadways, including -- snow removal, through the Homeowner's Association, prior to the approval of the Final Plat. 8. The applicants shall pay $200 per lot in School Impact Fees prior to the approval of the Final Plat. 9. All required permits from the Road and Bridge Department shall be obtained prior to the approval of the Final Plat. 10. All roadways shall be designed and constructed in conformance with design standards set forth in the County Subdivision Regulations and in place at the time of submittal of the Final Plat. 11. The following plat notes shall be included on the Final Plat: A) U.S.F.S. and State Forestry wildfire prevention guidelines shall be incorporated into residential site planning and design. B) A site specific soils report shall be conducted for each residence prepared by a registered professional engineer. C) Engineered foundations and wastewater systems shall be required by the Building Official. D) This subdivision is not located within a fire protection district. E) Lot buyers shall enter into a pre -annexation agreement with the Carbondale Fire Department. 12. The plat shall depict those areas identified in the geology report as too steep for construction on the Final Plat. 13. Prior to the approval of the Final Plat, the applicants shall seed the property in permanent grasses or the property shall remain in cultivation until all lots are sold. • • . 111 aUOK 806 PAGE278 14. Prior to the approval of the Final Plat, the applicants shall establish covenants to insure the construction of a 1500 gallon water storage tank on each lot as an integral portion of the residence.
