BACKGROUND AND DESCRIPTION OF THE PROPOSAL This is an amended plat application to vacate the lot line between Lots nd._6-the Cooperton Townsite. This application was previously approved by the BOCC on August 6, 2007. However, a Mylar was not submitted within the required 90 day window (per Section 6:20). As a result, the application has been resubmitted for approval by the BOCC in the same configuration which was presented to the BOCC on August 6, 2007. The Applicant wishes to construct a new home on Lots 5 and 6 which is currently under construction and has an active building permit, but in order to create a workable lot, the applicant is proposing to combine the existing lots. Lots 5, 6, and 7 are all owned by Gregory Forbes and all measure 25' by 156.5' (3912.5 square feet). The combined lots 5 and 6 would create one new lot measuring 50' by 156.5' (7825 square feet). The minimum lot size in the RLU one district is_ZKO square feet. STAFF RECOMMENDATION The Applicant has provided all required documentation and has satisfied the applicable standards for this plat amendment. Therefore, Staff recommends the Board of County Commissioners APPROVE this amended plat request with the following conditions: 1. That all representations of the Applicant, either within the application or stated at the meeting before the Board, shall be considered conditions of approval. 2. Within 90 days of approval, the Amended Final Plat shall be reviewed (paper copy), then signed and dated (mylar copy) by the County Surveyor, then signed and dated by the Chairman of the Board and recorded in the Clerk and Recorder's Office of Garfield County. The Amended Final Plat shall meet the minimum CRS standards for land survey plats, as required by Colorado state law, and approved by the County Surveyor and shall include, at a minimum, the information outlined in §5:22 of the Garfield County Subdivision Regulations. 3 June 18, 2008 Gregory A. This expiration is per Condition Number 2 as approved by the Board of County Commissioners on November 6, 2007 (See Attached). To date, a Mylar for the approved Amended Plat has not been submitted or signed within the mandatory 90 days from the date of approval. That all representations of the Applicant, either within the application or stated at the meeting before the Board, shall be considered conditions of approval. 2. A new driveway access permit issued by Garfield County Road & Bridge Department will need to be acquired for the property. The new driveway access permit will have conditions specific to the location of the driveway access. The conditions will include a paved or concrete apron attached to the edge of the driving surface of Cr. 106. A new_ drivewa access •ermit must be issued •rior to the issuing of a buildin• •ermit. Prior to the issuing of a driveway access permit an onsite visit by Garfield County Road & Bridge Department will be required._ The approval of this application will not be an issue to the traffic impact load on Cr. 106. The plat has since expired and Gregory has resubmitted the Amended Plat application (identical to what was approved last year) for reapproval. He has since started construction for a new home on the property and has a building permit for the home. Since the new home straddles the lot line, a Final Inspection will not be performed until the Amended Plat is completed. I have attached the comments you submitted last year for this application as well as the old staff report. Please let me know if you have any additional comments or whether you would like me to run with the comments you submitted last year.
