• • BOCC 11/14/94 PROJECT INFORMATION AND STAFF COMMENTS REQUEST: APPLICANT: I. DESCRIPTION OF PROPOSAL Amended Plat Lots 7-16, D in Block 7 and Lots B & 1 in Block 14, Amended Plat of the Townsite of Cooperton and the Vacation of a portion of Sopris Avenue between blocks 7 and 14. Jeff Wadley Jolene Singer The applicants are proposing to amend the legal descriptions of lots 7-16, and D of Block 7 and lots B & 1 of Block 14 in the Amended Plat of the Townsite of Cooperton. Additionally, they are requesting the vacation of a portion of Sopris Avenue, which would be added to the adjacent lots being replatted (see pages3• /Q ). The proposed amended plat would result in six (6) lots 62 ft. wide by 156.5 ft. long, containing 9703 sq. ft.. Access to each lot would be off of Mesa Avenue (County Road 106). Water would be provided by the Town of Carbondale and sewage would be treated through the use of individual sewage disposal systems on each lot. II. STAFF AND OTHER COMMENTS A. Satank Community: Enclosed is a copy of a petition signed by 32 people living in the area objecting to the vacation of Sopris Avenue (see pages 11. 13 ). B. CRMS: Larry Green, attorney for CRMS, verbally indicated that the school opposed the proposed vacation of Sopris Avenue. They felt the unimproved access provided the easiest physical access to additional Cooperton lots, owned by the school. C. Zoning: The Satank (Cooperton) area is zoned Residential/Limited/Urban Density (R/L/UD), which requires a 7500 sq. ft. minimum lot size for unsubdivided property. The majority of the Townsite of Cooperton was platted in 25 ft. by 156.5 ft. lots in 1888 and replatted in 1977. Because of the setback requirements of 25 ft. from the front and rear and 10 ft. on the sides, it has been necessary for anyone building in the area to have at least two lots to have a minimum building area. The County regulations do not make provisions for building on a property line where the property owner owns both lots. As a result, property owners are required to vacate the common property line by amending the Cooperton Townsite plat. Because these lots are already nonconforming, the 7500 sq. ft. minimum lot size does not have to be met, when lots are combined. I • • D. Subdivision: Section 6:10 of the Garfield County Subdivision Regulations allows for the amendment of a recorded plat, "if such amendment does not increase the number of subdivision lots or dwelling units result in the major relocation of a road or add new roads". This application does not increase the number of lots as a result of merging the lots together. The requested vacation of a portion of Sopris Avenue could be considered a relocation of a road, since this action would result in the elimination of access to the CRMS parcels. The merger of lots B and 1 in Block 14 would create a 50' x 156' lot. Because there are technically two rights-of-way adjacent the property, a variance front he County zoning setback requirements will be necessary to meet the 25' setback required along both right-of-way. This is because it would be considered a corner lot and is required to have the required 25' front yard setback along both property lines adjoining a public right-of-way. The same issue occurs in the merger of lots D, 16 and 15 Block 7. This can be resolved without a variance request by merging an adequate amount of land from lot 15 to create a building envelope sized to allow for a reasonably sized house. All other merged lots will only have to have 10 ft. from the side lot lines. E. Individual Sewage Disposal Systems: Each lot will need to have an adequate area to allow for a leaching area. If a drywell is going to be proposed on any lot, it will have to be 25 ft. from any property line. There are no variances allowed from the ISDS regulations. This could present a problem on the lots B and 1 in Block 14. All other lots should be capable of meeting the setback requirements, with the understanding that the size of a household may be limited, due to the size of the leach field. In other words, if a large leach field is required due to slow percolation, the number of bedrooms in a house may be limited due to site size. III_ RECOMMENDATION That the Board allow for the merger of lots B and 1, block 14 into one lot and the merger of lots 7-16 and D into no more than four (4) lots. The lot created on the corner of Sopris Avenue and Mesa Avenue needs to be at least 75 ft. wide, and all other lots should have at least 60 ft. of street frontage.
